Coordinates and lines (1 km, 5 km, 500 m, 100 m, reef crests, geodesics) are used to fix every boundary.\n\n- Defines what counts as a “Location” (either the 500 metre line around a listed reef, or a Schedule 3 Locality) and includes vertical limits (Localities extend vertically to 915 metres above ground or water; Locations include airspace to 500 feet) (Schedule 3; Schedule 9 Definitions).\n\n- Allocates use-intensity labels (Intensive / Moderate / Low) to individual reef Locations and Localities and lists which specific reef features fall into each category (Schedule 4). These labels are used to govern allowable activities and access regimes.\n\n- Imposes operational limits for sensitive places: sets airspace-height sensitivities and daily booking limits (for vessels) at named Sensitive Locations (Schedule 5, columns 3–4). Example: Michaelmas Cay has an airspace height of 3 000 ft and a booking limit of 1 vessel per day (Schedule 5 Part 1, item 5).\n\n- Fixes the number of permitted moorings and permitted pontoons at named Locations and Localities (Schedule 6 and Schedule 7). Those schedules list exact allowed counts (for example, Michaelmas Cay Locality: 19 permitted moorings; Agincourt No.4 Reef: 1 pontoon) and include site-specific historical exceptions (moorings allowed above the number permitted on 22 June 1998 at some reefs).\n\n- Establishes reef anchorages, reef anchorage areas and bad-weather anchorages (Schedule 8 and Schedule 6C). These define where vessels may anchor and where large vessels can seek shelter.\n\n- Sets group-size limits and lists which moderate-use Locations allow mooring access or reef anchorages for groups up to 100 people (Schedules 6A and 6B).\n\n- Provides a comprehensive set of definitions used to interpret all of the above (Schedule 9). Important defined concepts include types of tourism operations (standard, regional, craftless, long-range roving), vessel-size classes (large vessel, ship), mooring/pontoon definitions, “existing” vs “new” permissions, and mooring/pontoon site radii.\n\n**Who is directly affected**\n\n- Commercial tourism operators (all types of tourism programs listed in Schedule 9): their permitted destinations, group sizes, vessel sizes, and daily access are controlled by the Plan (see Schedules 4, 5, 6, 6A/6B and Schedule 9 definitions).\n\n- Vessel and pontoon owners/operators and mooring providers: permitted mooring and pontoon numbers and mooring site rules (50 m mooring site radius; 200 m pontoon site radius) govern where and how many fixed facilities can operate (Schedules 6, 7, Schedule 9).\n\n- The Great Barrier Reef Marine Park Authority (the “Authority” under the Act): it administers permissions, conversions, and enforcement; the Plan specifies how the Authority may treat existing vs new permissions and site plans (Schedule 9 and cross-referenced clauses).\n\n- Other stakeholders: fishers, aquaculture operators, traditional owners, local councils and local businesses that rely on reef visitation will all be affected indirectly by access restrictions, booking caps and the spatial layout of permitted uses.\n\n**Why it matters (practical effects and mechanics)**\n\n- It turns spatial zoning into operational rules. The Plan does not merely map reefs — it translates mapping into enforceable limits: exact mooring counts, vessel-day booking caps at sensitive Localities, allowed pontoon numbers, permitted anchorage areas, and group-size caps for certain access methods (Schedules 5, 6, 7, 8, 6A/6B).\n\n- Decisions are taken administratively by the Authority (permissions, VINs, conversions, site‑plans). That central role means the Authority determines who may operate where, subject to the Plan’s caps and definitions (Schedule 9; cross-references to permit provisions).\n\n- Compliance and operating costs fall primarily on private operators. Limits on moorings, pontoons and booking slots constrain operators’ capacity to sell tours, and therefore affect revenues and prices. Operators that already hold existing permissions or that control moorings/pontoons receive concentrated benefit from grandfathering or site‑specific allowances (see Schedule 6 entries noting existing counts as at 22 June 1998).\n\n- The Plan creates entry frictions. Numerical caps, site‑specific allocations and the need for relevant permissions introduce scarcity of access that can advantage incumbents or permit‑holders (VINs) and raise barriers for new entrants (Schedule 9: new permission / existing permission definitions; various Schedules listing fixed numbers).