[www.legislation.vic.gov.au](http://www.legislation.vic.gov.au) for Victorian Bills, Acts and current Versions of legislation and up-to-date legislative information.\n\nThe Conservation, Forests and Lands (Fisheries Infringement Notices) Regulations 2020, S.R. No. 3/2020 were made on 29 January 2020 by the Governor in Council under section 99 of the **Conservation, Forests and Lands Act 1987**, No. 41/1987 and came into operation on 1 February 2020: regulation 3.\n\nThe Conservation, Forests and Lands (Fisheries Infringement Notices) Regulations 2020 will sunset 10 years after the day of making on 29 January 2030 (see section 5 of the **Subordinate Legislation Act 1994**).\n\nINTERPRETATION OF LEGISLATION ACT 1984 (ILA)\n\nStyle changes\n\nSection 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.\n\nReferences to ILA s. 39B\n\nSidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided regulation, rule or clause of a Schedule is amended by the insertion of one or more subregulations, subrules or subclauses the original regulation, rule or clause becomes subregulation, subrule or subclause (1) and is amended by the insertion of the expression \"(1)\" at the beginning of the original regulation, rule or clause.\n\nInterpretation\n\nAs from 1 January 2001, amendments to section 36 of the ILA have the following effects:\n\n• Headings\n\nAll headings included in a Statutory Rule which is made on or after \n1 January 2001 form part of that Statutory Rule. Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule. \nThis includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms. \nSee section 36(1A)(2A)(2B).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule. Any examples, diagrams or notes inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, form part of that Statutory Rule. See section 36(3A).\n\n• Punctuation\n\nAll punctuation included in a Statutory Rule which is made on or after \n1 January 2001 forms part of that Statutory Rule. Any punctuation inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule. \nSee section 36(3B).\n\n• Provision numbers\n\nAll provision numbers included in a Statutory Rule form part of that Statutory Rule, whether inserted in the Statutory Rule before, on or after \n1 January 2001. Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule. See section 36(3)(3D)(3E).\n\n2 Table of Amendments\n\nThis publication incorporates amendments made to the Conservation, Forests and Lands (Fisheries Infringement Notices) Regulations 2020 by statutory rules, subordinate instruments and Acts.\n\n–––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––\n\n**Subordinate Legislation Act 1994, No. 104/1994**\n\n| *Assent Date:* | 13.12.94 |\n| --- | --- |\n| *Commencement Date:* | S. 5(2)(b) on 18.6.23 on sunset of the Conservation, Forests and Lands (Primary Industries Infringement Notices) Regulations 2013 |\n| *Current State:* | This information relates only to the provision/s amending the Conservation, Forests and Lands (Fisheries Infringement Notices) Regulations 2020 |\n\n\n–––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––Conservation, Forests and Lands (Fisheries Infringement Notices) Amendment Regulations 2021, S.R. The amount of the calculated penalty may be rounded to the nearest dollar.\n\nThe value of a penalty unit for future financial years is to be fixed by the Treasurer under section 5 of the **Monetary Units Act 2004**. The regulations do not extend into unrelated policy areas or create new regulatory schemes beyond the infringement notice framework established by the parent Act."},"complexity_factors":["Extensive cross-referencing: Schedule 1 contains 432 items that reference specific sections of the Fisheries Act 1995 and regulations from the Fisheries Regulations 2019, requiring users to look up external provisions to understand the actual offence","Repetitive structure: Large sections duplicate the same offence pattern (e.g., 'failure to comply with regulation X') across multiple licence types, creating bulk without adding conceptual complexity","Dual liability structure: Many offences are duplicated for both licence holders and persons acting on their behalf (e.g., items 132–158 mirror items 146–158), effectively doubling the offence list","Minimal defined terms: Only 2 defined terms in regulation 4 ('commercial fishery licence' and 'licence holder'), but heavy reliance on external definitions from the Fisheries Regulations 2019","Simple conditional logic: No nested exceptions or complex conditional provisions; the structure is essentially a lookup table mapping offence references to penalty units","Mechanical amendment history: References to revoked Parts (Pt 3 'revoked by virtue of No. 104/1994') and amendment notes create clutter but don't affect operational complexity"],"plain_english_summary":"These regulations create a system of on-the-spot fines (called **infringement notices**) for people who break fishing laws in Victoria.\n\n**What it does:**\n- Lists exactly which fishing offences can be dealt with by an infringement notice (a fine you can pay without going to court) rather than prosecution.\n- Sets the fine amount for each offence, measured in **penalty units** (a standard way of calculating fines in Victorian law—one unit is worth around $184–$192 depending on the year).\n- Covers a wide range of fishing activities including:\n - Using illegal fishing equipment (nets, lines, traps)\n - Taking or possessing fish you're not allowed to have\n - Breaking licence conditions for commercial fishing (abalone, rock lobster, giant crab, etc.)\n - Failing to register fishing boats properly\n - Specific rules for different fisheries like Corner Inlet, Gippsland Lakes, and Western Port\n\n**Who it affects:**\n- Commercial fishers and their employees\n- Recreational fishers who break equipment or possession rules\n- People holding specific licences (abalone divers, rock lobster fishers, aquaculture operators, etc.)