When an application is filed, the court registrar must set a hearing date that allows at least 14 clear days’ service of copies on the respondent and others affected (reg 6). Service rules reflect that 14‑day minimum (reg 7) but the court can allow shorter notice if it accepts that at hearing.\n- If someone served with an application fails to attend the hearing (in person or by lawyer), the court may hear the matter and make orders in that person’s absence (reg 8).\n- Schedule 2 contains prescribed forms for all standard notices and court applications under the Act (for example: notice that goods are ready for redelivery, notice of intention to sell, applications to the Magistrates Court for orders to sell/dispose, and post‑disposal records). Some notices require copies to be sent to the Commissioner of Police and to any persons known to claim an interest in the goods (see Forms 2, 4, 5, 6 and others).\n\n**Who this affects**\n\n- Bailees: the businesses or persons who have custody of uncollected goods (e.g. repairers, storage providers, auction houses). They must use the forms and follow the service, filing and timing rules before selling or disposing of goods.\n- Bailors/owners: people who left their goods; they receive notices and have specified time windows to collect, give directions for redelivery, or dispute the matters in the notice.\n- Other interested persons and the Commissioner of Police: may receive copies of certain notices and can be affected by disposal applications.\n- Magistrates Court and court staff (registrars): they administer filing, set hearing dates, and may make orders including in the absence of the person served.\n\n**Why it matters (official aim and a practical test of that aim)**\n\n- Officially: the regulations exist to implement the Act’s disposal process — to make sure uncollected goods can be notified, dealt with and, where appropriate, sold or destroyed in an orderly way and with legal certainty (see regs 3–8 and Schedules).\n\n- How that aim plays out in practice (costs, incentives, trade‑offs, risks):\n  - Who pays and who benefits: Bailees bear the administrative cost of notices, service and possible court applications; they obtain a legal route to recover charges and to clear premises by selling or disposing of goods if bailors do not collect them (forms and court procedures govern how charges and sale proceeds are recorded — Forms 13–14 and related regs). This concentrates the procedural benefit on bailees who follow the rules.\n  - Compliance burden and timing risk: The regulations impose fixed procedural steps (prescribed forms, record keeping, at least 14 clear days’ service) that add administrative time and cost to disposal. If service is defective or time limits are missed, bailees may need to re‑start the process or face court refusal. The court’s power to hear matters in a party’s absence (reg 8) reduces delay risk for bailees but increases the risk to bailors who do not receive or fail to act on notices.\n  - Verification and evidence: Prescribed forms require particular particulars to be completed. Accuracy matters: incorrect descriptions, valuations or failure to copy the Commissioner of Police (where required) can create legal exposure or invalidate a disposal.\n  - Valuation threshold: The regulations interact with value‑based Parts of the Act (e.g. goods over $3,500 require different procedure and court involvement — Forms 2 and 8). That threshold creates a legal bifurcation; misclassification of value can change the process and the costs involved.\n  - Substitution effects: The rules make it simpler for businesses to recover unpaid storage/repair charges by disposing of uncollected goods, which may lower the cost of offering such services. But they also impose record‑keeping and legal‑process costs that small operators must absorb.\n  - Enforcement and discretion: The Magistrates Court retains discretion to approve charges and orders (forms and records support any court determination). The regulations standardise procedure but leave substantive decisions (e.g. amount approved as reasonable charge, whether disposal was lawful) to the court.\n\n**Key behavioural changes the regulations produce**\n\n- Bailees must follow prescribed notice forms and service timelines before disposing of goods; this formalises the route to sell/destroy goods and to recover charges.\n- Bailors must act within the notice periods or risk losing goods; if they dispute matters they must do so in writing within the time specified.\n- Courts and registrars must manage scheduling so affected persons have at least 14 clear days’ notice (unless the court accepts shorter notice at hearing).\n\n**Relevant sections (examples)**\n- Prescribed goods list: Schedule 1.  \n- Prescribed forms and completion requirement: reg 4 and Schedule 2.  \n- Place for filing application: reg 5.  \n- Hearing scheduling and minimum service period: regs 6–7.  \n- Power to hear in absence of served person: reg 8.\n\n"},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available. It covers things left at repair shops, storage facilities, or any situation where someone (the \"bailee\") is holding goods for someone else (the \"bailor\") who doesn't come back for them.\n\n**Key features:**\n\n- **Prescribed goods list:** Schedule 1 lists specific low-value items (like bicycles, books, bedding, and sporting equipment) that can be sold or disposed of through a simpler process under Part II of the Act.\n\n- **Court applications:** The regulations specify that applications to dispose of goods must be filed at the court nearest to where the goods were originally left, and that everyone affected must get at least 14 days' notice of any hearing.\n\n- **Standard forms:** Schedule 2 provides 13 different template forms (Forms 1–10, 12–14) for various situations, including:\n  - Notifying owners that goods are ready for collection\n  - Warning owners of intention to sell\n  - Applying to court for permission to dispose of high-value goods (over $3,500)\n  - Recording how goods were disposed of\n\n- **Different tracks for different values:** The forms distinguish between low-value \"prescribed goods\" (simpler process) and goods worth more than $3,500 (requires court order).\n\n**Who it affects:**\nRepairers, storage businesses, second-hand dealers, pawnbrokers, and anyone who ends up holding someone else's property. It also protects property owners by ensuring they get proper notice and a chance to reclaim their goods before disposal.\n\n**Why it matters:**\nWithout these rules, businesses would be stuck storing abandoned property indefinitely, or risk breaking the law by selling someone else's goods. These regulations provide a clear, legal pathway to clear out uncollected items while protecting owners' rights through proper notice and court oversight for valuable items."}},"importantCases":[],"_links":{"self":"/api/acts/disposal-of-uncollected-goods-regulations-1971","history":"/api/acts/disposal-of-uncollected-goods-regulations-1971/history","analysis":"/api/acts/disposal-of-uncollected-goods-regulations-1971/analysis","conflicts":"/api/acts/disposal-of-uncollected-goods-regulations-1971/conflicts","importantCases":"/api/acts/disposal-of-uncollected-goods-regulations-1971/important-cases","documents":"/api/acts/disposal-of-uncollected-goods-regulations-1971/documents"}}
