The 1999 law was always about regulating animals (dogs, horses, livestock, pigeons, bees, poultry) in the City of Joondalup. This 2016 amendment simply removes specific provisions (horse area, dog area designations) without expanding into new regulatory areas like native wildlife, cats (beyond existing provisions), or other animal categories."},"complexity_factors":["Very short amendment (6 operative clauses)","No new defined terms introduced","Simple deletion mechanism - removes existing clauses and schedules rather than creating new conditional rules","No cross-references to external legislation beyond the enabling Local Government Act 1995","Straightforward purpose clause (1.3) clearly states intent without nested conditions"],"plain_english_summary":"This amendment to Joondalup’s 1999 animal control rules removes the designated horse exercise area at Hillarys Beach and deletes the local-law power to create “dog exercise” or “dog prohibited” areas. It directly affects horse riders who lose beach access and dog owners by stripping this specific tool for off‑leash/no‑dog designations; local residents may see less horse activity. The change is a clean‑up simplifying the local law and signals a shift toward managing these issues through other mechanisms."},"flash_summary":{"complexity_score":3,"scope_assessment":{"changed":true,"description":"The amendment narrows the local law’s scope by removing the statutory authorisation and mapped designations for specific dog exercise/prohibited areas and the Hillarys Beach horse exercise area (1.3; 2.2–2.6; Second and Third Schedules). Concretely, four offence entries tied to those place-based rules are deleted from the First Schedule (2.4; First Schedule items 1, 16–18), reducing the set of conduct subject to modified penalties under this local law. Other animal controls, penalties and administrative powers in the local law and the Dog Act remain, so regulatory coverage shifts from place-specific rules to those remaining general provisions (clauses 55–59; clause 6 definition of 'Dog Act')."},"complexity_factors":["Amendment form: purely deletes existing provisions rather than creating new regulatory regimes (clauses 2.2–2.6).","Removes Clause 10 (dog exercise areas) and Clause 26 (horse exercise area) which were cross‑referenced throughout Part 2 and Part 4 (2.2; 2.3; original clauses 10, 26).","Deletes specific modified-penalty items (First Schedule items 1, 16, 17, 18) altering enforcement exposure for particular conduct (2.4; First Schedule).","Deletes Second and Third Schedules including Diagrams 1 and 2 that geographically fixed prohibited/exercise areas, creating potential signage/transitional and public-notice tasks (2.5; 2.6; Second and Third Schedules).","Enforcement framework (offences, modified penalties, infringement notices) remains elsewhere in the local law (Part 9; clauses 55–59), so impact must be assessed against residual offences and the Dog Act cross-reference (clause 6 definition of 'Dog Act').","Administrative discretion and fee-setting powers remain (e.g. licence/fees and approvals under clauses such as 52 and definitions of 'authorised person'), so practical implementation relies on executive action (clause 52; clause 6).","Commencement timing and interaction with prior versions require checking the Gazette and transitional arrangements to determine when deleted offences cease to be enforceable (clause 1.2; clause 2.1)."],"plain_english_summary":"This amendment removes the local-law provisions that allowed horses to be exercised at Hillarys Beach and deletes the local law’s mechanism for designating dog exercise and dog-prohibited areas (see 1.3; 2.2–2.6).