\n- Anyone acting on behalf of a licence holder (crew members, agents)\n\n**Why it matters:**\nInstead of dragging every fishery violation through the courts, authorised officers can issue a fine on the spot. This makes enforcement faster and cheaper, but the regulations ensure there's a clear, published list of what offences attract fines and exactly how much you'll pay. The penalties range from 0.5 penalty units (about $92) up to 5 penalty units (about $960) depending on the seriousness of the breach."},"flash_summary":{"complexity_score":6,"scope_assessment":{"changed":false,"description":"The instrument stays within its original purpose: to prescribe which fisheries offences may be dealt with by infringement notice and to fix the corresponding infringement penalties (regulations 1, 5 and 6; Schedule 1). Many entries are specific to particular fisheries or licence types (see Schedule 1 entries). \n- Authorised enforcement officers and the administering agency, because they will use infringement notices as a disposal option instead of, or prior to, court prosecution.\n\n**Why it matters (purpose claim and operational effect)**\n\n- The stated objectives are to (a) list the offences for which an infringement notice may be served, (b) set the associated infringement penalties, and (c) make consequential amendments to earlier primary‑industries infringement rules (regulation 1). \n- Operationally, the regulations convert a long list of fisheries offences into fixed‑penalty options: for each listed offence an officer can issue an infringement notice carrying the penalty shown in Column 3 of Schedule 1 (regulation 6). That creates a readily enforceable, standardised monetary sanction for many contraventions of the Fisheries Act and Fisheries Regulations (regulation 5; Schedule 1).\n\n**How penalties are calculated and who pays**\n\n- Penalties are expressed in penalty units (Schedule 1 column 3). The monetary amount payable is the number of units multiplied by the value of a penalty unit for the relevant financial year; that unit value is set under the Monetary Units Act 2004 and administered via the Sentencing Act 1991 (Explanatory details). The offender (person who committed the offence) pays the fine if they accept the infringement notice or are found liable.\n\n**Who decides and what changes in behaviour are incentivised**\n\n- Decision to issue an infringement notice rests with authorised enforcement officers (acting under the parent Act’s infringement powers and agency procedures). The regulations do not itself create the decision‑making test for guilt — they list which statutory offences may be dealt with by infringement notice and how much the fixed penalty is. \n- Incentives: converting offences to fixed penalties lowers the transaction cost of enforcement for regulators (faster, lower‑cost resolution than court) and creates a predictable monetary cost for regulated parties. That tends to encourage compliance with licence conditions and regulations where detection risk is non‑zero, and shifts enforcement from discretionary prosecution to administrative fines for listed offences.\n\n**Costs, trade-offs and implementation risks**\n\n- Compliance burden and concentrated costs: many items in Schedule 1 target licence and access conditions (hundreds of entries relating to licence/permit conditions). That spreads many relatively small fixed penalties across a large regulated population (diffuse costs) while concentrating administrative benefit (faster enforcement) with the regulator.\n- Certainty vs. nuance: fixed penalties provide predictability for routine breaches but may not reflect case‑by‑case harm or culpability where an offence's elements require factual or contextual assessment (risk of under‑ or over‑deterrence). The Schedule relies on accurate identification of the underlying offence in the Fisheries Act/Regulations, so enforcement depends on officers’ ability to apply legal elements correctly.\n- External indexing: real dollar cost to offenders varies over time because penalty units are monetised annually (Monetary Units Act and Sentencing Act). That creates a separation between the number of penalty units (fixed here) and the actual dollar burden (variable).\n- Administrative discretion and appeal risk: officers exercise discretion to issue notices; recipients can contest infringement notices in court or by other statutory review routes (not changed by this instrument). Incorrect or disputed issuing may produce administrative or legal costs for both sides.\n- Implementation effort: the Schedule cross‑references many different provisions of the Fisheries Act and Fisheries Regulations. Ensuring operational guidance, officer training and accurate breach identification is necessary to avoid errors and inconsistent enforcement.\n\n**Market and private‑enterprise effects (brief)**\n\n- Competitive effects: the rules apply broadly across licence types; they do not create direct subsidies or exemptions for particular businesses, but firms with higher compliance costs (e.g. those with many licence conditions) face greater enforcement exposure. \n- Prices/productivity/contract freedom: penalties are a compliance cost which may feed into operating costs for commercial fishers and, indirectly, prices. The regulations do not directly regulate markets or ownership; they change enforcement friction and the cost of non‑compliance.\n\n**Key legal references within the instrument**\n\n- Authorising power: reg 2 (made under s.99 Conservation, Forests and Lands Act 1987). \n- Prescribes offences: reg 5 and Schedule 1. \n- Prescribes penalties for those offences: reg 6 and Schedule 1 (Column 3). \n- Definitions in the instrument: reg 4 (commercial fishery licence; licence holder). \n- Penalty unit monetisation and rounding: Explanatory details (Monetary Units Act 2004; Sentencing Act 1991).\n\n"},"issue_detection":{"absurdities":[],"contradictions":[]},"summary":{"complexity_score":3,"scope_assessment":{"changed":false,"description":"Based on the available text, the regulation appears to serve its stated purpose of establishing an infringement notice scheme for fisheries offences under the Conservation, Forests and Lands Act 1987.
