Spence\\]\n\nPip Spence  \nDirector of Aviation Safety\n\n13 April 2026\n\nCASA EX24/26 — Part 65 Competency Standards for Air Traffic Controllers and On-the-Job Training Instructors (Airservices Australia) Exemption 2026\n\nPart 1 — Preliminary\n\n1 Name\n\nThis instrument is CASA EX24/26 — Part 65 Competency Standards for Air Traffic Controllers and On-the-Job Training Instructors (Airservices Australia) Exemption 2026.\n\n1A Commencement\n\nThis instrument commences on the day after it is registered.\n\n2 Application\n\nThis instrument applies to:\n\n(a) AA in its capacity as an ATS provider and an ATS training provider; and\n\n(b) an employee of AA who has applied for the grant of an ATC licence, air traffic controller rating or endorsement.\n\n3 Definitions\n\n> Note In this instrument, certain terms and expressions have the same meaning as they have in the Civil Aviation Act 1988 and the regulations. These include ATC licence, ATS provider, ATS training provider and CASR, all of which are defined in the CASR Dictionary.\n\nIn this instrument:\n\n> AA means Airservices Australia, ARN 202210.\n\nadapted air traffic controller competency standards means the group of competencies for air traffic controllers, with their associated description and performance criteria:\n\n(a) adapted from the relevant ICAO competency framework, specified in the ICAO Procedures for Air Navigation Services – Training (ICAO PANS‑TRG, Doc 9868), in accordance with the procedures for developing competency-based training and assessment for a given role specified in that document; and\n\n(b) provided to CASA by AA on 26 March 2026.\n\n> Note The definition of adapted air traffic controller competency standards refers to the version of that document provided to CASA on 26 March 2026. If AA makes any changes to that document, the exemptions in Part 2, which all effectively refer to that specific document, will cease to operate.\n\n> adapted on-the-job training instructor competency standards means the group of competencies for on-the-job training instructors, with their associated description and performance criteria:\n\n(a) adapted from the relevant ICAO competency framework, specified in the ICAO Procedures for Air Navigation Services – Training (ICAO PANS‑TRG, Doc 9868), in accordance with the procedures for developing competency-based training and assessment for a given role specified in that document; and\n\n(b) provided to CASA by AA on 26 March 2026.\n\n> Note The definition of adapted on-the-job training instructor competency standards refers to the version of that document provided to CASA on 26 March 2026. If AA makes any changes to that document, the exemptions in Part 3, which all effectively refer to that specific document, will cease to operate.\n\n> air traffic controller rating means a rating on an ATC licence granted under regulation 65.080 of CASR.\n\n> endorsement means an endorsement on an ATC licence granted under regulation 65.085 of CASR.\n\n> on-the-job training instructor qualification means an ATC qualification granted under regulation 65.095 of CASR that certifies that the holder is competent to perform the ancillary function of on-the-job instructor.\n\n> Part 65 Manual of Standards means the Manual of Standards issued by CASA under regulation 65.033 of CASR.\n\nPart 2 — Exemptions about air traffic controller competency standards\n\n4 Exemption — AA’s obligations as ATS provider\n\n(1) AA is exempt from compliance with subregulation 65.080(3) of CASR, but only to the extent that the program that AA has set up and maintained to ensure that its employees who hold ATC licences maintain air traffic controller ratings appropriate to their duties:\n\n(a) does not accord with the standards and requirements set out in Chapter 5 of the Part 65 Manual of Standards; and\n\n(b) does accord with the standards and requirements set out in the adapted air traffic controller competency standards.\n\n(2) AA is exempt from compliance with subregulation 65.085(4) of CASR, but only to the extent that the program that AA has set up and maintained to ensure that its employees who hold ATC licences maintain endorsements appropriate to their duties:\n\n(a) does not accord with the standards and requirements set out in Chapter 5 of the Part 65 Manual of Standards; and\n\n(b) does accord with the standards and requirements set out in the adapted air traffic controller competency standards.\n\n(3) AA is exempt from compliance with subregulation 65.030(1) and paragraph 65.090(1)(a) of CASR, but only to the extent that the program that AA has set up and maintained for the continuing assessment of the competency of any of its employees who hold air traffic controller ratings and endorsements for the purpose of ensuring that they continue to satisfy the currency requirements in relation to ratings and endorsements:\n\n(a) does not accord with Chapter 5 of the Part 65 Manual of Standards; and\n\n(b) does accord with the adapted air traffic controller competency standards; and\n\n(c) does not require assessments to be carried out in accordance with any relevant requirements and standards in Chapter 5 of the Part 65 Manual of Standards; and\n\n(d) requires the assessments to be carried out in accordance with any relevant requirements and standards set out in the adapted air traffic controller competency standards.