As from 13 October 2004, a legislative item relating to a provision of an Act is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. Operators of bus services, procurers (people or bodies that charter or engage a service), bus safety workers (including drivers and maintainers) and people who design or maintain bus stops must, \"so far as is reasonably practicable,\" ensure safety (see s.15, s.16, s.17, s.18).\n\n- Creates a statutory accreditation regime for bus operators (Part 4) and, separately, for drivers of commercial and local bus services (Part 4A).  Accreditation is required to operate most bus services in Victoria (s.22) and to drive in certain services (s.55J).  Applications, decision-making standards, conditions, renewals, fees and obligations are set out in detail (see ss.23–40; ss.55K–55R).\n\n- Gives Safe Transport Victoria (STV) broad administrative powers: to grant/refuse accreditations and driver accreditations (s.24; s.55O), impose conditions (s.31; s.55Q), set and collect fees (s.67; s.71A), require information (s.55G), conduct safety audits (s.20) and immediately suspend accreditations where public safety requires (s.45; s.55ZC; s.55ZD).\n\n- Requires accredited operators to run safety systems and inspections: annual or prescribed-interval safety inspections for buses (s.19), and a written alcohol and drug management policy with specified testing rules if testing is used (s.56–57).\n\n- Provides enforcement and remedies: disciplinary processes (s.46; ss.55W–55ZA), suspension/cancellation powers, criminal penalties ranging from infringement-level fines up to indictable offences for serious breaches (e.g. s.15 offences), and officer liability where corporate entities fail to prevent offences (s.69).\n\n- Sets review channels: internal review by STV and external review by VCAT for many accreditation and driver-decision outcomes (Part 6, ss.58, 58A, 58D, 58E).\n\n- Authorises subsidiary rule‑making and practical guidance: extensive regulation-making powers (s.72 et seq.) and approval of codes of practice (ss.59–64) that provide operational detail and may be relied on to show compliance (s.70).\n\nKey actors and who pays\n\n- Who decides: Safe Transport Victoria makes the accreditation, exemption, fee and disciplinary decisions (many provisions across Parts 4 and 4A: e.g. ss.24, 31, 36A, 55O, 55T).  The Minister approves codes and may publish guidelines (ss.59–64; s.44(5)).  VCAT reviews some STV decisions (Part 6).\n\n- Who pays: accredited operators and accredited drivers pay application, inspection and annual accreditation fees set by STV (s.67; s.36A; ss.55S, 71A).  Operators and drivers also bear compliance costs: inspections, training, administration, drug/alcohol testing, record keeping and possible corrective action following audits.\n\nWho is affected\n\n- Directly: bus operators (commercial, minibus, route, charter, demand‑responsive), drivers (commercial and local services), procurers who charter or set contractual terms, people who design or maintain bus stops, and bodies required to produce information to STV.\n\n- Indirectly: passengers, especially children and other vulnerable people (the statute singles out safety and \"public care\" objectives in Part 4A, s.55I), and service purchasers whose contracts may be reviewed for safety‑threatening terms (s.16(2)).\n\nWhy it matters (practical implications, incentives and trade‑offs)\n\n- Safety vs cost of compliance.  The Act centralises safety oversight (accreditation, regular inspections, alcohol/drug policies, audits).  That raises the standard of safety management (mechanism: s.14, ss.19–20, ss.56–57) but imposes recurring costs on operators and drivers (inspection, training, fees set under s.67 and s.71A).\n\n- Entry and labour effects.  Accreditation and driver accreditation are gatekeeping tools: they control who may operate or drive (s.22; s.55J).  Non‑transferability (s.35; s.55VI) keeps accreditations personal to holders.  This reduces the risk that an operator or driver can immediately sell on accreditation but also makes business exits or sales administratively heavier.\n\n- Administrative discretion and regulatory burden.  STV has wide discretionary powers to impose conditions, vary accreditations and set fees (s.31; s.39; s.67).  That discretion can produce tailored safety responses but creates compliance uncertainty and gives regulated parties a strong incentive to engage with STV on fee-setting and conditions (consultation requirements appear in ss.31(4)–(6), s.67(5)–(6)).\n\n- Enforcement leverage on contracting.  The Act makes procurers potentially liable if contracting terms threaten safety (s.16(2)), which shifts incentives upstream: organisations that commission bus services may need to change contract terms (price, timetables, performance requirements) to avoid creating safety risk.\n\n- Cross‑jurisdiction coordination.  The Act provides mechanisms for treating interstate operators (ss.41–44) and for consulting corresponding regulators, which reduces duplication but maintains scope for STV to differ on conditions (s.42(4); s.44).