McCormick  \nDirector of Aviation Safety\n\n3 August 2011\n\nExemption — design of modification or repair\n\n1 Duration\n\nThis instrument:\n\n(a) commences on the day after registration; and\n\n(b) stops having effect at the end of June 2014.\n\n2 Application\n\nThis exemption applies to approval of design of temporary modifications or repairs that do not fully meet the relevant airworthiness design standards for an operation under paragraph 21.009 (1) (f) and subregulation 21.437 (4) of CASR 1998.\n\n3 Exemption\n\nAn authorised person is exempt from the requirements of paragraph 21. 009 (1) (f) and subregulation 21.437 (4) of CASR 1998 to the extent mentioned in Schedule 1.\n\n4 Conditions\n\nThe exemption is subject to the conditions in Schedule 2.\n\nSchedule 1 Extent of exemption\n\nThe exemption extends only:\n\n(a) to the requirement that an authorised person be satisfied that a design conforms with any relevant design standard in respect of the type of aircraft or aircraft component; and\n\n(b) to an aircraft that is to be issued with a special flight permit or an experimental certificate for the purpose of research and development or test flights for demonstrating compliance with the Civil Aviation Regulations.\n\nSchedule 2 Conditions\n\n1 An authorised person must take into account any relevant consideration, including all hazards and risks, relating to the safe operation of the intended flight before approving the design of temporary modifications.\n\n2 An authorised person may impose limitations or conditions on the approval or require that a specified thing be done to ensure the safety of air navigation.","sortOrder":0}],"analysis":{"kimi_summary":{"_metrics":{"model":"kimi-k2.5","source":"moonshot-batch","completionTokens":2569},"content_quality":"ok","complexity_score":3,"scope_assessment":{"changed":false,"description":"This appears to be the original instrument as made, creating a narrow exemption for temporary modifications consistent with its stated purpose."},"complexity_factors":["References external regulations (CASR 1998 regs 21.009 and 21.437) without reproducing the text of those provisions","Assumes knowledge of who qualifies as an 'authorised person' under the regulations","Short, single-purpose instrument with minimal conditional logic"],"plain_english_summary":"This instrument temporarily allowed certain CASA‑authorised aviation safety officials to approve short‑term aircraft modifications or repairs that do not fully meet normal airworthiness design standards, but only for aircraft on special flight permits or experimental certificates used for R&D or test flights.
