Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule. \nThis includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms. \nSee section 36(1A)(2A)(2B).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule. Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule. See section 36(3)(3D)(3E).\n\n2 Table of Amendments\n\nThis publication incorporates amendments made to the Cladding Safety Victoria Regulations 2020 by statutory rules, subordinate instruments and Acts.\n\n–––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––\n\nCladding Safety Victoria Amendment Regulations 2024, S.R. Think of it as the 'instruction manual' for the Cladding Safety Victoria Act 2020.\n\n**Who it affects:**\n- **Building owners and owners corporations** (bodies that manage apartment buildings and similar properties) who need financial help to remove or replace unsafe cladding\n- **Municipal building surveyors** (local council officials who check building safety) who must notify Cladding Safety Victoria about buildings needing work\n- **Original builders** who might be asked to do the rectification work\n\n**Key things the regulations cover:**\n\n- **How to complain:** If you have a complaint about Cladding Safety Victoria, they must acknowledge it within 28 days and keep you updated on progress.\n\n- **Which buildings get priority:** When deciding who gets financial assistance first, Cladding Safety Victoria must look at 14 different risk factors including:\n - Fire risk from the cladding type and how it's installed\n - How many people live in or use the building\n - Whether the original builder is available and qualified to do the work\n - Existing fire safety measures and escape routes\n\n- **How to apply for help:** Owners must fill out a detailed form (Form 2) with information about the building, its history, insurance, any legal action taken, and quotes for the work. They have 60 days to apply after being invited.\n\n- **Funding agreements:** Before money is handed over, owners must sign a formal agreement specifying what work will be done, how much funding is provided, what insurance is required, and when payments will be made.\n\n- **Notification when work is done:** Once cladding is fixed, Cladding Safety Victoria must tell Fire Rescue Victoria and the Environment Protection Authority.\n\n**Why it matters:**\nAfter several high-profile building fires involving combustible cladding (like the Grenfell Tower fire in London and fires in Melbourne), many Australian buildings were found to have similar dangerous materials. These regulations create a clear, structured process to help owners afford the expensive work of making their buildings safe, while ensuring the most dangerous buildings get help first."},"flash_summary":{"complexity_score":4,"scope_assessment":{"changed":false,"description":"The regulatory scope remains to prescribe forms, complaint process, prioritisation criteria, funding agreement terms and notifications. They affect building owners, owners corporations, municipal building surveyors, original builders and Cladding Safety Victoria. Cladding Safety Victoria decides prioritisation and funding; owners must apply on the prescribed forms and meet insurance and documentary requirements (regs 7–9)."},"flash_summary_failed":{"failed":true,"reason":"Unauthenticated.
