Rather than writing a completely new law from scratch, Tasmania (like other Australian states and territories) has passed a short Act that **imports** the Co-operatives National Law — a detailed set of rules originally enacted by New South Wales — and makes it apply as if it were Tasmanian law.\n\n**Who it affects**\n\n- **Co-operatives** operating in Tasmania (businesses owned and run by their members, like credit unions, agricultural co-ops, or community clubs)\n- **The Registrar of Co-operatives** — the Director of Consumer Affairs and Fair Trading, who oversees registration and compliance\n- **Members and directors** of co-operatives, who must follow the governance, financial reporting, and disclosure rules in the imported National Law\n\n**Key things the Act does**\n\n- **Adopts the National Law**: The Co-operatives National Law (set out in a NSW Act) applies in Tasmania as the *Co-operatives National Law (Tasmania)*, and is treated as if it were a Tasmanian Act (section 4).\n- **Adopts National Regulations**: National regulations made under the scheme also apply in Tasmania, with local modifications allowed (section 4(2)).\n- **Tasmanian-specific tweaks**: The Act fills in gaps that the National Law leaves for each state to decide, such as:\n - Who counts as a \"police officer\" or \"public sector official\" in Tasmania (section 5)\n - Which courts handle disputes (Supreme Court for most matters; Magistrates Court for administrative appeals) (section 7(3))\n - What forms of official notices are required (orders in writing, Gazette notices, etc.) (section 7(2))\n - How unclaimed money from compulsory share acquisitions is handled (under Tasmania's *Unclaimed Moneys Act 1918*) (section 8)\n - Stamp duty exemptions for co-operative mergers, transfers, and share certificates (section 13)\n - Who can receive confidential information held by the Registrar (Treasurer, Auditor-General, Integrity Commission, etc.) (section 11)\n- **Protects officials**: The Minister, Registrar, and public servants are protected from personal liability for honest actions (section 19).\n- **Repeals old law**: The old *Cooperatives Act 1999* and associated regulations are repealed (Schedules 2–4), with transitional rules to ensure existing co-operatives continue smoothly (Schedule 1).\n\n**Why it matters**\n\nThis Act creates a **uniform national framework** for co-operatives while allowing Tasmania to make local adjustments. It means co-operatives in Tasmania operate under the same core rules as those in other states, reducing red tape for businesses that operate across borders, but with Tasmanian courts, officials, and procedures handling local matters."},"issue_detection":{"absurdities":[],"contradictions":[]},"flash_summary":{"complexity_score":7,"scope_assessment":{"changed":true,"description":"This Act replaces the prior Cooperatives Act 1999 with the Co‑operatives National Law as applied in Tasmania (s4; Schedule 2 repeals the earlier Act) and establishes Tasmanian modifications: local definitions and exclusions (s3, s5, s6), designation of the Director as Registrar (s20), tailored fee and stamp‑duty treatments (ss13–14), transitional savings for existing co‑operatives (Schedule 1) and power to make local regulations (s15).
