The principal durable change relative to a bare designation is the insertion of explicit, ongoing notification obligations on port owners/lessees/operators (section 9), which increases administrative duties but does not broaden the statutory goals or create new categories of regulated activity. (Sections 5–6.)\n- Identifies specific areas, berths and facilities within the port as the authorized \"biosecurity entry points\" where arriving vessels and unloaded goods must be brought for biosecurity control. The instrument sets separate tables for vessels and for goods and maps classes of vessel/goods to named areas (Inner Harbour 18–29, H/K/M/N Berths, Outer Harbor 1–8, Osborne 1, Osborne Naval Shipyard Common User Facility, Port Adelaide Passenger Terminal, etc.). (Sections 7–8.)\n- Lists exceptions: the designation does not apply to non‑commercial vessels, and Port Adelaide is not the first point of entry for live horses, non‑commercial vessel baggage or non‑commercial vessel waste. (Sections 5–6.)\n- Imposes notification conditions on the port owner, any lessee and on persons/bodies responsible for operations. They must give the Agriculture Department written notice when there is (or will be) a change to the business entity operating the port or a biosecurity entry point, and must give written notice (reasonable notice for proposed changes) before making changes that affect biosecurity procedures, facilities, or the ability to identify or notify about biosecurity risks. (Section 9.)\n\n**Who it affects\n\n- Port owner and any lessees or operational contractors at the Port of Port Adelaide: they must inform the Agriculture Department about changes to operators and about planned changes that could affect biosecurity arrangements. (Section 9.)\n- Ship operators and masters of vessels (other than non‑commercial vessels): when arriving at Port Adelaide they must bring the vessel to the port area designated as the appropriate biosecurity entry point as soon as practicable. (Sections 7 and note re section 246 of the Act.)\n- Cargo owners, freight handlers, terminal operators and stevedores: goods unloaded from vessels must be brought to the designated biosecurity entry point for that class of goods as soon as practicable. (Section 8 and note re section 147 of the Act.)\n- Biosecurity officials and the Agriculture Department (administration and enforcement): benefit from clear, named locations where they can exercise inspection and control powers.\n\n**Why it matters (practical effects and trade‑offs)\n\n- Predictability for biosecurity enforcement: by fixing where inspections, testing or other biosecurity controls occur, the instrument concentrates government activity and establishes the legal basis to require vessels/goods to be routed to those places. (Sections 7–8.)\n- Operational constraints and compliance costs for port users: ship operators and cargo handlers may incur additional movement, scheduling or storage costs to ensure vessels and goods are brought to the specific authorised berths/areas. Those costs are concentrated on the businesses using the port. (Sections 7–8.)\n- Ongoing administrative burden for port owners/operators: written notification obligations require rapid reporting of changes of operator and pre‑notification of changes to procedures or facilities that affect biosecurity. This creates an ongoing compliance cost and increases interaction with the Agriculture Department. (Section 9.)\n- Trade‑offs: the instrument increases the ability of biosecurity agencies to control entry risk at the cost of some loss of flexibility for port operations. The legal standards used—\"as soon as practicable\" and \"reasonable notice\"—are open to case‑by‑case interpretation, giving biosecurity authorities and courts some discretion when disputes arise. (Sections 7–9.)\n\n**Concrete implementation and risk notes (mechanisms, not judgments)\n\n- Who decides: the instrument itself (made under s 229(1) of the Act) fixes the legal designation. The Agriculture Department is the recipient of notices and the operational counterpart for biosecurity controls. (Sections 3 and 9.)\n- Behaviour changes required: vessel masters and cargo operators must route arrivals and unloaded goods to the specific berths/areas listed; port owners/operators must institute processes to detect, document and notify changes to operators or to biosecurity‑related procedures/facilities. (Sections 7–9.)\n- Potential implementation frictions: accurate mapping/signage of the designated areas, synchronising berth availability with inspection capability, and resolving borderline cases (e.g. vessels arriving outside specified berths) will all be practical coordination tasks. The instrument cross‑references multiple provisions of the Biosecurity Act (for example sections 147, 173, 174, 229, 246) that can affect how particular goods or vessels are treated in practice.\n\n**Key statutory references in the instrument**\n- Definitions and scope: section 4 (definitions used in the instrument), which relies on definitions in section 9 and section 19 of the Act for the term \"goods\". (Section 4.)\n- Designations: sections 5–6 (first point of entry for vessels and goods) and sections 7–8 (named biosecurity entry points for vessels and goods). (Sections 5–8.)\n- Conditions/notifications: section 9 (notice obligations for owners, lessees and persons/ bodies responsible for operations).\n\nThis summary describes what the instrument does and the direct operational effects it creates. Statements of purpose appearing in the instrument (for example implied aims of concentrating inspections) are presented as the statutory mechanism; readers should treat claims about intended policy outcomes as the drafter's purpose and weigh them against the practical costs and administrative requirements noted above."}},"importantCases":[],"_links":{"self":"/api/acts/biosecurity-first-point-of-entry-port-of-port-adelaide-determination-2021","history":"/api/acts/biosecurity-first-point-of-entry-port-of-port-adelaide-determination-2021/history","analysis":"/api/acts/biosecurity-first-point-of-entry-port-of-port-adelaide-determination-2021/analysis","conflicts":"/api/acts/biosecurity-first-point-of-entry-port-of-port-adelaide-determination-2021/conflicts","importantCases":"/api/acts/biosecurity-first-point-of-entry-port-of-port-adelaide-determination-2021/important-cases","documents":"/api/acts/biosecurity-first-point-of-entry-port-of-port-adelaide-determination-2021/documents"}}
