The following notice now applies—\nEXEMPTION NOTICE FOR SMALL LOCAL GOVERNMENT SEWERAGE AND/OR NON-\nPOTABLE WATER SERVICES PROVIDERS\nIn accordance with section 7 of the Water Services Act 2012, the Hon Dave Kelly MLA, Minister for\nWater, has granted a class exemption from section 5(1) of the Act to local government water services\nproviders with less than 1000 customer connections whose water services are limited to the\nprovision of sewerage services and/or non-potable water supply services.\n\n4040 GOVERNMENT GAZETTE, WA 1 July 2022\nThe Act defines the terms ‘water service’, ‘water supply service’, ‘sewerage service’ and\n‘wastewater’.\nThe class exemption does not apply to potable water supply services (i.e. ‘drinking water’).\n‘Drinking water’ is defined as water that is intended for human consumption or for purposes\nconnected with human consumption such as the preparation of food, or the making of ice for\nconsumption or for the preservation of unpackaged food, whether or not the water is used for\nother purposes.\nThe exemption will come into effect on the day it is published in the Government Gazette and will apply\nfor a duration of five years.\nThe exemption will apply to the following local government authorities—\nShire of Brookton\nShire of Coolgardie\nShire of Dalwallinu\nShire of Denmark\nShire of Dowerin\nShire of Dumbleyung\nShire of East Pilbara\nShire of Goomalling\nShire of Jerramungup\nShire of Kent\nShire of Koorda\nShire of Lake Grace\nShire of Moora\nShire of Morawa\nShire of Northam\nShire of Ravensthorpe\nShire of Victoria Plains\nShire of Wickepin\nShire of West Arthur\nShire of Yilgarn\nSummary of reasons for the decision\nGranting the exemption is not contrary to the public interest. It is considered that—\n• the risk of the abuse of monopoly power in the provision of water services is low;\n• the public health and environmental aspects of these water services are regulated under the\nHealth Act 1911 and the Environmental Protection Act 1986, respectively; and\n• the exemption will reduce the regulatory and compliance costs associated with water services\nlicensing, including—\no administrative costs to the service provider of licensing i.e. licence fees, annual regulatory\nreporting costs, the costs of operational audits and asset management system reviews every\ntwo to three years; and\no costs to Government for enforcing and administering water service licences.\nHon. DAVE KELLY, MLA, Minister for Water.\nWORKCOVER\nWC401\nWORKERS’ COMPENSATION AND INJURY MANAGEMENT ACT 1981\nNOTICE\nGiven by the Board for the purposes of section 168 of the Workers’ Compensation