\n\n(4) AA is exempt from compliance with subregulation 65.030(1) and paragraph 65.090(1)(b) of CASR, but only to the extent that the program that AA has set up and maintained for the familiarisation, retraining and assessment of any of its employees who hold air traffic controller ratings and endorsements that do not satisfy the currency or recency requirements in relation to an endorsement:\n\n(a) does not accord with Chapter 5 of the Part 65 Manual of Standards; and\n\n(b) does accord with the adapted air traffic controller competency standards; and\n\n(c) does not require assessments to be carried out in accordance with any relevant requirements and standards in Chapter 5 of the Part 65 Manual of Standards; and\n\n(d) requires assessments to be carried out in accordance with any relevant requirements and standards set out in the adapted air traffic controller competency standards.\n\n(5) AA is exempt from compliance with paragraph 65.100(a) of CASR, but only to the extent that the practical training for the award of an ATC licence, air traffic controller rating or endorsement that is required to be carried out by, or on behalf of, AA:\n\n(a) is not carried out in accordance with the standards and requirements set out in Chapter 5 of the Part 65 Manual of Standards; and\n\n(b) is carried out in accordance with the adapted air traffic controller competency standards.\n\n(6) AA is exempt from compliance with paragraph 65.105(a) of CASR, but only to the extent that an assessment that is carried out by, or on behalf of, AA for the award of an ATC licence, air traffic controller rating or endorsement:\n\n(a) is not carried out in accordance with the standards and requirements set out in Chapter 5 of the Part 65 Manual of Standards; and\n\n(b) is carried out in accordance with the adapted air traffic controller competency standards.\n\n5 Exemption — AA’s obligations as ATS training provider\n\n(1) AA is exempt from compliance with paragraph 143.055(a) of CASR, but only to the extent that the training relating to air traffic services that is provided by AA:\n\n(a) is not of at least the standard required by Chapter 5 of the Part 65 Manual of Standards; and\n\n(b) is of at least the standard required by the adapted air traffic controller competency standards.\n\n(2) AA is exempt from compliance with regulation 143.060 of CASR, but only to the extent that the training plan relating to air traffic services that AA is required to have and put into effect:\n\n(a) does not accord with the standards and requirements set out in Chapter 5 of the Part 65 Manual of Standards; and\n\n(b) does accord with the adapted air traffic controller competency standards.\n\n(3) AA is exempt from compliance with regulation 143.065 of CASR in relation to training relating to air traffic services covered by its approval (the required training), but only to the extent that:\n\n(a) AA does not, at all times, have enough suitably qualified personnel to enable it to provide the required training in accordance with the standards and requirement set out in Chapter 5 of the Part 65 Manual of Standards; and\n\n(b) AA does, at all times, have enough suitably qualified personnel to enable it to provide the required training in accordance with the adapted air traffic controller competency standards.\n\n(4) AA is exempt from compliance with paragraph 143.070(b) of CASR, but only to the extent that:\n\n(a) AA has given a person responsibility as an instructor or assessor for any training relating to air traffic services that AA provides; and\n\n(b) the person is required to satisfy the standards and requirements of Chapter 5 of the Part 65 Manual of Standards for persons who have that responsibility; and\n\n(c) the person:\n\n(i) does not satisfy the standards and requirements of Chapter 5 of the Part 65 Manual of Standards for persons who have that responsibility; and\n\n(ii) satisfies the standards and requirements of the adapted air traffic controller competency standards for persons who have that responsibility.\n\n6 Exemptions — employees of AA applying for grant of ATC licence, rating or endorsement\n\n(1) An employee of AA who has applied for the grant of an ATC licence is exempt from compliance with regulation 65.015 and paragraph 65.070(1)(c) of CASR, but only to the extent that the training successfully completed by the employee (including any examination or assessment):\n\n(a) was not in accordance with Chapter 5 of the Part 65 Manual of Standards for the licence, a rating and an endorsement; and\n\n(b) was in accordance with the adapted air traffic controller competency standards for the licence, a rating and an endorsement.