Based on the text provided, it performs the same narrow naming function and does not, on its face, broaden or narrow the legal scope beyond that function."},"complexity_factors":["Very narrow, single‑issue instrument: sole substantive act is to specify an organisation under the Criminal Code — reg 5(1).","Lists multiple alternative names/aliases that expand the label’s coverage and reduce ambiguity about identity — reg 5(2)(a)–(i).","Replaces and repeals the 2020 regulation, so continuity questions exist but the instrument itself is short — Schedule 1.","Immediate and fixed commencement date creates prompt legal effect — reg 2(1).","Cross‑references other statute provisions ( Criminal Code Act 1995 and subsection 102.1(1) ), so legal effect depends on interpreting those provisions — reg 3; reg 5(1).","Low administrative discretion: executive lists the name; no new licensing or regulatory regime introduced (minimal implementing apparatus).","Compliance burden concentrated and potentially high for affected private parties: naming triggers existing criminal offences and enforcement risk for individuals/entities interacting with the group — reg 5(1).","Interpretive complexity arises from reliance on the Criminal Code’s broader definitions and criminal offences rather than from this instrument’s text."],"plain_english_summary":"This regulation mechanically adds the organisation known as Boko Haram (and several listed aliases) to the Criminal Code’s definition of “terrorist organisation”, so the existing criminal offences and prohibitions that apply to listed organisations can be used against that group. It matters to police and intelligence, financial institutions that must freeze linked assets, and anyone in Australia who might deal with the group."}},"importantCases":[],"_links":{"self":"/api/acts/criminal-code-terrorist-organisation-boko-haram-regulations-2023","history":"/api/acts/criminal-code-terrorist-organisation-boko-haram-regulations-2023/history","analysis":"/api/acts/criminal-code-terrorist-organisation-boko-haram-regulations-2023/analysis","conflicts":"/api/acts/criminal-code-terrorist-organisation-boko-haram-regulations-2023/conflicts","importantCases":"/api/acts/criminal-code-terrorist-organisation-boko-haram-regulations-2023/important-cases","documents":"/api/acts/criminal-code-terrorist-organisation-boko-haram-regulations-2023/documents"}}
