It updates eligibility rules, definitions and payment rules for a range of ADF (Australian Defence Force) entitlements. The amendments take effect 12 December 2019 (see front matter).\n\n- Key mechanical changes by topic:\n  - Applicant travel, accommodation and meals (Schedule 1): replaces the rules that reimburse people who apply to join the ADF for travel, accommodation and meals. It narrows eligibility to applicants who are asked to attend a Defence Force Recruiting Centre and live outside metropolitan public-transport service areas; sets specific payment rules depending on travel mode (private vehicle or regional/public transport including air) and caps reimbursements to the lesser of Commonwealth fare rates or the fares paid (section 2.1.4). It replaces the previous country-applicant provision (section 4.5.8 removed).\n  - Removals, housing and travel for ADF retention (Schedule 2): introduces definitions and specific rules for members posted to seagoing ships or submarines (new definition: “ship’s home port”, section 1.3.73A; refitting port definition altered, section 1.3.64). It sets when dependants may be moved to a personal location at Commonwealth expense (section 6.5.21) and reworks removal entitlements for members posted to ships/submarines (section 6.5.36). It modifies when members and dependants are eligible for service residences, travel on next posting, and limits on removal benefits (inter alia sections 6.5.21, 6.5.36, 6.5.71, 7.6.29.1, 7.6.64, 9.3.9 and others).\n  - Evacuation assistance (Schedule 3): inserts a new Part 11 (sections 7.11.1–7.11.7) to provide short-term evacuation support for members and their dependants who occupy Service residences or living-in accommodation on a Defence establishment that is evacuated in an emergency. It defines “Emergency” and “Evacuation order” (sections 1.3.21A and 1.3.24AA) and sets entitlement mechanics for accommodation, meals, transport allowances (vehicle allowance if driving >50 km), and a discretionary reimbursement up to $500 for exceptional costs (sections 7.11.4–7.11.7).\n  - Long-term overseas postings (Schedule 4): adds Divisions clarifying overseas living allowance treatment when members or dependants are temporarily absent for more than 28 days, or a member leaves before dependants (sections 15.2A.21–15.2A.25). It also creates rules for meal allowances for additional duty, temporary accommodation meal reimbursement, and a special garment allowance (sections 15.2A.26–15.2A.29). Calculation mechanics reference exchange rates and post indices for precise rates.\n  - Overseas benchmark schools and hardship locations (Schedule 5): modifies the benchmark schools list (adds International School Brunei and adjusts Italian entries) and updates Brunei’s hardship/location entry (Annexes 15.6.A and 16.B).\n  - Deployment allowance – Operation STEADFAST (Schedules 6 & 7): adds Iraq as an Operation STEADFAST deployment location with a daily rate (AUD 166.44) and provides a transitional (retroactive) payment regime for members who served earlier unremunerated periods between 10 Sept 2018 and the Determination’s commencement (Schedule 7 table with three date bands and corresponding daily rates).\n\n**Who is affected**\n\n- People applying to join the ADF (applicants) who travel to recruiting centres will be affected by the changed eligibility criteria and capped reimbursement rules (Schedule 1; see section 2.1.4).\n- Serving ADF members and their dependants, especially Navy personnel posted to seagoing ships or submarines, because removal, travel and service-residence entitlements are adjusted (Schedule 2; see sections 6.5.21, 6.5.36, 6.5.71 and related provisions).\n- Members and dependants who occupy Service residences on Defence establishments may receive evacuation assistance if an evacuation order is issued (Schedule 3; sections 7.11.1–7.11.7).\n- Members posted overseas (post-1 July 2017 postings) — allowances for temporary absences, meals on additional duty, temporary accommodation meal costs, and a special garment allowance are clarified or introduced (Schedule 4; sections 15.2A.21–15.2A.29).\n- Families using Defence-funded benchmark schools overseas (and the schools themselves) are affected by changes to the benchmark list (Schedule 5, Annex 15.6.A).\n- Members who served on Operation STEADFAST (Iraq) may receive deployment allowance payments, including back-pay for certain earlier service dates (Schedules 6–7).\n\n**Why it matters (claimed purposes and practical consequences)**\n\n- Claimed purposes in the instrument: to refine and clarify conditions of service entitlements, align benefits with operational circumstances (notably seagoing service), provide emergency evacuation support to personnel in Service accommodation, and ensure correct allowance payment for specific deployments (schedules cite their purposes, e.g. 2.1.3, 7.11.1, 15.2A.21, 15.2A.26).\n\n- Practical effects and fiscal bearings:\n  - Concentrated beneficiaries: the primary beneficiaries are specific groups — job applicants who travel for interviews, Navy members and their dependants affected by ship postings, overseas-posted members and families (school-related benefits), and personnel who served on Operation STEADFAST. These are relatively concentrated populations within the ADF.