\n\n(2) An employee of AA who has applied for the grant of an air traffic controller rating is exempt from compliance with regulation 65.015 and paragraph 65.080(1)(b) of CASR, but only to the extent that the training successfully completed by the employee (including any examination or assessment):\n\n(a) was not in accordance with Chapter 5 of the Part 65 Manual of Standards for the licence, a rating and an endorsement; and\n\n(b) was in accordance with the adapted air traffic controller competency standards for the licence, a rating and an endorsement.\n\n(3) An employee of AA who has applied for the grant of an endorsement on an ATC licence is exempt from compliance with regulation 65.015 and paragraph 65.085(2)(b) of CASR, but only to the extent that the training successfully completed by the employee (including any examination or assessment):\n\n(a) was not in accordance with Chapter 5 of the Part 65 Manual of Standards for the licence, a rating and an endorsement; and\n\n(b) was in accordance with the adapted air traffic controller competency standards for the licence, a rating and an endorsement.\n\nPart 3 — Exemptions about on-the-job training instructor competency standards\n\n7 Exemption — AA’s obligations as ATS provider\n\n(1) AA is exempt from compliance with subregulation 65.095(7) of CASR, but only to the extent that the program that AA is required to set up and maintain to grant on-the-job training instructor qualifications to its employees, and to administer such qualifications held by its employees:\n\n(a) does not accord with the standards and requirements set out in paragraph 3.1.12.1 of the Part 65 Manual of Standards; and\n\n(b) does accord with the adapted on-the-job training instructor competency standards.\n\n(2) AA is exempt from compliance with subregulation 65.095(7) of CASR to the extent that AA grants an on-the-job training instructor qualification in accordance with paragraph 3.1.11.3 of the Part 65 Manual of Standards, but only to the extent that the employee to whom it is granted:\n\n(a) has not demonstrated competency against the standards set out in Section 3.1.12 of the Part 65 Manual of Standards; and\n\n(b) has demonstrated competency against the adapted on-the-job training instructor competency standards.\n\n(3) AA is exempt from compliance with paragraph 65.100(a) of CASR, but only to the extent that the practical training for the award of on-the-job training instructor qualifications that is carried out by, or on behalf of, AA:\n\n(a) is not carried out in accordance with the standards and requirements set out in paragraph 3.1.12.1 of the Part 65 Manual of Standards; and\n\n(b) is carried out in accordance with the adapted on-the-job training instructor competency standards.\n\n(4) AA is exempt from compliance with paragraph 65.105(a) of CASR, but only to the extent that an examination or assessment that is carried out by, or on behalf of, AA for the award of on-the-job training instructor qualifications:\n\n(a) is not carried out in accordance with the standards and requirements set out in paragraph 3.1.12.1 of the Part 65 Manual of Standards; and\n\n(b) is carried out in accordance with the adapted on-the-job training instructor competency standards.\n\n8 Exemption — AA’s obligations as ATS training provider\n\n(1) AA is exempt from compliance with paragraph 143.055(a) of CASR, but only to the extent that the training relating to the grant of on-the-job training instructor qualifications that is provided by AA:\n\n(a) is not of at least the standard required by paragraph 3.1.12.1 of the Part 65 Manual of Standards; and\n\n(b) is of at least the standard required by the adapted on-the-job training instructor competency standards.\n\n(2) AA is exempt from compliance with regulation 143.060 of CASR, but only to the extent that the training plan for the training relating to the grant of on-the-job training instructor qualifications covered by its approval that AA is required to have and put into effect:\n\n(a) does not accord with the standards and requirements for on-the-job training instructor qualifications in paragraph 3.1.12.1 of the Part 65 Manual of Standards; and\n\n(b) does accord with the adapted on-the-job training instructor competency standards.\n\n(3) AA is exempt from compliance with regulation 143.065 of CASR in relation to training relating to the grant of on-the-job training instructor qualification covered by its approval (the required training), but only to the extent that:\n\n(a) AA does not, at all times, have enough suitably qualified personnel to enable it to provide the required training in accordance with the standards and requirement set out in paragraph 3.1.12.1 of the Part 65 Manual of Standards; and\n\n(b) AA does, at all times, have enough suitably qualified personnel to enable it to provide the required training in accordance with the adapted on-the-job training instructor competency standards.\n\n(4) AA is exempt from compliance with paragraph 143.070(b) of CASR, but only to the extent that AA has given a person responsibility as an instructor for any training relating to the grant of on-the-job training instructor qualifications that AA provides, and that person:\n\n(a) does not satisfy the requirements relating to on-the-job training instructor qualifications set out in Section 3.1.12 of the Part 65 Manual of Standards relating to competency standards;
