Citation\n\n\t\tThis order is the *Electricity Corporations (Pilbara Prescribed Customers) Order 2021*.\n\n##### 2. Commencement\n\nThis order comes into operation as follows —\n\n(a) clauses 1 and 2 — on the day on which this order is published in the *Gazette*;\n\n(b) the rest of the order — on the day after that day.\n\n##### 3. Declaration of class of customers (Act s. 54(4)(a))\n\n(1) In this clause —\n\nlight regulation network has the meaning given in the *Pilbara Networks Access Code* section 5;\n\nPilbara ISO has the meaning given in the *Electricity Industry Act 2004* section 120W(1);\n\nsupply point means —\n\n(a) a bidirectional point, as defined in the *Pilbara Networks Access Code* section 5; or\n\n(b) an exit point, as defined in the *Pilbara Networks Access Code* section 5.\n\n(2) The class of customers declared to be prescribed customers for the purposes of section 54(3) of the Act is each customer who is supplied electricity at a supply point in a light regulation network who —\n\n(a) never consumes 1 200 MWh or more of electricity at the supply point in any 12‑month period from 1 January 2020; and\n\n(b) could reasonably be expected by the Pilbara ISO to never consume 1 200 MWh or more of electricity at the supply point in any 12‑month period from the day on which this clause comes into operation.\n\n(3) However, if a customer is supplied electricity at more than 1 supply point in a light regulation network, the customer is not a member of the class described in subclause (2) in relation to any of the following supply points —\n\n(a) a supply point at which the customer consumes 1 200 MWh or more of electricity in any 12‑month period from 1 January 2020;\n\n(b) a supply point at which the customer could reasonably be expected by the Pilbara ISO to consume 1 200 MWh or more of electricity in any 12‑month period from the day on which this clause comes into operation;\n\n(c) a supply point at which electricity is supplied to the customer at the same place as a supply point to which paragraph (a) or (b) applies.\n\n![]()\n\nNotes\n\nThis is a compilation of the *Electricity Corporations (Pilbara Prescribed Customers) Order 2021*. This Order ensures they receive regulated, fair pricing by bringing them under the protection of section 54 of the Electricity Corporations Act 2005. It essentially draws a line between \"big industrial users who can negotiate their own deals\" and \"everyone else who needs price protection.\""},"flash_summary":{"complexity_score":4,"scope_assessment":{"changed":true,"description":"This Order narrows and specifies which customers are \"prescribed customers\" for the purposes of section 54(3) by (a) setting a 1,200 MWh annual consumption cutoff measured from 1 January 2020 and (b) delegating a forward‑looking eligibility judgement to the Pilbara ISO.
