{"id":"F2009L03552","name":"CASA 428/09 – Direction – number of cabin attendants","slug":"casa-428-09-direction-number-of-cabin-attendants","collection":"legislative_instrument","jurisdiction":"commonwealth","status":"repealed","isInForce":false,"actNumber":null,"makingDate":null,"administeringDepartment":null,"currentVersion":{"id":141293,"registerId":"commonwealth-F2009L03552-current","compilationNumber":null,"startDate":"2026-04-03","status":"Repealed","reasons":null,"registeredAt":null},"sections":[{"sectionNumber":"1","sectionType":"section","heading":"CASA 428/09 – Direction – number of cabin attendants","content":"Instrument number CASA 428/09\n\nI, MICHAEL DAVID QUINN, Deputy Director of Aviation Safety, a delegate of CASA, make this instrument under regulation 208 of the Civil Aviation Regulations 1988.\n\n\\[Signed M.D. Quinn\\]\n\nMick Quinn  \nDeputy Director of Aviation Safety\n\n29 September 2009\n\nDirection — number of cabin attendants\n\n1 Duration\n\nThis instrument:\n\n(a) commences on 1 October 2009; and\n\n(b) stops having effect at the end of 31 August 2011.\n\n2 Application\n\nThis instrument applies to the aircraft mentioned in section 3 that is:\n\n(a) operated by Capiteq Limited, trading as Airnorth, Aviation Reference Number 518845 (the operator); and\n\n(b) engaged in regular public transport and charter operations.\n\n3 Direction\n\nIn spite of subparagraph 6.1 (b) of Civil Aviation Order 20.16.3 (CAO 20.16.3), the operator may operate an Australian registered Embraer 170/100 series aircraft with a type certificate data sheet that provides for a maximum seating capacity of 78 passengers if there is 1 cabin attendant for every 50 passenger seats or part of that number.\n\nNote CAO 20.16.3 applies in all other respects to an aircraft referred to in this section.\n\n4 Conditions\n\nThe direction is subject to the conditions mentioned in Schedule 1.\n\nSchedule 1 Conditions\n\n1 During the aircraft take-off, landing operation and in prepared emergencies, a cabin attendant must be positioned in the crew seat adjacent to the forward and aft entrance doors which serve as emergency exits.\n\n2 The operator must ensure that the aircraft can be evacuated in 90 seconds.\n\n3 Arrangements for the seating and briefing of passengers must be in accordance with procedures set out in the operator’s operations manual and approved by CASA.","sortOrder":0}],"analysis":{"kimi_summary":{"_metrics":{"model":"kimi-k2.5","source":"moonshot-batch","completionTokens":2833},"content_quality":"ok","complexity_score":2,"scope_assessment":{"changed":false,"description":"The instrument maintains its original narrow scope as a specific exemption for Airnorth's Embraer 170 operations.