\n  - Costs fall to the Commonwealth (the taxpayer). The Determination adjusts what the Commonwealth will reimburse: in some cases it tightens caps (for applicants, travel is limited to lesser of Commonwealth fare or actual fare under section 2.1.4), in others it expands or clarifies liability (evacuation accommodation/meals, seagoing dependants’ removals, backdated deployment allowances). These changes change the timing and certainty of cash flows for affected individuals and for Defence budgeting.\n  - Bureaucratic discretion and decision points: several provisions give decision-making to senior officials. Examples: the Chief of the Defence Force (CDF) must be satisfied that a personal location is beneficial before permitting dependants’ removals (section 6.5.21.c and 6.5.21.c.i–iii); the Senior ADF Officer decides whether an evacuation order is issued and whether exceptional reimbursements are payable (section 7.11.7). Those discretion points create administrative judgment calls and record-keeping burdens.\n  - Administrative and compliance burden: members, applicants and families must provide evidence of travel, fares, accommodation costs and meet specific temporal thresholds (e.g. 28-day absence tests in sections 15.2A.23–15.2A.25). Defence staff must process claims, apply caps and compute allowances referencing other sections or annexes (e.g. vehicle rate in 9.6.25, meal caps in Annex 13.3.A or table in section 7.5.24). This increases transactional work and audit points.\n  - Incentives and potential behavioural effects: reimbursement rules tied to the lesser of Commonwealth fares or actual fares (section 2.1.4) reduce incentives for over‑claiming but may encourage claimants to select lower-cost options. Travel-to-appointment eligibility limits (e.g. living outside metropolitan transport service areas, section 2.1.4.1.d) may shift applicant behaviour (applicants might travel from a different residence to qualify, or choose different travel modes). Where the CDF can approve extensions (section 15.2A.25.3), members may seek discretionary exceptions.\n  - Effects on private markets and competition: directly limited. Some knock‑on demand changes may occur — for example, Defence-financed accommodation and meal costs during evacuation (section 7.11.4–7.11.6) create short-term demand for local hotels and catering providers; benchmarking schools’ inclusion could increase demand for particular private schools overseas (Annex 15.6.A). Overall, these are targeted public purchases rather than regulations that alter market structure or competition broadly.\n\n**Trade-offs, risks and implementation notes**\n\n- Opportunity and fiscal cost: the Determination balances tightened caps in some places (applicant travel) against expanded or clarified entitlements in others (evacuation assistance, seagoing personnel removals, overseas allowances). Net fiscal impact depends on utilisation (how many applicants claim, frequency of evacuations, number of seagoing postings and overseas absences).\n- Discretion vs predictability: CDF and Senior ADF Officer discretion allows flexibility to handle special cases but reduces predictability for members and increases record-keeping, appeals or review risks (sections 6.5.21, 7.11.7, 15.2A.25.3).\n- Retroactivity and transitional risk: Schedule 7 creates retroactive entitlements for Operation STEADFAST for defined date bands and specific members (transitional table). Retroactive payments can create administrative and budgeting pressure and expectations for similar retrospective claims elsewhere.\n- Potential for substitution or gaming: where reimbursement is the lesser of Commonwealth cost or member cost (section 2.1.4.2.b, section 6.5.71.4), claimants will have an incentive to choose modes and invoices that maximise their reimbursement net of the Commonwealth cap. The Determination attempts to limit overpayment by reference to Commonwealth fares and pre-existing caps.\n\n**Representative section citations (samples)**\n- Applicant travel and caps: section 2.1.4 (Schedule 1).\n- Seagoing ship/submarine definitions and removal rules: sections 1.3.64, 1.3.73A, 6.5.21 and 6.5.36 (Schedule 2).\n- New evacuation assistance Part 11: sections 7.11.1–7.11.7 and definitions 1.3.21A, 1.3.24AA (Schedule 3).\n- Overseas posting absence/allowance rules and meal/clothing provisions: sections 15.2A.21–15.2A.29 (Schedule 4).\n- Benchmark schools and hardship location adjustments: Annex 15.6.A and Annex 16.B (Schedule 5).\n- Operation STEADFAST deployment allowance and transitional payment table: subsection 17.7.6.1 and Schedule 7.\n\n"}},"importantCases":[],"_links":{"self":"/api/acts/defence-determination-conditions-of-service-amendment-omnibus-determination-2019-no-34","history":"/api/acts/defence-determination-conditions-of-service-amendment-omnibus-determination-2019-no-34/history","analysis":"/api/acts/defence-determination-conditions-of-service-amendment-omnibus-determination-2019-no-34/analysis","conflicts":"/api/acts/defence-determination-conditions-of-service-amendment-omnibus-determination-2019-no-34/conflicts","importantCases":"/api/acts/defence-determination-conditions-of-service-amendment-omnibus-determination-2019-no-34/important-cases","documents":"/api/acts/defence-determination-conditions-of-service-amendment-omnibus-determination-2019-no-34/documents"}}
