Duration\n6.1 This Scheme will commence in New South Wales, Victoria, Queensland, Western Australia,\nTasmania, and the Northern Territory on 22 November 2018.\n6.2 In the Australian Capital Territory and in South Australia, the Scheme will commence—\n6.2.1 on the date provided for in the Minister’s notice in relation to the Scheme, if a date is\nprovided; and\n(c) any interest payable on the amount of those damages or costs.\n4 Section 4(1A) of the Act provides that a reference in the Act “to the amount payable under an insurance policy in\nrespect of an occupational liability includes a reference to—\n(a) defence costs payable in respect of a claim, or notification that may lead to a claim (other than\nreimbursement of the defendant for the time spent in relation to the claim), but only if those costs are\npayable out of the one sum insured under the policy in respect of the occupational liability; and\n(b) the amount payable under or in relation to the policy by way of excess.”\nHowever, see also section 26A of the Act and its note, which has the effect that section 4 (1A) does not reduce the\ncap on the liability of the Participating Member to the client.\n\n4152 GOVERNMENT GAZETTE, WA 19 October 2018\n6.3 This Scheme will be in force for five years from its commencement in New South Wales.\n6.4 For any other jurisdiction, the Scheme will be in force for—\n6.4.1 five years from the date of commencement in that jurisdiction; The amendment narrows operational requirements by removing a specific deadline for presenting bins (clause 2.7 amendment) and updates an internal cross‑reference in clause 4.1(a). The Council adopted the change and the Department of Water and Environmental Regulation gave consent; it matters because it shifts a concrete compliance deadline and may affect collection operators’ scheduling."}},"importantCases":[],"_links":{"self":"/api/acts/claremont-town-of-waste-amendment-local-law-2018","history":"/api/acts/claremont-town-of-waste-amendment-local-law-2018/history","analysis":"/api/acts/claremont-town-of-waste-amendment-local-law-2018/analysis","conflicts":"/api/acts/claremont-town-of-waste-amendment-local-law-2018/conflicts","importantCases":"/api/acts/claremont-town-of-waste-amendment-local-law-2018/important-cases","documents":"/api/acts/claremont-town-of-waste-amendment-local-law-2018/documents"}}
