{"id":"F2005B00728","name":"CASA 316/98 - Instruction under regulation 174A relating to the carriage of transponders by aircraft operating in controlled airspace","slug":"casa-316-98-instruction-under-regulation-174a-relating-to-the-carriage-of-transponders-by-aircraft-o","collection":"legislative_instrument","jurisdiction":"commonwealth","status":"repealed","isInForce":false,"actNumber":null,"makingDate":null,"administeringDepartment":null,"currentVersion":{"id":32190,"registerId":"commonwealth-F2005B00728-current","compilationNumber":null,"startDate":"2026-04-01","status":"Repealed","reasons":null,"registeredAt":null},"sections":[{"sectionNumber":"1","sectionType":"section","heading":"CASA 316/98 - Instruction under regulation 174A relating to the carriage of transponders by aircraft operating in controlled airspace","content":"INSTRUMENT NUMBER: CASA 316/98\n\nCIVIL AVIATION ACT 1988\n\nCIVIL AVIATION REGULATIONS\n\nINSTRUCTION UNDER REGULATION 174A RELATING TO THE CARRIAGE OF TRANSPONDERS BY AIRCRAFT OPERATING IN CONTROLLED AIRSPACE\n\nI, MICHAEL ROBERT TOLLER, Director of Aviation Safety:\n\n(1) revoke instrument number CASA 207/98; and\n\n(2) under regulation 174A of the Civil Aviation Regulations, on behalf of CASA, specify:\n\n(a) that an aircraft must be fitted with a serviceable Mode A and Mode C secondary surveillance radar transponder before the aircraft undertakes a V.F.R flight within radar coverage in airspace that has been determined under subregulation 2.04 (1) of the Airservices Regulations to be Class A airspace, Class B airspace or Class C airspace; and\n\n(b) that an aircraft with an engine driven electrical system capable of continuously powering a transponder must be fitted with a serviceable Mode A and Mode C secondary surveillance radar transponder before the aircraft undertakes a V.F.R flight in airspace that has been determined under subregulation 2.04 (1) of the Airservices Regulations to be Class E airspace.\n\nThis instruction does not apply to aircraft operating in general aviation aerodrome procedures control zones.\n\nThis instrument starts having effect on 25 August 1998.\n\n\\[Signed M.
