Bill for this Act was \"A Bill to establish the Docklands Authority and to make other provision to facilitate the development of the docklands area and for other purposes.\".\n\nThe **Docklands Authority Act 1991** was assented on 21 May 1991 and came into operation as follows:\n\nSections 1–30, 32–57 on 5 June 1991: Government Gazette 5 June 1991 page 1450; section 31 on 20 July 1998: Government Gazette 16 July 1998 page 1924.\n\nThe name of this Act was changed from the **Docklands Authority Act 1991** to the **Docklands Act 1991** by Act No. 59/2003 section 91.\n\nINTERPRETATION OF LEGISLATION ACT 1984 (ILA)\n\nStyle changes\n\nSection 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.\n\nReferences to ILA s. 39B\n\nSidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided section or clause of a Schedule is amended by the insertion of one or more subsections or subclauses, the original section or clause becomes subsection or subclause (1) and is amended by the insertion of the expression \"(1)\" at the beginning of the original section or clause.\n\nInterpretation\n\nAs from 1 January 2001, amendments to section 36 of the ILA have the following effects:\n\n• Headings\n\nAll headings included in an Act which is passed on or after 1 January 2001 form part of that Act. Any heading inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, forms part of that Act. This includes headings to Parts, Divisions or Subdivisions in a Schedule; sections; clauses; items; tables; columns; examples; diagrams; notes or forms. See section 36(1A)(2A).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in an Act which is passed on or after 1 January 2001 form part of that Act. Any examples, diagrams or notes inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, form part of that Act. See section 36(3A).\n\n• Punctuation\n\nAll punctuation included in an Act which is passed on or after 1 January 2001 forms part of that Act. Any punctuation inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, forms part of that Act. See section 36(3B).\n\n• Provision numbers\n\nAll provision numbers included in an Act form part of that Act, whether inserted in the Act before, on or after 1 January 2001. Provision numbers include section numbers, subsection numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of an Act is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of an Act.  \nSee section 36(3)(3D)(3E).\n\n2 Table of Amendments\n\nThis publication incorporates amendments made to the **Docklands Act 1991** by Acts and subordinate instruments.\n\n–––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––\n\n**Docklands Authority (Amendment) Act 1993, No. 24/1993**\n\n| Assent Date: | 25.5.93 |\n| Commencement Date: | 25.5.93: s. 2 |\n\n**Building Act 1993, No. 126/1993**\n\n| Assent Date: | 14.12.93 |\n| Commencement Date: | S. 264(Sch. 5 item 6) on 1.7.94: Special Gazette (No. 42) 1.7.94 p. 1 |\n\n**Financial Management (Consequential Amendments) Act 1994, No. 31/1994**\n\n| Assent Date: | 31.5.94 |\n| Commencement Date: | S. 4(Sch. 2 item 23) on 1.1.95: Government Gazette 28.7.94 p. 2055 |\n\n**Port Services Act 1995, No. 82/1995**\n\n| Assent Date: | 8.11.95 |\n| Commencement Date: | S. 202 on 14.12.95: Government Gazette 14.12.95 p. 3488—see **Interpretation of Legislation Act 1984** |\n\n**Miscellaneous Acts (Omnibus Amendments) Act 1995, No. 100/1995**\n\n| Assent Date: | 5.12.95 |\n| Commencement Date: | S. 10(1)(Sch. 1 item 3) on 30.4.96: Special Gazette (No. 45) 30.4.96 p. 1 |\n\n**Melbourne City Link Act 1995, No. 107/1995**\n\n| Assent Date: | 12.12.95 |\n| Commencement Date: | S. 125 on 14.12.95: Special Gazette (No. 120) 14.12.95 p. 3 |\n\n**Parliament House Completion Authority Act 1996, No. 9/1996**\n\n| Assent Date: | 25.6.96 |\n| Commencement Date: | 25.6.96: s. 2 |\n\n**Miscellaneous Acts (Further Omnibus Amendments) Act 1996, No. 73/1996**\n\n| Assent Date: | 17.12.96 |\n| Commencement Date: | Pt 9 (ss 15–17) on 17.12.96: s. 2(1) |\n\n**Port Services (Amendment) Act 1997, No. 63/1997**\n\n| Assent Date: | 5.11.97 |\n| Commencement Date: | S. 10(4)(Sch. items 1.1–1.6) on 10.12.97: Government Gazette 4.12.97 p. 3290 |\n\n**Docklands Authority (Amendment) Act 1997, No. 66/1997**\n\n| Assent Date: | 18.11.97 |\n| Commencement Date: | 