Initially focused on light work and basic care definitions, it has expanded to include: (1) youth detention oversight provisions (2022) following the establishment of the Aboriginal and Torres Strait Islander Children and Young People Commissioner; (2) a comprehensive internal review framework for care and protection decisions (2024-2025) covering education, religion, culture, and health decisions; and (3) intensive therapy register access provisions. The 2024-2025 amendments in particular added substantial procedural machinery for administrative review that was not present in the original regulation."},"complexity_factors":["Multiple cross-references to the parent Act (Children and Young People Act 2008) requiring simultaneous reading","Schedule 1 contains a complex table structure with 4 columns mapping functions to decisions to prescribed persons","Nested definitions in Schedule 1.1 where terms like 'long-term decision' exclude 'routine' decisions and decisions 'reviewable by another entity'","Age-tiered supervision requirements for light work (3 distinct brackets: under 3, 3-12, and young person)","Recent amendments (2024-2025) adding substantial new reviewable decision frameworks suggesting evolving scope"],"plain_english_summary":"The regulation sets detailed protections for children and young people in the ACT—strengthening oversight of youth detention records (including Indigenous identification), defining care-and-protection services, regulating safe \"light work\" and supervision, and creating internal-review and notification rights for major decisions about a child’s life.\n\nIt affects children in care or detention, their families and carers, ACT staff and employers, and matters because it clarifies safeguards, transparency and avenues to challenge decisions under the Children and Young People Act."},"flash_summary":{"complexity_score":5,"scope_assessment":{"changed":true,"description":"Since the original 2009 instrument, the regulation’s scope has been expanded: it now prescribes operational registers and who may inspect or access them (ss3AA–3AC), adds and clarifies care‑and‑protection purposes (s3A), defines light work and supervision standards (s4), and establishes which care, placement and assistance decisions are internally reviewable and who must be notified, naming the director‑general as reviewer (s5; s6; s7; sch 1).
