It establishes **Dams Safety NSW** — a government agency responsible for regulating dam safety — and gives it significant powers to monitor, direct, and intervene when dams are unsafe.\n\n**Who it affects:**\n\n* **Dam owners** — anyone who owns, controls, operates, or manages a \"declared dam\" (a dam officially classified as high-risk). They must comply with safety standards, prepare maintenance and emergency plans, submit to audits, and pay a safety levy.\n* **Dams Safety NSW** — the regulator with powers to declare dams, set standards, issue directions, conduct emergency interventions, and prosecute offences.\n* **Mining companies** — must consult with Dams Safety NSW before getting approval to mine near declared dams.\n* **The public** — benefits from reduced flood and dam failure risks, and can access information about dam safety compliance.\n\n**Key requirements:**\n\n* **Declared dams** must meet prescribed safety standards, have operations and maintenance plans, and emergency plans (ss 14–17).\n* **Dams Safety NSW** can conduct audits, issue compliance notices, give \"stop work\" directions, and take emergency control of failing dams (ss 18–21).\n* **Authorised officers** have broad investigation powers including entering premises, seizing evidence, and requiring information (Part 4).\n* **Formal inquiries** can be held into dam safety incidents (Part 5).\n* **Serious penalties** apply — up to 10,000 penalty units for corporations (roughly $1.1 million) for failing to comply with safety standards or emergency directions.\n\n**Why it matters:**\n\nDam failures can cause catastrophic flooding, loss of life, and environmental damage. This Act shifts from a reactive approach to proactive risk management, requiring owners to demonstrate ongoing compliance and allowing the regulator to step in before disasters occur. It also ensures mining activities near dams don't compromise their structural integrity."},"summary":{"complexity_score":6,"scope_assessment":{"changed":true,"description":"The Act has undergone at least 10 amendments since its original commencement in September 2015, suggesting the scope has evolved beyond the original intent.