\n\n**Stated purpose-claims and testing them against trade-offs**\n\n- Stated purpose (implicit in a Plan of Management): to manage visitor use and protect sensitive reef/locality values by limiting crowding, mooring pressure and air/sea disturbance. The instrument does this directly through mapping and numeric limits (Schedules 4, 5, 6, 7, 8).\n\n- Costs and incentives: booking caps and mooring/pontoon limits reduce the marginal availability of visitor-access slots; operators face higher scarcity rents for permitted capacity and may respond by raising prices or concentrating effort on allowed Locations. Operators without pre‑existing permissions bear the cost of limited entry and additional administrative compliance (Schedule 6; Schedule 9).\n\n- Trade-offs and opportunity costs: allocating fixed numbers of moorings, pontoon sites and vessel-days to certain reefs prevents alternative uses of those same spatial footprints (e.g. new tourism operators, different permit types, or different forms of marine infrastructure). Historical allowances (specific moorings allowed above the standard number as at 22 June 1998) show the Plan preserves some incumbency, which reduces short‑term redistributional effects but can entrench incumbents.\n\n- Implementation risk & bureaucratic discretion: many rules reference permissions, VINs and site plans that the Authority issues or determines (Schedule 9; cross-references). That creates operational dependence on administrative capacity and on how the Authority applies discretion to site assessments, renewals, or conversions.\n\n- Compliance burden: operators must track which Locations are Intensive/Moderate/Low (Schedule 4), whether a site is Sensitive and requires booking (Schedule 5), the number of permitted moorings/pontoons (Schedules 6–7), and any special limits (Schedules 6A–6C). This generates recurring administrative tasks, potential permit applications and monitoring/enforcement risk.\n\n**Concrete examples from the Plan**\n\n- Moorings: Schedule 6 lists permitted mooring counts by Location (e.g. Michaelmas Cay Locality — 19 permitted moorings in Schedule 6, item under Offshore Cairns).\n\n- Sensitive Location booking caps: Schedule 5 sets daily vessel booking limits (e.g. Green Island Reef Location — 4 vessels per day; Michaelmas Cay — 1 vessel per day; various sites have 1–4 vessel/day limits or none).\n\n- Group-size rules and access: Schedules 6A and 6B list moderate-use reefs and reef anchorages where group-size limits of 100 apply.\n\n- Permanently moored pontoons: Schedule 7 lists allowed pontoons by site (e.g. Arlington Reef — 2 pontoons; Moore Reef Locality 1 — 2 pontoons).\n\n**Who pays, who decides, and what behaviour changes**\n\n- Who pays: commercial operators (tourism operators, mooring/pontoon owners) bear most direct costs — permit application and compliance costs, potential higher capital costs to acquire limited mooring/pontoon slots, and possible higher operating prices to reflect limited vessel-days.\n\n- Who decides: the Great Barrier Reef Marine Park Authority administers permissions, VIN attachments, conversions and site plans within the constraints and numbers the Plan prescribes (Schedule 9 definitions; clauses cross‑referenced in Schedules).\n\n- Behaviour changes expected: operators will allocate vessels to Locations where they hold capacity; may raise prices where slots are scarce; may invest in permitted pontoons/moorings where allocated; and may shift itineraries toward less restricted Locations. Some operators can rely on existing permissions or historic allowances, which reduces their need to compete for new allocation.\n\n**Implementation notes and practical risks**\n\n- Accuracy of mapping and coordinates matters for enforcement and operator planning (Schedules 2–3, Schedule 8 anchorages).\n\n- The Plan mixes baseline caps with site‑specific historical exceptions; tracking which sites have grandfathered allowances (dates cited) creates additional administrative complexity (see Schedule 6 entries referencing numbers permitted on 22 June 1998).\n\n- Cross-references to the Act, Regulations and the Zoning Plan mean effective implementation depends on coordination across instruments and on how the Authority exercises discretion over permissions and VINs (Schedule 9).\n\n"}},"importantCases":[],"_links":{"self":"/api/acts/cairns-area-plan-of-management-1998","history":"/api/acts/cairns-area-plan-of-management-1998/history","analysis":"/api/acts/cairns-area-plan-of-management-1998/analysis","conflicts":"/api/acts/cairns-area-plan-of-management-1998/conflicts","importantCases":"/api/acts/cairns-area-plan-of-management-1998/important-cases","documents":"/api/acts/cairns-area-plan-of-management-1998/documents"}}
