It does not broaden or narrow the exclusion’s substance in this text; it preserves the exclusion while imposing an explicit 60‑month expiry that requires future reconsideration (s7)."},"complexity_factors":["Cross-reference to the Act’s definition: the exclusion operates by modifying paragraph (c) of subsection 6(1) of the Act, so interpretation requires consulting the Act’s defined terms (see instrument s4 and s6).","Narrow technical carve-out: exclusion applies to internet delivery except where services use broadcasting services bands, creating a boundary between IP-delivery and spectrum-based delivery that can require technical/legal classification (s6).","Sunset provision: the instrument self-repeals after 60 months, requiring renewal or replacement and periodic policy review (s7).","Repeal of prior instrument: the 2019 Determination is expressly repealed in Schedule 1, so legal continuity requires checking the repeals and any differences between instruments (Schedule 1).","Made under delegated power: instrument issued by the Minister under subsection 6(2) of the Act, so scope and exercise rest on that statutory delegation (s3).","Commencement mechanics: operative from registration (s2), affecting timing of application and transitional arrangements for affected providers (s2).","Compliance and regulatory burden shift: by excluding a class of services from the Act’s definition, the instrument reduces the set of entities subject to broadcasting obligations but requires regulators and providers to determine coverage (s6).","Behavioural incentives: providers may choose delivery methods (use of broadcasting services bands vs internet-only) with regulatory consequences, creating incentives tied to the carve-out (s6)."],"plain_english_summary":"This determination says services that make television or radio programs available over the internet are not “broadcasting services” under the Broadcasting Services Act, unless they deliver programs using broadcasting services bands. It repeals the 2019 instrument and automatically expires after 60 months. The change alters which online audio/video providers fall inside broadcasting regulation and therefore affects who must comply with broadcasting obligations and who does not."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
