Registration can be for 1 year, 3 years, or the cat's lifetime. Fees apply (with discounts for pensioners), and cats must wear a registration tag in public.\n- **Microchipping:** Cats must be microchipped by an approved implanter (vets or qualified veterinary nurses). The regulations specify exactly what information must be recorded in the microchip database.\n- **Sterilisation:** Cats generally must be sterilised (desexed), unless exempted by a vet. Sterilised cats are identified by a certificate or a specific tattoo (a broken circle with a line through it).\n- **Breeding:** You need council approval to breed cats. To get approval, you must be 18, have no recent animal-related convictions, and be a member of a recognised cat organisation. Approvals last one year.\n- **Exemptions:** Some cats don't need to be registered or wear tags—such as cats in foster care (for limited periods), cats at shelters like Cat Haven or the RSPCA, or cats being shown at cat shows.\n- **Enforcement:** The regulations prescribe forms for warrants, infringement notices ($200 fines for offences like unregistered cats or failure to microchip), and how to object to council decisions.\n\n**Who it affects:** Anyone who owns, breeds, sells, or cares for cats in Western Australia, plus local councils who administer the system, vets who implant microchips, and animal welfare organisations.\n\n**Why it matters:** These rules help reunite lost cats with owners, reduce unwanted litters, and ensure responsible breeding. The regulations set out the exact forms to use for registration, breeder approval, infringement notices, warrants and related processes (Schedules and Forms 1–8; rr. 11, 20, 26–29; Schs 1–3).  \n\n- Require standards for microchips and restrict who may supply and implant them. Microchips must meet Australian Standards AS 5018 and AS 5019, and it is an offence to sell or implant non‑compliant microchips (r.5).  \n\n- Name the bodies that count as authorised microchip database companies and cat management facility operators (rr.4, 6).  \n\n- Define who may implant microchips and the training/qualifications required for veterinary nurses (r.7).  \n\n- Spell out what information must be recorded by microchip implanters, by local governments in their cat registers, and in registration certificates and tags (rr.15–17; r.16).  \n\n- Set registration options and timing: owners may register a cat for one year, three years or for life; specify expiry timing and renewal windows (r.12).  \n\n- Describe exemptions from registration and from wearing registration tags (for example, cats in certain shelters or exhibited at specified shows, and short‑term foster care exemptions) and the circumstances in which transfers of exempt cats are treated differently (rr.9–10, 19).  \n\n- Prescribe breeder approval procedures, eligibility criteria (including membership of specified cat organisations and absence of recent convictions), a one‑year approval duration, and grounds on which a local government may refuse or defer approval (rr.21–25, 22–24).  \n\n- Set specific modified penalties (fixed fines) for common regulatory breaches and list the fee amounts for registrations and breeder approvals (Schedule 2; Schedule 3).  \n\n- Provide the form and content of enforcement documents: cat control notices, infringement notices, withdrawal notices, objections, and warrants (Forms 3–8; rr.20, 26–29).  \n\n\nWhat the regulations say they aim to achieve (as claims in the instrument)\n\n- The regulations are the detailed implementation rules for the Cat Act 2011: they claim to make cat ownership traceable (microchipping and registers), to enable enforcement (forms, warrants, infringement penalties), and to regulate breeding and rehoming through approvals and exemptions (see generally rr.5–25, Schs.1–3).\n\n\nHow these measures change incentives, who pays, and who decides\n\n- Who pays: Cat owners pay registration fees (one year, three years or lifetime) and may pay fines for breaches (Sch.3; Sch.2). Microchip suppliers and implanters bear compliance costs to use only compliant devices (r.5); veterinarians and veterinary nurses incur training/administration costs when providing microchipping services (r.7). Local governments carry administrative costs for registering cats, storing records and enforcing the Act (rr.11, 16).  \n\n- Who decides: Local governments implement and enforce registration, breeder approvals and fee waivers (rr.11, 21, Sch.3). The Minister designates tag colours (r.15). Local authorised officers issue notices, warrants and decide on objections under the Act (Forms 3–8; r.26).  \n\n- Behavioural effects: Owners are nudged toward microchipping and sterilisation by registration requirements and by fines for non‑compliance (rr.5, 12; Sch.2). Breeders must join prescribed organisations and meet eligibility checks to obtain approval (r.23). Microchip implanters must use particular devices and report owner details to registered databases (rr.5, 17). Shelter and foster arrangements get limited relief via exemptions (r.9).  \n\n\nCosts, incentives, trade‑offs and implementation risks (brief assessment tied to the text)\n\n- Compliance costs: Owners pay recurring or upfront registration fees (Sch.3). Microchip suppliers and implanters face a compliance obligation to use devices meeting two Australian Standards (r.5) and to provide data to prescribed databases (r.17). Veterinary nurses and other implanters must hold specified training units or courses (r.7), imposing training costs.  \n\n- Concentrated benefits and competition effects: The regulations expressly name a small set of microchip database companies and cat management facility operators (rr.4, 6). Naming particular private companies creates a concentrated benefit to those entities because they are listed as recognised databases or facility operators; whether this prevents other providers operating depends on how the Cat Act's definitions interact with the regulations, but the prescription confers practical advantage (r.6).  \n\n- Administrative discretion and burden: Local governments have discretion to waive or reduce fees, to grant/refuse breeder approvals and to enforce offences (Sch.3 cl.1(4); rr.21–24). That discretion concentrates operational choice at local government level and creates potential variation in practice across jurisdictions (r.13 on transfers between local government areas).  \n\n- Enforcement and compliance risk: Enforcement relies on local government authorised officers and the infringement/penalty regime (Forms 6–7; Sch.2). Effectiveness depends on resourcing and consistent record‑keeping (r.16 requires extensive contact and cat data).  \n\n- Trade‑offs between administrative efficiency and owner costs: Lifetime registration (r.12; Sch.3 item 3) raises up‑front fees but reduces renewal administration. The regulations permit electronic lodgement and waive the signature for online applications, reducing friction for owners and local governments (r.11(2)–(3)).  \n\n- Potential substitution/unintended consequences: Requiring specific microchip standards and listing named database companies may reduce market entry for alternative providers and shape the market for animal‑ID services (rr.5–6). Prescribed membership requirements for breeders link private membership to regulatory eligibility (r.23), which can shift bargaining power toward the listed organisations.\n\n\nBottom line — what changes for ordinary people and organisations\n\n- Cat owners must register cats (one, three or lifetime), microchip and often sterilise them, keep details up to date with local government and microchip databases, and ensure tags are worn in public unless a prescribed exemption applies (rr.5, 6, 9–12, 15–17; Sch.2).  \n- Veterinarians, veterinary nurses and other prescribed implanting persons must follow device standards and reporting requirements and meet the training requirements if they are non‑veterinarians (rr.5, 7, 17).  \n- Local governments run the registration system, enforce compliance and issue approvals to breed (rr.11, 16, 21–25).  \n\n(References given are to the regulations and schedules cited above: for example, microchip device standards and penalties — r.5; named database companies — r.6; registration periods — r.12; information to be recorded — r.16; modified penalties — Schedule 2; fees — Schedule 3.)"},"issue_detection":{"absurdities":[],"contradictions":[]}},"importantCases":[],"_links":{"self":"/api/acts/cat-regulations-2012","history":"/api/acts/cat-regulations-2012/history","analysis":"/api/acts/cat-regulations-2012/analysis","conflicts":"/api/acts/cat-regulations-2012/conflicts","importantCases":"/api/acts/cat-regulations-2012/important-cases","documents":"/api/acts/cat-regulations-2012/documents"}}
