Multiple provisions related to reporting, business plans, meetings and other operational details have been omitted or renumbered and governance aligned with the Financial Management Act and Public Sector Management Act (see Endnotes 3–4). Schedule 1 is authoritatively bounded but can be expanded by Ministerial declaration (s 4(2)–(3))."},"complexity_factors":["Interdependence with other Territory laws: governance and obligations reference the Financial Management Act (pt 2 notes; s 7 references governmental policies) and the Public Sector Management Act for staff employment (s 12(2); note to pt 2).","Ministerial control and cost allocation: Minister may give binding written directions and the Territory must pay reasonable costs of compliance, with dispute resolution by the Chief Minister if Treasurer and corporation cannot agree (s 14(1)–(5)).","Defined institutional structure: fixed 7‑member governing board including the CEO, and mandatory advisory committees for 3 areas, creating multiple decision nodes (s 10; s 11; s 8(1)).","Designated locations regime: Schedule 1 lists specific venues and the Minister can add locations by disallowable instrument, introducing rulemaking and parliamentary oversight (s 4(1)–(3); sch 1).","Regulatory and procedural delegation: regulation‑making power for the Executive (s 17) and allowance to engage consultants but not to hire them as employees (s 13), creating administrative constraints.","Amendment history and redrafting: numerous renumberings, omissions and substitutions (see Endnotes 3–4) increase interpretive complexity when comparing current text to earlier versions."],"plain_english_summary":"This Act creates the Cultural Facilities Corporation to run, develop and promote cultural activities and to manage specific ‘designated’ venues (listed in Schedule 1 and able to be added by the Minister) (s 5–6, s 4, sch 1). It sets the governing board, requires a public‑servant CEO and public‑sector employment for staff, and allows the Minister to give written directions that the corporation must follow (s 10–11, s 12, s 14). These mechanics centralise venue management and link the corporation to government governance and policy (s 7)."},"kimi_summary":{"content_quality":"ok","complexity_score":3,"scope_assessment":{"changed":true,"description":"The legislation has narrowed in scope compared to its original 1997 form. The amendment history shows significant stripping out of provisions: original sections dealing with business plans (ss 22-26), quarterly reports (s 15), annual reports (s 16), and detailed governance mechanisms were removed in 2005-2006 amendments. These functions were largely transferred to the Financial Management Act 1996, which now provides the generic governance framework for all ACT territory authorities. The current Act is essentially a 'shell' that establishes the corporation and lists its specific functions, while relying on external legislation for operational details. The original Act appears to have been more comprehensive and self-contained."},"complexity_factors":["Short statute — only 17 sections plus a schedule and dictionary","Minimal defined terms — only 4 specific definitions in the dictionary (corporation, cultural activities, designated location, governing board), with other terms relying on the general Legislation Act definitions","Heavy reliance on external legislation — the Financial Management Act 1996 governs most corporate governance details (board appointments, meetings, conflicts of interest), and the Public Sector Management Act 1994 governs staffing, meaning this Act is intentionally incomplete without cross-referencing","Simple conditional logic — only one substantive limitation (s 13(2) prohibiting employment contracts with consultants)","No nested exceptions or complex temporal provisions","Straightforward administrative structure — no offence provisions, no complex compliance mechanisms, no intricate delegation chains"],"plain_english_summary":"The Act creates the Cultural Facilities Corporation to operate and develop Canberra’s major cultural venues and collections (museums, galleries, historic sites and performing arts locations). It affects visitors, staff, board members and the ACT Government by centralising management of key cultural sites while allowing ministerial directions and policy oversight. It matters because it gives these institutions a dedicated legal structure balancing operational independence with government accountability and costed compliance when directions are issued."},"flash_summary_failed":{"failed":true,"reason":"Unauthenticated.
