The planning\ncontrol area has previously been declared to protect the future primary regional road reservation for\nthe Armadale Road bridge/North Lake Road re-alignment. The planning control area is now amended\nto include all lots severed to the south by the deviation route, as well as adjustments to account for\nthe final alignment of the Armadale Road deviation and new North Lake Bridge / Freeway\ninterchange, as shown on Western Australian Planning Commission plan number 1.7415/2.\nPurpose\nThe purpose of the planning control area is to protect the future primary regional road reservation for\nthe Armadale Road bridge/North Lake Road re-alignment. The WAPC considers that the planning\ncontrol area is required over the whole of the land to ensure that no development occurs on this land\nwhich might prejudice this purpose until it may be reserved for future primary regional road\nreservation in the Metropolitan Region Scheme.\nDuration and effects\nThe amended Planning Control Area has effect from the date of publication of this notice in the\nGovernment Gazette to 8 March 2021, or until revoked by the WAPC with the approval of the\nMinister.\nA person shall not commence and carry out development in a planning control area without the prior\napproval of the WAPC. The changes aim to boost road and pedestrian safety and protect public footpaths and verges from damage."},"flash_summary":{"complexity_score":3,"scope_assessment":{"changed":true,"description":"The amendment modestly expands/enforces the local government's regulatory reach over how vehicles are parked and how property access is achieved. It adds a new on-street parking offence (clause 1.4 amending clause 3.2), replaces the footpath/verge access rule with a prohibition subject to local government approval (clause 1.5 replacing clause 5.11), and adjusts prescribed offences and penalties (clause 1.6, Schedule 2). The result is tighter behavioural rules for drivers and additional approval discretion for the council."},"complexity_factors":["Targets a narrow set of on-street behaviours (parking orientation and driving over footpaths) rather than broad regulatory overhaul.","Amends and relies on the principal local law (Town of Cambridge Parking Local Law 2016) rather than standalone rules (see clause 1.3).","Introduces a discretionary exception for approved or permitted crossovers, concentrating decision-making with the local government (new clause 5.11).","Creates/renames prescribed offences and sets a specific modified penalty for the new offence (Schedule 2 — new Item 23A: 3.2(2)(f) — $80).","Textual edits to offence descriptions can produce enforcement interpretation issues (eg. phrase ‘normal flow of traffic’ in inserted 3.2(2)(f)).","Changes interact with existing driveway/access practice and compliance burden for residents wanting non-standard access arrangements."],"plain_english_summary":"This amendment to the Town of Cambridge Parking Local Law 2016 makes three practical changes: it bans parking against the normal flow of traffic on a carriageway, forbids driving over footpaths or verges to reach property unless an approved crossover is used, and updates the schedule of prescribed offences and fines (new Item 23A — $80). It affects all drivers and property owners in the Town of Cambridge and matters because it creates new enforceable offences and gives the local government discretion to permit crossovers."}},"importantCases":[],"_links":{"self":"/api/acts/cambridge-town-of-parking-amendment-local-law-2018","history":"/api/acts/cambridge-town-of-parking-amendment-local-law-2018/history","analysis":"/api/acts/cambridge-town-of-parking-amendment-local-law-2018/analysis","conflicts":"/api/acts/cambridge-town-of-parking-amendment-local-law-2018/conflicts","importantCases":"/api/acts/cambridge-town-of-parking-amendment-local-law-2018/important-cases","documents":"/api/acts/cambridge-town-of-parking-amendment-local-law-2018/documents"}}
