McCormick  \nDirector of Aviation Safety\n\n06 September 2010\n\nExemption — carriage of children suffering from a serious medical condition\n\n1 Duration\n\nThis instrument:\n\n(a) commences on the day after it is registered; and\n\n(b) stops having effect at the end of 31 August 2012.\n\n2 Application\n\nThis instrument applies to the carriage of a child over 2 years old who:\n\n(a) suffers from a serious medical condition which makes it impossible for him or her to sit upright unaided; and\n\n(b) weighs less than 16 kilograms.\n\n3 Exemption\n\nThis instrument exempts Virgin Blue International Airlines Pty Ltd, trading as V Australia, Aviation Reference Number 768593, and a child to whom this instrument applies, from compliance with subregulation 251 (1) of CAR 1988.\n\n4 Conditions\n\n(1)The child must be carried in a Boeing 777 series aircraft.\n\n(2)The exemption is subject to the conditions of carriage mentioned in Schedule 1.\n\nSchedule 1 Conditions of carriage\n\n1 All staff, who may reasonably be expected to have any contact with the child during the carriage of the child, must be informed of the carriage of the child under this exemption and of the medical condition of the child.\n\n2 A qualified medical practitioner must provide a statement in writing that mentions the child’s medical condition, and that he or she:\n\n(a) is unable to sit upright unaided; and\n\n(b) weighs under 16 kilograms; and\n\n(c) is fit to travel.\n\n3 An approved infant seat belt must be used in the aircraft to restrain the child while sitting on an accompanying adult’s lap.","sortOrder":0}],"analysis":{"kimi_summary":{"_metrics":{"model":"kimi-k2.5","source":"moonshot-batch","completionTokens":2026},"content_quality":"ok","complexity_score":2,"scope_assessment":{"changed":false,"description":"This is the original 2010 exemption instrument; it establishes the scope (limited to V Australia and specific medical cases) rather than expanding or altering a pre-existing scope."},"complexity_factors":["Cross-references to Civil Aviation Regulations 1988 (subregulations 251(1) and 308(1))","Multiple cumulative eligibility criteria (age >2 years, weight <16kg, specific medical condition, specific aircraft type)","Single-operator limitation (specific ARN and trading name)","Sunset clause with fixed expiration date (31 August 2012)","Conditional requirements requiring external medical certification and internal staff notification"],"plain_english_summary":"This exemption let V Australia (Virgin Blue International) carry children over 2 with serious medical conditions who cannot sit upright, weighing under 16 kg, on an adult’s lap on Boeing 777s.