18.11.97: s. 2 |\n\n**Rail Corporations (Amendment) Act 1997, No. 104/1997**\n\n| Assent Date: | 16.12.97 |\n| Commencement Date: | S. 43 on 31.3.98: Special Gazette (No. 23) 31.3.98 p. 1 |\n\n**Building (Amendment) Act 1998, No. 18/1998**\n\n| Assent Date: | 5.5.98 |\n| Commencement Date: | S. 12 on 20.7.98: Government Gazette 16.7.98 p. 1924 |\n\n**Public Sector Reform (Miscellaneous Amendments) Act 1998, No. 46/1998**\n\n| Assent Date: | 26.5.98 |\n| Commencement Date: | S. 7(Sch. 1) on 1.7.98: s. 2(2) |\n\n**Transfer of Land (Single Register) Act 1998, No. 85/1998**\n\n| Assent Date: | 17.11.98 |\n| Commencement Date: | S. 24(Sch. item 18) on 1.1.99: s. 2(3) |\n\n**Local Government (Governance and Melton) Act 1998, No. 86/1998**\n\n| Assent Date: | 17.11.98 |\n| Commencement Date: | S. 13 on 17.11.98: s. 2(1); What began as a comprehensive 'shadow council' for a new city precinct is now primarily a land development and financing framework."},"complexity_factors":["Multiple amending Acts (over 30) creating layered, sometimes inconsistent provisions","Extensive cross-referencing to other Victorian legislation (Planning and Environment Act 1987, Crown Land (Reserves) Act 1978, Transport Integration Act 2010, etc.)","Transitional provisions in Part 7 that create parallel regimes — some powers transferred to Melbourne City Council, others retained by Development Victoria","Conditional powers requiring multiple approvals (e.g., Governor in Council + Minister + other Ministers for certain actions)","Repealed and substituted sections throughout, with notes showing historical changes","Definitions section with 15+ defined terms, some with nested definitions (e.g., 'development', 'land', 'infrastructure')","Special provisions for easements, negotiation bonds, and planning agreements that incorporate external legislation by reference"],"plain_english_summary":"This Act sets up the legal framework for developing Melbourne's Docklands area — a major waterfront urban renewal project. It gives **Development Victoria** (a government agency) special powers to transform this former industrial port area into a mixed-use precinct with homes, businesses, and public spaces.\n\n**Key things the Act does:**\n\n- **Land powers**: Development Victoria can acquire, hold, and sell land in the Docklands area. It can force other government bodies to surrender land, buy land from private owners (even compulsorily), and grant leases or sell land to developers.\n\n- **Infrastructure**: It can build or alter roads, railways, port facilities, and waterways — though it needs approval from relevant transport bodies like Ports Victoria or the Melbourne City Council.\n\n- **Funding**: Development Victoria must maintain a \"Docklands Fund\" for all money received and spent on the project, and must aim to make a \"prudent financial return\" on its commercial investments.\n\n- **Charges**: It can levy special charges on property owners for services like telecommunications, area promotion, or shared infrastructure — similar to council rates but specific to Docklands.\n\n- **By-laws**: It can make local rules about behaviour, property use, and services in the area, with penalties up to 10 penalty units for breaches.\n\n- **Transition to normal council control**: Since 2007, most functions have gradually transferred back to the **Melbourne City Council** — sewers, drains, roads, and rates now go to the Council. Development Victoria retains some land management and development coordination roles.\n\n**Who it affects**: Property owners, developers, and residents in the Docklands area; government agencies with land or functions in the area; and the Melbourne City Council.\n\n**Why it matters**: This Act created a special \"development authority\" model that let the government fast-track a massive urban renewal project with powers that override normal planning and council processes. It's now winding down as the area becomes a normal part of the city."}},"importantCases":[],"_links":{"self":"/api/acts/docklands-act-1991","history":"/api/acts/docklands-act-1991/history","analysis":"/api/acts/docklands-act-1991/analysis","conflicts":"/api/acts/docklands-act-1991/conflicts","importantCases":"/api/acts/docklands-act-1991/important-cases","documents":"/api/acts/docklands-act-1991/documents"}}