\n\n- Concentrated benefits and diffuse costs.  The immediate, concentrated beneficiaries of accreditation and oversight are those actors who obtain the regulatory licence to operate (market access) and stakeholders who prefer regulated safety standards.  Costs (fees, time to comply, training) are spread across many small operators and drivers.  STV’s power to set differing fees by class (s.67(2)(f)) means compliance costs can be targeted by operator size or service type.\n\n- Implementation risks and trade‑offs.  The Act relies on STV capacity to process applications within statutory timeframes (operator decisions: s.33; driver decisions: s.55N), to run audits (s.20), and to handle disciplinary matters fairly (s.47).  Regulatory timing, administrative resourcing and clarity about \"fit and proper\" assessments (s.24) are implementation bottlenecks that affect how burdens translate into delays and costs.\n\nSelected section references for quick navigation\n\n- Purpose and objects: s.1, s.4.  Definitions and scope: s.3.  Duties: ss.14–18.  Inspections and audits: ss.19–20.  Operator accreditation: Part 4 (ss.21–55H); offence to operate without accreditation: s.22.  Driver accreditation regime: Part 4A (ss.55I–55ZI).  Fees and exemptions: ss.36A, 67, 67A, 71A.  Suspension, disciplinary action and review: ss.45–49; ss.55W–55ZA; Part 6 (reviews).\n\nSummary conclusion (mechanical effect, not a policy judgement)\n\nThis Act builds a comprehensive regulatory framework for bus safety in Victoria.  It does so by imposing statutory duties on operators, procurers, drivers and infrastructure designers; by creating operator and driver accreditation systems with enforceable conditions and penalties; and by giving Safe Transport Victoria broad powers to set fees, require information, audit and discipline.  The mechanics prioritise formal oversight and administrative control of entry, conduct and monitoring of bus services, with trade‑offs in compliance cost, administrative discretion and timing of regulatory decisions (see s.15; s.22; s.31; s.55O; s.67)."},"issue_detection":{"absurdities":[],"contradictions":[]},"flash_summary_failed":{"failed":true,"reason":"Unauthenticated. This involves proving you're \"fit and proper,\" competent, and can operate safely. Accreditation comes with conditions — like using properly maintained vehicles and only employing accredited drivers.\n\n- **Driver accreditation** (Part 4A, added in 2023): Drivers of commercial and local bus services must now also be personally accredited. Safe Transport Victoria checks their criminal history, driving record, and fitness. Serious offences (sexual offences, serious violence, terrorism, trafficking) can disqualify someone automatically or lead to refusal.\n\n- **Safety duties** (Part 3): Everyone in the chain has legal duties to ensure safety \"so far as is reasonably practicable.\" Operators must ensure their services are safe. Procurers can't hire buses on terms that threaten safety. Workers must take reasonable care. People designing bus stops must ensure they're safe.\n\n- **Alcohol and drug policies** (Part 5): Accredited operators must have written policies banning drivers from having alcohol or drugs in their system, with testing procedures.\n\n- **Inspections and audits**: Buses must undergo annual safety inspections. Safe Transport Victoria can conduct safety audits and demand information.\n\n- **Enforcement**: The regulator can suspend or cancel accreditations, impose conditions, and prosecute offences. There are serious penalties — up to 9,000 penalty units for corporations that breach safety duties.\n\n- **Review rights**: Decisions can be reviewed internally and then by **VCAT** (Victoria's administrative tribunal). There's a special process for people with serious criminal histories to seek VCAT orders allowing them to drive despite automatic disqualification.\n\n**Who it affects:**\n\n- Bus companies (commercial operators, tour and charter services, local community services)\n- Bus drivers\n- Schools, clubs, and community groups running bus services\n- Anyone chartering or hiring buses\n- People designing, building, or maintaining bus infrastructure\n\n**Why it matters:**\n\nBuses carry vulnerable people — including children, elderly passengers, and people with disabilities. This Act aims to prevent accidents through proactive safety management rather than just punishing failures after they happen. The 2023 amendments significantly expanded it to require individual driver accreditation, bringing bus drivers into line with other commercial passenger vehicle drivers like taxi and rideshare drivers."}},"importantCases":[],"_links":{"self":"/api/acts/bus-safety-act-2009","history":"/api/acts/bus-safety-act-2009/history","analysis":"/api/acts/bus-safety-act-2009/analysis","conflicts":"/api/acts/bus-safety-act-2009/conflicts","importantCases":"/api/acts/bus-safety-act-2009/important-cases","documents":"/api/acts/bus-safety-act-2009/documents"}}
