(s4, s6, s6A)\n\n- Two grant streams are set out:\n - For full‑time hires (unemployed person, eligible school leaver, or a person who has completed/partly completed an accredited apprenticeship): a $5,000 grant paid in three instalments at about 6, 12 and 18 months after the hire. The employer must sign a grant agreement and keep the new position filled and the overall employment level at least at the same number as on the \"relevant date\". (s6(1), s6(2)(a),(c))\n - For traineeships: either $4,000 in four half‑yearly instalments if the agreement starts at the traineeship commencement (and the employer provides training/employment for 2 years), or $5,000 in three half‑yearly instalments if the agreement starts at the end of the traineeship (and the employer provides 18 months employment). (s6A(1))\n\n- Eligibility and definitions are in section 3: who counts as an \"unemployed person\", an \"eligible school leaver\", a \"trainee\", what a \"full‑time position\" and an \"employment establishment\" mean, and the statutory \"relevant date\" used to measure increases. The Minister can approve particular training or employment programmes for eligibility. (s3(1)–(3))\n\n- The Minister will not make a grant unless satisfied that the employer actually increased their employment, the new position is a genuine opportunity, and the employer is not already receiving major assistance under another Act (unless the Treasurer agrees to an exception). Grants cannot be double‑claimed for the same person/position. (s4(2)–(2B))\n\n- Employers must apply on a Minister‑approved form and verify statements by statutory declaration. False or misleading statements attract criminal penalties and can forfeit grant entitlement and trigger repayment. (s5(1)–(3))\n\n- Grant payments are made under written grant agreements containing conditions. If an employer breaches those conditions (for example, long unexplained breaks, repeated vacancies, failing to maintain employment levels), instalments already paid may be recoverable as a debt to the Crown. (s6, s7(5),(5A),(6))\n\n- Administrative powers: the Secretary may require information by notice, require production of books and documents to authorised State Service officers, and authorised officers have inspection and copying rights of business premises and records. Refusal without reasonable excuse is an offence. (s8)\n\n- The Act includes service rules for notices, grouping rules to treat related or commonly controlled businesses as a single group for determining whether an employer genuinely increased net employment, and a mechanism for the Governor to fix the \"relevant date\" and a day after which no further grants are to be made. (s9, Schedule 1, s3(3), s12)\n\n- Grants are paid from money appropriated by Parliament. (s10)\n\n\nWho decides and who pays\n\n- Decisions to approve grants, make conditions, transfer or cancel grant entitlements, and to exercise many exceptions rest with the Minister (with some powers exercisable only with Treasurer approval in specific cases). (s4, s6, s7, s4(2B))\n- Administrative compliance and enforcement are handled by the Secretary and authorised State Service officers. (s8)\n- The public pays: grants come from Parliamentary appropriations. (s10)\n\n\nWhat behaviours the law is designed to change (and how it does so)\n\n- It aims to increase hires of targeted groups by offering a time‑phased cash payment per successful new hire, conditional on retention and on keeping overall employment at or above the pre‑set reference level (the \"relevant date\"). (s4, s6, s6A)\n- It discourages simple reshuffling of staff between related businesses because the Minister must have regard to employment changes across all businesses the employer controls (and Schedule 1 treats related bodies and commonly controlled businesses as a group for this purpose). (s4(3)–(4), Schedule 1)\n- It limits double‑dipping by disallowing a grant where major assistance is being received under another Act (unless Treasurer approval is obtained) and by allowing adjustment where other Commonwealth assistance was paid for the same wage period. (s4(2)(c),(d), s7(3))\n\n\nOfficial purpose claim and a practical test of trade‑offs\n\n- The Act's stated purpose is to incentivise employers to create and keep jobs for the unemployed, school leavers and trainees. That motive is implemented by modest, time‑contingent payments tied to retention and to maintaining the employer's baseline employment level. (s4, s6, s6A)\n\n- Costs: the grants are paid from public funds (s10). Each successful full‑time hire attracts $5,000 total; traineeship arrangements attract $4,000–$5,000 depending on timing. The program therefore concentrates benefits on employers that apply and meet conditions while imposing a fiscal opportunity cost on other public spending. (s6, s6A, s10)\n\n- Incentives and possible responses:\n - Positive: reduces net cost of hiring for employers who would otherwise pay the full wage cost for the retention period, improving the business case for taking on targeted workers. (s6, s6A)\n - Behavioral risk: employers might try to qualify for grants by reclassifying or relocating staff across related entities or by hiring for the minimum period necessary. The statute addresses some of that risk through group‑accounting rules and retention conditions (s4(3)–(4), Schedule 1, s7(5),(5A)).\n - Administrative burden: employers must complete statutory declarations and support requests for records; the Department has powers to inspect and require documents—imposing compliance costs on small employers. (s5(1), s8)\n\n- Discretion and implementation risk: the Minister has broad discretion to set terms and conditions, approve schemes, transfer or cancel entitlements, and to exclude businesses from groups on factual grounds; those discretions concentrate decision power in the executive and create operational workload for verifying compliance. (s3(2), s6(1)(b), s7(1), Schedule 1 cl6)\n\n- Competition and distributional effects: the direct financial benefit accrues only to employers who go through the application and compliance process and whose net employment increases are accepted by the Minister. That produces concentrated private benefits for successful applicants and diffuse fiscal costs for the public. (s4, s5, s6)\n\n\nConcrete compliance and enforcement levers\n\n- False or misleading statements attract penalties and can void or forfeit grants. (s5(2)–(3))\n- Grant instalments already paid may be recoverable if the employer breaches agreement terms or fails to keep positions filled. Recovery is a debt due to the Crown and enforceable in court. (s7(2),(5),(6))\n- The Secretary and authorised State Service officers can request statutory declarations, inspect premises, and copy records; refusal is an offence. (s8)\n\n\nBottom line (mechanical):\n\n- The Act is a targeted, administratively supervised wage‑subsidy style scheme. It pays modest, staged lump sums to employers who create and retain new positions for unemployed people, school leavers and trainees, subject to conditions, monitoring and recovery powers. It is funded from parliamentary appropriations and administered under Ministerial discretion.
