The instrument’s core scope — imposing a percentage levy on construction work to fund industry training and making project owners liable — remains the same. That other Act contains the detailed collection, administration and use of the money raised (not reproduced here).\n\n**Who is affected**\n\n- Project owners of construction work (s.6) are the primary payers of the levy.\n- Contractors, sub‑contractors, suppliers and ultimately purchasers or tenants may be indirectly affected if project owners pass the cost on in contract prices or bids.\n- Administrators and training providers connected with the Building and Construction Industry Training Fund are affected because the levy supplies funding for that scheme (via the incorporated Act).\n\n**Why it matters**\n\n- It creates a dedicated revenue stream (fixed-percentage levy) intended to support training in the building and construction industry — the declared purpose is found by reading this Act together with the incorporated Fund Act (s.3).\n- Even at a low headline rate (0.2%), the levy is charged on the full value of construction work, so it scales with project size and can change tendering and pricing behaviour (s.5).\n- The Governor may change the rate by regulation (s.7), so the effective cost to project owners could be higher than the statutory 0.2% if regulations prescribe a different percentage.\n\n**Practical mechanics and immediate incentives**\n\n- The statute places legal liability on the project owner to pay the levy (s.6); in practice, project owners may contractually pass the cost to builders or clients, which changes bargaining and pricing but does not alter statutory liability.\n- Collection and enforcement procedures are not in this short Act: they are handled by the incorporated Building and Construction Industry Training Fund and Levy Collection Act 1990 (s.3). That means compliance steps (registration, declarations, audits, penalties) are governed elsewhere.\n\n**Costs, trade-offs and risks**\n\n- Who pays: Statutory payer is the project owner (s.6). Economic incidence may be shifted (passed on) to contractors, purchasers or tenants through higher bids or prices.\n- Compliance burden: The Act gives effect to a sector-wide levy; administrative and record-keeping costs will arise under the collection Act and for payers who must monitor and report project values.\n- Discretion and rate risk: The Governor’s regulation power over the percentage (s.7) creates a route for future increases without amending the primary Act, introducing regulatory rate risk for project budgeting.\n- Allocation and oversight risk: Because the money is channelled to a Fund (see s.3), how the Fund is governed determines who benefits. That centralised funding creates a potential for concentrated beneficiaries (training providers or organisations tied to fund governance) and diffuse payers (project owners and ultimately consumers), depending on fund rules and governance in the incorporated Act.\n\n**Concrete behavioural effects likely to follow**\n\n- Slight upward pressure on the effective cost of construction projects, proportional to project value (s.5).\n- Administrative interaction between project owners and the Fund’s collection regime (s.3) — e.g., registration, reporting and payments — which may alter contracting practices.\n- Incentive to link training or compliance requirements into procurement and contracting if project owners want to maximise the perceived return from the levy-funded training."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
