{"id":"F2008L02322","name":"Determination to Reduce Appropriations Upon Request (No. 11 of 2007-2008)","slug":"determination-to-reduce-appropriations-upon-request-no-11-of-2007-2008","collection":"legislative_instrument","jurisdiction":"commonwealth","status":"repealed","isInForce":false,"actNumber":null,"makingDate":null,"administeringDepartment":null,"currentVersion":{"id":139373,"registerId":"commonwealth-F2008L02322-current","compilationNumber":null,"startDate":"2026-04-03","status":"Repealed","reasons":null,"registeredAt":null},"sections":[{"sectionNumber":"1","sectionType":"section","heading":"Determination to Reduce Appropriations Upon Request (No. 11 of 2007-2008)","content":"![](image.001.png)\n\nDetermination to Reduce Appropriations Upon Request (No. 11 of 2007-2008)\n\nAnnual Appropriation Acts\n\nI, Lindsay Tanner, Minister for Finance and Deregulation, make this Determination under subsection 9(1) of the following annual Appropriation Acts:\n\nAppropriation Act (No. 1) 2006-2007\n\nAppropriation Act (No. 1) 2007-2008\n\nAppropriation Act (No. 3) 2007-2008\n\nAppropriation (Northern Territory National Emergency Response) Act (No. 1) \n2007-2008\n\nDated 24 June 2008\n\nLINDSAY TANNER\n\nMinister for Finance and Deregulation\n\nPart 1 Preliminary\n\n1.1 Name of Determination\n\nThis Determination is the Determination to Reduce Appropriations Upon Request (No. 11 of 2007-2008).\n\n1.2 Commencement\n\nThis Determination commences on 30 June 2008.\n\n1.3 The Legislative Authority under which the Instrument is made\n\nSubsection 9(1) of Appropriation Acts (No. 1) and (No. 3) enables the Minister for Finance and Deregulation to make a Determination reducing a departmental item for an entity by the amount specified in the Determination, upon receipt of a written request from the Minister responsible for that entity.\n\nThe provision was included in the Appropriation Acts to enable excess departmental appropriation items to be extinguished.\n\n1.4 Purpose of the Instrument\n\nThe instrument determines that the appropriation items for the entities listed in the Schedules are reduced by the amounts indicated in Column 5 of each provision.\n\n1.5 Notes on the Instrument\n\nThe Schedules to the instrument list the entities to which a determination applies. The entities are listed alphabetically, by portfolio.\n\nEach entity’s reduction determination table is contained within an individual provision. Each provision provides that the entity in column 1, has the appropriation item in column 2, under the legislative authority in column 3, through the request by the responsible Minister in Column 4, reduced, by the amount in column 5.\n\nThe instrument reflects entity and portfolio names contained in the appropriation Acts under which reductions are made, noting that these may have subsequently been changed by, for example, machinery of government changes.\n\n1.6 Disallowance\n\nSubsection 9(9) of the Appropriation Acts that this determination is made under provides that a determination made under subsection 9(1) is a legislative instrument and despite subsection 44(2) of the Legislative Instruments Act 2003, (which provides that Instruments made under Annual Appropriation Acts are not subject to disallowance under section 42 of the Legislative Instruments Act 2003) section 42 of that Act applies to this Determination.\n\n1.7 Reductions in Appropriation Act (No. 1) 2006\\-2007\n\nSchedule 1 contains reduction determinations for entities for departmental items appropriated by Appropriation Act (No. 1) 2006\\-2007.\n\n1.8 Reductions in Appropriation Act (No. 1)
