Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule. See regulation 6 (qualifications) and regulation 7 (work experience).\n\n**Who is affected**\n\n- People who want to be licensed as conveyancers in Victoria (applicants). \n- Employers and supervisors who provide the required supervised conveyancing experience. \n- Registered training organisations that deliver the nationally‑endorsed units and diplomas listed here. \n- The licensing authority that assesses applications and may attach conditions to licences based on competency (note in reg 6).\n\n**Main pathways to qualification (what an applicant must show)**\n\n- Complete one of the listed national competency qualifications or units of competency prescribed in regulation 6. The regulation lists several alternative routes, including:\n - A modern Advanced Diploma of Conveyancing (BSB60220) with a specified set of 15 named units (reg 6(aa)); or\n - The earlier Advanced Diploma (BSB61115) with a set of named units (reg 6(a)) — but only if completed by 19 April 2022; or\n - Completion of specified groups of units from older financial services/conveyancing training packages (reg 6(b)–(d)), each with defined unit lists and transitional cut‑off dates; or\n - A recognised law degree or certain older diplomas/associate diplomas if the study began before 1 July 2008, combined in some cases with demonstration of particular competency units (reg 6(e)–(g)).\n\n- Meet one of the work‑experience routes in regulation 7:\n - At least 12 months of \"supervised conveyancing experience\" (full‑time or part‑time equivalent) within the 5 years before applying (reg 7(1)(a) and reg 7(2)); or\n - Hold the academic and practical legal training prerequisites that are defined in the Legal Profession Uniform Law (Victoria) (reg 7(1)(b)); or\n - Have been a licence holder under the Conveyancers Act at any time during the 5 years before applying (reg 7(1)(c)).\n\n- Definitions important to experience: \"supervised conveyancing experience\" must be obtained working for either (a) a licence holder who is not a provisional licensee, or (b) an Australian legal practitioner who has a practising certificate authorising supervision (reg 7(2)). The Regulations also adopt definitions from the Legal Profession Uniform Law (Victoria) and the Education and Training Reform Act 2006 (reg 5).\n\n**Why it matters (practical effects and how decisions are made)**\n\n- The Regulations convert general licensing law into concrete entry requirements: they list the specific training units and diplomas that satisfy the \"competency\" requirement in section 12 of the Act (reg 6), and they set the objective standard for what counts as acceptable work experience (reg 7).\n\n- Who pays: prospective licence applicants pay for the necessary courses and for time spent obtaining supervised experience; employers may bear some supervision costs. Training organisations receive demand for the listed units/diplomas.\n\n- Who decides: the licensing authority uses these prescribed lists to determine whether an applicant meets the statutory competency and experience tests. The authority can also impose licence conditions related to competency and experience (see note after reg 6 referring to s. 23 of the Act).\n\n**Implementation and compliance features to note**\n\n- The Regulations incorporate external, nationally endorsed training packages by reference (training.gov.au) and expressly allow those packages to be taken \"as in force from time to time.\" That means updates to the Commonwealth training package may affect what counts as a prescribed qualification without further Victorian subordinate legislation (see reg 6 and the Table of Applied, Adopted or Incorporated Matter).\n\n- Several transitional or cutoff dates are embedded: certain older diplomas or unit‑sets are accepted only if completed by particular dates (for example, BSB61115 only if completed by 19 April 2022; certain older units only if completed by 31 December 2018, 20 July 2016 or 31 December 2012). Those deadlines affect which training pathways are still available to new applicants (reg 6(a)–(d)).\n\n**Costs, incentives, trade‑offs and practical risks**\n\n- Cost and time: the Regulations standardise the training required, which creates predictable standards but imposes compliance costs (course fees, time to complete units, and time needed to obtain supervised experience). These costs are borne by applicants and, to some extent, by employers who supervise.\n\n- Incentives and behaviour: applicants will select training providers and supervision arrangements that satisfy the listed units. Employers may be incentivised to provide supervised work to gain and retain staff who require experience. The licensing authority may restrict the scope of a licence where an applicant's demonstrated competencies are narrower (note to reg 6).\n\n- Implementation risk: because the Regulations adopt external training packages \"as in force from time to time,\" changes at the Commonwealth level can alter what counts as a prescribed qualification. That reduces the need for frequent local legislative updates, but it also transfers some rule‑making power to the bodies that maintain the national training packages.\n\n- Effects on market entry and competition: the rules set minimum national training standards for entry into conveyancing. A conveyancer is a specialist who handles the legal transfer of property ownership (buying and selling real estate).\n\n**What it does:**\n- **Lists acceptable qualifications**: You can qualify through various pathways, including completing specific vocational courses (like the Advanced Diploma of Conveyancing), holding certain older qualifications, or being a qualified lawyer.\n- **Sets deadlines for old qualifications**: Many pathways have cutoff dates (for example, some older diplomas are only accepted if you started studying before 2008, or completed certain courses by 2022).\n- **Requires practical experience**: Applicants must have at least 12 months of supervised work experience in conveyancing, unless they are already qualified lawyers or held a conveyancer's licence within the last 5 years.\n- **Defines 'supervised experience'**: This means working full-time (or equivalent part-time) under a licensed conveyancer or a lawyer who is authorised to supervise others.\n\n**Who it affects:**\n- Anyone applying for a conveyancer's licence in Victoria\n- People currently working in conveyancing who need to maintain or upgrade their qualifications\n- Registered training organisations that deliver conveyancing courses\n\n**Why it matters:**\nBuying property is one of the biggest financial decisions most people make. These rules ensure conveyancers have proper training in property law, contract law, trust accounting (handling client money), and compliance before they can operate independently. The legislation also provides 'grandfathering' provisions—allowing people with older qualifications to remain eligible while ensuring new entrants meet current industry standards."},"summary":{"complexity_score":3,"scope_assessment":{"changed":false,"description":"Based on the available text, there is no evidence of scope change from the original intent.
