It introduces an entirely new, parallel regime for campus associations at regional State schools and integrates that regime across many governance provisions (substantively changing association governance and participation structures). It creates a formal statutory scheme for transfer notes and imposes new, binding timelines and duties on principals (affecting recordkeeping and inter‑school administrative flows). It also authorises a new privacy/data‑sharing pathway (approved online services) that materially expands the department’s ability to share non‑sensitive student information with third parties under contractual arrangements (a policy area not previously governed in this detail). Other policy additions include extending the home‑education age limit to 18, criminal‑history disqualifications for association office‑holders, and an explicit power for associations to give assistance to other institutions. The campus association regime is applied into many existing provisions by substitution (for example, school council constitutions, proxies, membership rules) so a campus association may replace a whole-school association in those contexts (multiple amending sections throughout ch 7 and sch 4).\n\n- Creates a statutory requirement and process for \"transfer notes\" (a short, approved-form record about a student) and imposes timelines and duties on principals to prepare and share transfer notes when a student leaves a school, or when a new school requests one. Transfer notes must be factual, objective and succinct and must include prescribed items and any safety/wellbeing information the previous principal considers reasonably necessary (ch 14 replacement: ss 383–388E; renumbered definitions in sch 4).\n\n- Permits departmental officers to disclose non-sensitive student personal information to certain third-party online services that the chief executive approves as \"approved online services\", subject to conditions (contractual arrangements, an assessment framework, protections against collection of sensitive information, and public listing of approved services). That is introduced as a new confidentiality exception (s 426A).\n\n- Changes home-education eligibility and related timing rules: a child is eligible for provisional or full registration for home education if they will be at least 5 years 6 months old on 31 December in the year the application is made, and registration may continue until 31 December in the year the child turns 18 (replacement ss 206 and amendment to s 229A).\n\n- Strengthens rules about who must be told and who must respond to departmental notices about compulsory schooling and compulsory participation in education or training by requiring notices may be given to a non‑State school's principal or to its governing body and obliging principals to supply requested information (amended ss 180 and 251AB).\n\n- Requires the principal to tell a suspended student about the suspension and permits the principal to delegate that telling function to an appropriately qualified teacher (amendments and new s 289A acting with s 283).\n\n- Clarifies associations may give assistance (including financial) to other State instructional institutions or their associations if those institutions have been adversely affected by an event (accident, deliberate act, natural disaster) (new s 142A). It also clarifies such assistance is not an \"urgent matter\" for urgent‑matters procedures (amend s 127) and may be an authorised use of association funds (amend s 132).\n\n- Adds disqualification rules that bar people with convictions for indictable offences (other than spent convictions) from being members of associations’ executive committees and subcommittees (amend ss 126, 130).\n\n- Tightens the rules for distance‑education kindergarten registration when the ground is medical need: medical certificates must total more than 10 weeks inability to attend a centre‑based service to qualify (amend s 419F).\n\n- Provides transitional and validation provisions (ch 20 pt 11) to cover existing applications, ongoing reviews, and specific historical situations (notably validating some former parents-and-citizens activity as a campus association for Tagai State College).\n\n**Who is affected**\n\n- Parents and local community members at multi‑campus (regional) State schools: they can form campus associations and participate under a tailored set of functions and limits (ss 154C–154L).\n\n- School principals and heads of campus: new duties to prepare and provide transfer notes (ss 385–388C), to tell suspended students about suspensions (s 283 as amended), to respond to departmental notices (ss 180, 251AB), and to work with campus associations and P&C bodies when constitutions and councils are formed (various ch 7 amendments).\n\n- Non‑State schools and their governing bodies: they may be required to supply information to the department on decisions about compulsory schooling/participation (ss 180, 251AB).\n\n- Departmental officers and the chief executive: new discretion to approve online services and to maintain a public list (s 426A); responsibility for assessing online services and administering new notice and data‑sharing obligations.\n\n- Providers of online education/administration services: they may be eligible to become \"approved online services\" and therefore receive certain non‑sensitive student personal information, subject to contract and departmental approval (s 426A).\n\n- Parents and students moving schools: the new transfer‑note regime creates firm timeframes (principals must produce transfer notes within 10 school days of a request; new schools must ask previous schools within 90 days of enrolment) (ss 388B–388C, 385–386).\n\n- Associations’ governance: people with indictable convictions (non‑spent) are excluded from executive and subcommittee roles (ss 126, 130).\n\n**Why it matters (claimed purposes then pragmatic effects and trade‑offs)**\n\nClaimed purposes (from the text and structure):\n- To give campus‑level parent associations a clear statutory form and to integrate them into existing school governance processes for regional multi‑campus schools (chs 7 and related amendments).\n- To improve continuity of care and safety when students change schools by formalising transfer notes and timelines (ch 14 replacement).\n- To permit secure, contractually governed data sharing with approved online services for school management and learning delivery (s 426A).\n- To clarify home education age eligibility and align the end of registration with 18 years (ss 206, 229A).\n- To permit associations to provide emergency assistance to other institutions affected by events (s 142A).