The authority is governed by a board with employer and worker representatives (ss 15–25).\n\n- Requires registration of workers and employers so service can be tracked centrally (workers: ss 44–52; employers: ss 53–60). The authority keeps registers and records basic identifying and service/wage information (ss 48, 57, 70).\n\n- Imposes a levy on ordinary wages for each worker to fund the scheme. The levy percentage is set by regulation (ss 84–86, 85). Employers must lodge regular returns and pay the levy for each return period (ss 65–66). Late payments and failures to lodge attract penalties, interest and debt-recovery powers (ss 69, 88–89).\n\n- Sets rules for crediting service: if a worker performs any community services work in a return period, they are credited with every day in that return period (ss 61–63). Entitlement accrues at 6.1 weeks’ LSL per 2,555 days of credited service (s 73). The Act contains a formula for calculating money payments from the authority (s 74) and rules for payments where an employer has already paid (ss 76–79).\n\n- Provides administrative features: actuarial reviews of fund adequacy at least every 2 years (s 43); authorises borrowing and investment by the authority (s 14, s 41); allows the authority to enter agreements with corresponding interstate authorities and to treat other States as \"reciprocating\" for cross-border credits (ss 119–120).\n\n- Gives enforcement powers (authorised officers and powers adapted from the Contract Cleaning portable LSL Act) and criminal/civil penalties for non-compliance (pts 8–11; ss 100–116, 112–117). It also provides internal review and appeal routes to the industrial magistrate and industrial court (pt 8, ss 91–99).\n\n- Protects confidential information obtained administering the Act (s 118) and requires a statutory review of the Act within five years (s 123).\n\n(References in parentheses are to the Act’s section numbers.)\n\nWho it affects and who pays\n\n- Workers doing community services work: included are employees and self-employed people who perform the defined community services work; they must register (or be registered by the authority) to have service credited and to claim payment (ss 7–9, 44–49, 72–74).\n\n- Employers (broadly defined to include entities that provide community services, labour-hire providers supplying that work, and self-employed providers when acting as employers): must register, keep worker records for 6 years, lodge returns after each return period, and pay the levy calculated as a percentage of ordinary wages (ss 9, 54, 65, 66, 70, 84–85). Commonwealth, State and local governments are excluded from the definition of \"employer\" for this Act (s 9).\n\n- The Authority (and its board) decides registration, levy enforcement, payments, actuarial settings and administrative matters (see especially ss 13, 42–43, 66–69, 74, 76–77).\n\nWhy it matters (official purpose and practical trade-offs)\n\n- The Act’s stated purpose is to create portability of long service leave for community services workers, so entitlements follow workers across employers in the industry rather than being trapped with any single employer (s 4). Mechanically, that is achieved by central registers, crediting rules that attach service to a worker and a central fund financed by an employer levy (ss 44–48, 62–63, 73–76, 84–85).\n\n- Costs and who bears them: employers fund the scheme through the levy (ss 84–86). That is a recurring labour cost for businesses in the community services sector. The levy rate is not fixed in the Act but set by regulation (s 85) and reviewed actuarially (s 43), so employer cost can change over time.\n\n- Incentives and behaviour changes: employers must start new administrative processes (registration, regular returns, record-keeping, payment and verification) and may alter hiring, contracting or reporting practices to manage the levy and compliance burden (ss 54, 65, 70). The Act provides an exemption route (s 68) and limits on what counts as a worker for return/levy purposes (see s 65 definitions), so there are formal channels for reducing obligations where appropriate.\n\n- Opportunity costs and implementation risk: the authority must develop registry systems, actuarial capability and collections processes; the Act allows it to borrow and to contract administration with other industry authorities (ss 14, 38–41). Establishing IT systems, staff arrangements and cross-border agreements creates upfront costs and operational risk. Insufficient initial levies or errors in actuarial assumptions could create funding shortfalls and require levy increases later (s 43).\n\n- Compliance burden and enforcement: employers face record-keeping and reporting requirements and potential penalties (ss 65, 70, 69, 112). The Act gives authorised officers inspection and information powers (pt 9, ss 100–111) and recovery tools for unpaid levies (ss 87–89). These create a measurable regulatory compliance cost for businesses.\n\n- Effects on markets and contracts: the levy raises per-worker labour costs that may be passed on to funders or clients (including government-funded programs). The scheme reduces the risk borne by workers when moving between employers, which may encourage mobility in the workforce. Employers may respond with contract structure changes (use of labour hire, subcontracting, or seeking exemptions) where feasible (ss 9, 68).\n\n- Concentrated benefits and diffuse costs: the direct beneficiaries are individual workers who accrue portable LSL (concentrated benefit). The costs are spread across many employers via a per-wage levy (diffuse costs). This distribution matters for political economy and compliance dynamics (ss 73, 84–85).\n\n- Capture and governance risk: the Act requires a board with specific employer and worker representation (s 18). That design gives stakeholders formal influence over administration; it reduces unilateral ministerial control but creates a concentration of influence that could be used to shape operational choices (s 18). The authority may use staff and systems from the Building and Construction Industry Authority and make agreements with other industry authorities for administration and cost-recovery (ss 36, 38–40), which embeds inter-agency dependencies.\n\nCosts, trade-offs and enforcement mechanics (concrete)\n\n- Levy not fixed in statute: percentage is set by regulation and reviewed actuarially every two years (s 85, s 43). That makes employer cost responsive to actuarial advice rather than fixed in the Act.\n\n- Payment and collection: employers lodge returns and pay levies within 14 days after each return period; late payment yields compound interest and penalties; outstanding amounts are recoverable as a debt (ss 65–66, 88–89).\n\n- Benefit calculation: entitlement is determined by credited days and a legislated accrual rate (2,555 days → 6.1 weeks) and a formula for payment using moderated wages and an applicable classification rate (ss 62, 71, 73–74).\n\n- Safety nets and insolvency: the authority can step in to pay workers where employers are insolvent or unable to pay, and it can then seek recovery or apply rules for employer repayment/reimbursement (ss 78–79, 76).\n\nImplementation and practical risks\n\n- Successful launch depends on timely registry systems, compliance-contacting and data-exchange arrangements with employers and other States (ss 44–50, 119–120).\n\n- Funding adequacy depends on quality of actuarial reviews and assumptions about mobility, wages growth and claim patterns (s 43).\n\n- Administrative concentration: the authority can borrow from the Contract Cleaning Industry Authority and use Building and Construction Authority staff (ss 14, 36–40), which economises on resources but ties operations to other statutory bodies.\n\nKey sections to check in practice\n\n- Registration and when service starts (ss 45–49).\n- Employer return and levy timing and content (ss 65–66, 85).\n- Crediting rules that convert returns into days of service (ss 61–63, 62 example).\n- Payment calculation formula and moderation of wages (ss 71, 74).\n- Actuarial review and ministerial involvement in budget approval (ss 42–43).\n\nOverall: the Act creates a centrally administered, levy-funded portable LSL scheme for the community services industry. It shifts collection and payment responsibilities to a new statutory authority, imposes ongoing reporting and levy obligations on employers, and provides workers with portable entitlements tracked by a central register (see especially ss 4, 44–66, 73–76, 84–89)."},"issue_detection":{"absurdities":[],"contradictions":[]},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
