The Act remains focused on its core function of administering portable long service leave entitlements through a declared company."},"complexity_factors":["Moderate cross-referencing between the Act and an external Trust Deed (the actual scheme rules are in a separate document not included here)","Multiple amendments incorporated (notably the 2003 amendments which substituted several key sections)","Transitional provisions spanning two schemes (the repealed 1971 Act and the new scheme) with deemed termination dates and retrospective application","Conditional levy system with alternative payment mechanisms (section 5 vs section 7)","Interaction with corresponding laws in other jurisdictions requiring ministerial declarations","Time-limitation rules with extension provisions and awareness-based triggering (sections 9A and 9B)","14 defined terms in the interpretation section, some referencing external classifications (ANZSIC codes)"],"plain_english_summary":"This law sets up a portable long service leave scheme for construction workers in Tasmania. Normally, long service leave (paid time off after working for the same employer for many years) is lost when workers change jobs. Because construction workers often move between employers and projects, this Act creates a system where their service time follows them.\n\n**What it does:**\n- Establishes a scheme administered by a company (currently TasBuild Limited) that tracks construction workers' service time across different employers\n- Requires employers in the construction industry to register themselves and their employees with this company\n- Employers must make payments to the scheme (or pay a levy) to fund workers' long service leave entitlements\n- Allows workers to claim long service leave benefits even after working for multiple different employers\n\n**Who it affects:**\n- **Construction workers** (employees in building and construction industries) – they get portable long service leave entitlements\n- **Employers** in the construction industry – they must register and make payments to the scheme\n- **Self-employed people** – counted as employers and must also participate\n\n**Key features:**\n- **Portable benefits**: Workers don't lose their accrued long service leave when changing jobs\n- **Reciprocal arrangements**: Works with similar schemes in other Australian states and territories so workers don't lose benefits when moving interstate\n- **Enforcement**: The administering company can take employers to court for non-payment and enforce record-keeping obligations\n- **Transition**: Replaced an older 1971 scheme, transferring all existing funds and entitlements to the new system\n\n**Why it matters:**\nConstruction is a mobile industry where workers rarely stay with one employer for 10+ years (the usual threshold for long service leave). Without this scheme, most construction workers would never qualify for long service leave. This law ensures they accrue these benefits throughout their career across multiple employers."}},"importantCases":[],"_links":{"self":"/api/acts/construction-industry-long-service-act-1997","history":"/api/acts/construction-industry-long-service-act-1997/history","analysis":"/api/acts/construction-industry-long-service-act-1997/analysis","conflicts":"/api/acts/construction-industry-long-service-act-1997/conflicts","importantCases":"/api/acts/construction-industry-long-service-act-1997/important-cases","documents":"/api/acts/construction-industry-long-service-act-1997/documents"}}
