It affects manufacturers, suppliers and caregivers by setting a 12‑month transitional window, after which products must meet specified international toy‑safety standards. Exclusions include sporting, outdoor, electronic and fashion items that aren’t toys. The aim is to prevent ingestion of small powerful magnets and align Australian rules with global standards; it’s separate from the ban on standalone high‑powered novelty magnets."},"flash_summary":{"complexity_score":6,"scope_assessment":{"changed":true,"description":"The instrument replaces the 2010 Consumer Product Safety Standard by repealing it (Schedule 1) and establishes a new compliance framework that accepts several international standards (sections 7–8, 9–12). It retains the core subject matter—magnetic toys—and the same enumerated exclusions (section 6(1)–(2)—so product coverage is materially similar, but the compliance pathways and specific technical obligations have changed, shifting costs to suppliers for standard selection, testing and documentation and preserving regulator power to require nomination of the standard relied upon (notes to sections 7 and 8)."},"complexity_factors":["Multiple alternative compliance routes: suppliers may choose among four different international standards, creating choice and verification complexity (sections 7–8, 9–12).","Textual modifications: the instrument modifies and omits specific clauses and subclauses of the incorporated standards, requiring side‑by‑side comparison with the purchased standards (sections 9(1)–(4), 11(1)–(4), 12(1)–(3)).","Transitional arrangement and repeal: a 12‑month transitional period permits the old 2010 standard before full repeal, so suppliers and regulators must track temporal applicability (section 7; Schedule 1).","Dependence on externally published standards that must be purchased or viewed under licence increases access costs for compliance assessment (definitions for Australian/New Zealand, European, International and US Standards).","Regulator discretion to request nomination of the applicable standard imposes administrative burdens and evidentiary requirements on suppliers (notes to sections 7 and 8 referencing section 108 of the Australian Consumer Law).","Defined exclusions (sporting goods, camping goods, bicycles, playground equipment, trampolines, electronic game units, combustion/steam models, fashion jewellery) require factual characterisation of products to determine applicability (section 6(2)).","Cross‑reference to other consumer law provisions (authority under subsection 104(1) of the Australian Consumer Law) creates interactions with enforcement powers and standards in that Act (section 3)."],"plain_english_summary":"This instrument sets mandatory safety rules for toys supplied with magnets.
