The rules specify how voting works—one representative per parish, with extra representatives if turnout is high (capped at four per parish).\n- **Gives Synods power to make rules:** These meetings can create regulations binding on clergy and church members regarding church property, appointments to church positions (called 'advowson' or 'patronage'), and general church management.\n- **Establishes disciplinary tribunals:** Synods can set up Commissions to hear cases about clergy misconduct ('ecclesiastical offences'), though they can only recommend penalties—the bishop makes the final decision.\n\n**Important limits:**\n- **Dual consent required:** Regulations need approval from both clergy and laity (voting separately) plus the bishop's assent.\n- **Can't override higher authority:** Church rules can't conflict with Victorian state law, the state's Constitution, or the Anglican Church's official doctrines. Changes affecting appeals to the Archbishop of Canterbury need his written consent.\n- **No harsh penalties:** Synods can't impose criminal penalties—only church-specific consequences like suspending clergy from their positions.\n- **Royal oversight:** The Archbishop of Canterbury reviews regulations and can refer them to the Queen's Privy Council for approval or rejection.\n\n**Who it affects:**\n- Anglican bishops, clergy, and lay members in Victoria.\n\n**Why it matters:**\nThis was a foundational law giving the Anglican Church in Victoria autonomy to manage its own affairs while maintaining ties to the Church of England hierarchy. It reflects the colonial context—establishing local governance while reserving oversight to the 'mother church' in England. The 1985 amendment (Section 13A) modernised lay representation rules."},"flash_summary":{"complexity_score":5,"scope_assessment":{"changed":true,"description":"The core scheme—Bishop‑convened diocesan Synods making binding regulations with oversight by the Archbishop and Crown—remains. These changes expand how lay representation may be constituted while leaving the Synod oversight and external confirmation mechanisms intact."},"complexity_factors":["Cross‑jurisdictional oversight and confirmation: Synod regulations require review/confirmation by the Archbishop of Canterbury and may be submitted to Her Majesty in Council (ss 5, 15–16), creating extra procedural layers.","Detailed election and qualification procedures for lay representatives, including voting, declarations and numerical thresholds (ss 7–12, 13), which generate administrative burden.","Limits on disciplinary powers and scope of commissions: commissions can deal only with clergy and may recommend penalties the Bishop cannot exceed (ss 3–4), constraining remedies and creating procedural nuance.","Interaction with civil law and constitutional instruments: Synod rules cannot conflict with Victorian statutes or the Constitution of Victoria (s 6), requiring legal coordination.","Amendment history and inserted provisions (notably s 13A) alter foundational membership rules over time, so interpretation must track statutory changes (Table of Amendments; s 13A).","Archaic drafting and retained Crown prerogatives (preamble, s 18) that preserve royal appointment rights and affect modern governance reading."],"plain_english_summary":"This Act authorises a diocesan Bishop to convene Synods of licensed clergy and elected laity to make binding regulations governing church government, property, patronage and clergy discipline; Synods may create Commissions to hear ecclesiastical offences but sanctions are limited to suspension or removal.