\n\nTesting those claims against likely costs, incentives and risks:\n\n- Implementation and administrative burden: creating campus associations and integrating them across existing governance provisions requires updating constitutions, procedures, ballots, and possibly training for principals, association officers and departmental staff. The Bill inserts campus associations into many pre‑existing provisions (see multiple amendments to ch 7 and sch 4) which will require schools and the department to revise templates, election procedures and meeting rules (ss 94, 95, 109 etc.).\n\n- Compliance and timing costs for principals: transfer‑note obligations impose firm, short deadlines (10 school days) to prepare records and transmit them. New‑school principals must initiate requests within 90 days. These timelines create administrative workload for principals and school offices (ss 385–388C). Failure to meet timelines could create disputes or operational friction when students transfer.\n\n- Privacy and data‑sharing trade‑offs: s 426A expands authorised disclosures of non‑sensitive personal information to approved third‑party online services. The chief executive has broad discretion to approve services (subject to contractual and assessment requirements). This lowers legal friction for using third‑party ed‑tech or administration platforms, but also concentrates decision power in the chief executive and delegates privacy risk assessment to departmental processes. The Bill requires public listing of approved services (s 426A(3)), and prohibits requiring sensitive information for service provision (s 426A(2)(d)), but ongoing security and governance depend on the adequacy of the contract terms and the unspecified assessment framework (s 426A(2)(b),(c)). There is an implementation risk if the department does not maintain rigorous procurement and oversight.\n\n- Market effects and private choice: allowing approved online services to receive student personal information makes it easier for ed‑tech firms to integrate with schools (potentially increasing vendor opportunities). The statutory requirement that the provider be a bound contracted service provider (Information Privacy Act concept) creates a procurement/contractual entry cost that may favour larger vendors able to meet public service contracting standards. That changes the competitive landscape for providers (s 426A(2)(a); definitions).\n\n- Incentives and concentrated benefits: campus associations gain clear statutory authority to raise funds and provide services for a campus (ss 154E–154F). That concentrates benefits locally (parents, campus programs) while costs of compliance (recordkeeping, elections) and any oversight fall on associations and department staff. The power to give assistance to other institutions (s 142A) creates flexibility but could be used to prioritise some campuses/institutions over others depending on local resources.\n\n- Safeguards and exclusion rules: The disqualification of people with indictable convictions from executive or subcommittee roles (ss 126, 130) is an explicit safeguard but introduces a compliance check for associations and may require background checks or self‑disclosure processes.\n\n- Transitional and legal certainty: the Bill provides numerous transitional provisions to apply new rules to in‑flight decisions, existing applications and reviews, which reduces legal uncertainty (ch 20 pt 11: ss 544–555). It also contains a narrow validation provision recognising certain historical campus associations (s 555) which avoids potential retrospective invalidity.\n\n**Who pays and who decides**\n- The department (chief executive) decides which online services are approved and maintains the public list (s 426A). The department also issues notices and requests to non‑State school principals or governing bodies (ss 180, 251AB).\n- School principals (and heads of campus) and association officers implement processes: preparing transfer notes (10 school‑day deadline), responding to notices, convening association meetings, and running ballots (ss 385–388C, 109 and related).\n- Associations may use their funds to give assistance to other State instructional institutions (s 142A; s 132 amendment allows use of association money thirdly for such assistance).\n\n**Summary of practical effects (behaviour changes and likely compliance tasks)**\n- Schools will need procedures and forms to produce transfer notes quickly and to handle incoming requests from new schools within 90 days (ss 388B–388C).\n- Regional State schools will need to manage campus association formation, mapping which existing association provisions apply to campus associations, and update constitutions and election processes (ss 154C–154L; many ch 7 amendments).\n- The department must build or adopt an assessment framework for approving online services, manage procurement/contractual arrangements, and publish and maintain a list of approved services (s 426A).\n- Associations must check executive and subcommittee members’ criminal history eligibility (ss 126, 130).\n\n**Key sections to refer to**\n- Campus associations: ss 154A–154L (new ch 7 pt 11) and associated amendments to ch 7 and sch 4.\n- Transfer notes and timelines: ss 383–388D (new ch 14 parts) and ss 385–388E.\n- Approved online services/confidentiality exception: s 426A.\n- Home education eligibility and age end point: s 206 (replacement) and s 229A (amendment).\n- Principal must tell suspended student / delegation: s 283 (amend) and new s 289A.\n- Associations giving assistance: s 142A; s 127 clarification; s 132 amendment on use of money.\n- Disqualification for association executive/subcommittee roles: ss 126, 130.\n\nThis is a procedural and structural package of reforms that builds new local‑level association structures for regional schools, formalises school‑to‑school transfer information flows, introduces a controlled pathway for the department to share student personal information with approved online services, extends the age scope for home education registration, and tightens governance checks for associations."}},"importantCases":[],"_links":{"self":"/api/acts/education-general-provisions-amendment-bill-2025","history":"/api/acts/education-general-provisions-amendment-bill-2025/history","analysis":"/api/acts/education-general-provisions-amendment-bill-2025/analysis","conflicts":"/api/acts/education-general-provisions-amendment-bill-2025/conflicts","importantCases":"/api/acts/education-general-provisions-amendment-bill-2025/important-cases","documents":"/api/acts/education-general-provisions-amendment-bill-2025/documents"}}
