(see definitions and section 6)\n- Requires that button/coin batteries must not be released from the product during reasonably foreseeable use or misuse. (section 8)\n- Requires battery compartments that are intended to be user‑replaceable to be resistant to opening by young children; where access is by screws, those fasteners must be captive (remain attached). (sections 9 and 10)\n- Requires pre‑supply testing of representative samples against specified clauses of recognised Australian, New Zealand, international or UL industry standards — either product‑specific standards (for audio/video, toys, electronic apparatus, luminaires) or a non‑product‑specific Lithium Technologies Standard (UL 4200A). Suppliers can use specified alternative tests where the quoted clause is inappropriate, provided samples are tested and meet the objective. (sections 12–17)\n- Applies from an \"application day\" set at 18 months after the instrument commences; it does not apply to goods first supplied to consumers before that application day or to some narrowly defined categories (for example, hearing aids, certain trade/industrial equipment, and some products with soldered‑in batteries). (definitions and section 6)\n\nWho this affects\n\n- Manufacturers, importers and suppliers of consumer goods that contain or are designed to store button/coin batteries. (section 6)\n- Testing laboratories and design teams, because representative samples must be tested before supply. (sections 12–17)\n- Smaller suppliers are especially affected because they must arrange and pay for testing and any design changes needed to meet the standard.\n\nWhy it matters (stated purpose, and how the instrument tries to achieve it)\n\n- The instrument is structured to prevent batteries becoming detached or being accessed by young children — outcomes that are associated with ingestion, choking and chemical/thermal injuries. The stated mechanism is to require mechanical design features and verified testing against recognised industry standards so batteries won’t be released or easily accessed. (sections 8–11, 12–17)\n\nPractical consequences, incentives and trade‑offs (implementation‑level analysis)\n\n- Who pays: suppliers (manufacturers/importers/retailers) bear the direct costs — product redesign, testing fees and buying copies of proprietary standards. The instrument references paid standards (AS/NZS, IEC, ISO, UL) which suppliers typically must acquire or access. (definitions; notes to definitions)\n- Who decides: the supplier decides which of the listed standards/tests to apply (product‑specific or non‑product‑specific route) and may apply an alternative test where the nominated clause is not appropriate; the regulator (under the Australian Consumer Law) can request suppliers to nominate which requirements they relied on. (sections 8(2), 12(2), 13(3) and notes re: section 108 of the ACL)\n- Behaviour changes required: design battery compartments to resist child access; make screws captive where required; choose soldered‑in batteries for some product classes (which are excluded) or redesign to avoid user‑replaceable compartments; perform representative‑sample testing before first supply to consumers. (sections 9–11, 10(2), 12–17)\n- Compliance burden and friction: repeated cross‑referencing to external standards increases compliance complexity. Testing must be done on \"representative samples\" before supply — that creates lead‑time, record‑keeping and laboratory workload. Buying access to standards (private copies) is a recurring cost and can be a fixed barrier for small suppliers. (definitions and test clauses throughout Part 2)\n- Substitution and unintended effects: because the instrument exempts some products (for example, certain soldered‑in batteries in specified electronic equipment), suppliers may have an incentive to change battery attachment methods or label products as business/industrial to rely on exclusions — a design or marketing response that shifts risk management rather than eliminating risk. The instrument allows alternative tests where clause tests are inappropriate, which gives technical flexibility but requires a defensible testing basis if challenged. (section 6(3)(e), sections 12(2), 14(2), 15(2))\n- Enforcement and evidentiary mechanics: compliance is tested by reference to specific clauses in named standards or to the Lithium Technologies Standard; regulators will rely on supplier records and test reports. The instrument does not itself describe penalties — enforcement sits within the Australian Consumer Law enforcement framework. (sections 12–17 and notes re: section 108 ACL)\n\nRisks and implementation notes\n\n- Cost and capacity risk: testing capacity (and cost) will be concentrated in accredited labs; smaller suppliers face proportionally higher compliance costs.\n- Legal/technical ambiguity: multiple options (Australian, international, product‑specific, non‑product‑specific routes) plus an \"alternative test\" route create conditional complexity that will require technical justification in some cases.\n- Timing: the 18‑month lead time (application day) gives suppliers time to redesign and test, but also creates a cliff for stock management because goods supplied before application day are out of scope. (definition of \"application day\" and section 6(3)(a))\n\nSource‑attributed purpose claim and testing that claim\n\n- The instrument’s explicit purpose is to reduce the risk of child access and battery release by placing design + testing requirements on suppliers (sections 8–11). That purpose is implemented by mandating tests from recognised standards and by permitting suppliers to demonstrate compliance by testing representative samples. The trade‑offs are concrete: improved product safety in return for testing and design costs, potential market concentration in favour of suppliers who can absorb testing costs, and the possibility of product redesign to qualify for exclusions. The instrument leaves the choice of which standard route to suppliers (subject to regulator enquiry), so the regulator retains oversight but suppliers retain the practical choice of technical route.
