or\n(b) if the betting operator does not know the person’s location when\nthe bet is placed and the person is required to register an address\nwith the operator before placing a bet with the operator—the\nperson’s registered address is located in the ACT.\n7 Meaning of net ACT betting revenue\nIn this Act:\nnet ACT betting revenue, for a financial year, is worked out as\nfollows:\n(TB + TF) − (W + PC)\nPC means the total of any—\n(a) refunds of ACT bets made by the betting operator during the\nfinancial year; and\n(b) prescribed costs paid by the betting operator during the financial\nyear.\nTB means the total amount of all ACT bets placed with, or using a\nservice provided by, the betting operator during the financial year.\nTF means the total of any fees, commissions, or other amounts\nprescribed by regulation, associated with placing bets or using the\nservice, paid to the betting operator during the financial year.\n\nBetting operations tax Part 2\nSection 8\nR2\n28/03/19\nBetting Operations Tax Act 2018\nEffective: 28/03/19\npage 5\nAuthorised by the ACT Parliamentary Counsel—also accessible at www.legislation.act.gov.au\nW means the total amount of all winnings paid or payable by the\nbetting operator in relation to ACT bets during the financial year.\n8 Meaning of threshold amount\n(1) In this Act:\nthreshold amount means—\n(a) $150 000; or\n(b) if another amount is determined under subsection (2)—that\namount.\n(2) The Treasurer may determine a threshold amount for subsection (1).\n(3) A determination under subsection (2) is a disallowable instrument.\nNote A disallowable instrument must be notified, and presented to the\nLegislative Assembly, under the Legislation Act.\n9 Amount of bet\nIf all or part of a bet is placed other than in cash, the amount of the\nbet includes the monetary value of the non-cash component of the bet.\nExamples—non-cash component that may comprise all or part of a bet\n1 the amount or value of a debt to the extent it is released or extinguished by the\nbet\n2 the amount of any liability assumed under the bet, including an obligation to\npay any unpaid money\n3 digital currency within the meaning of the Anti-Money Laundering and\nCounter-Terrorism Financing Act 2006 (Cwlth)\nNote An example is part of the Act, is not exhaustive and may extend, but does\nnot limit, the meaning of the provision in which it appears (see\nLegislation Act, s 126 and s 132).\n\nPart 2 Betting operations tax\nSection 10\npage 6 Betting Operations Tax Act 2018\nEffective: 28/03/19\nR2\n28/03/19\nAuthorised by the ACT Parliamentary Counsel—also accessible at www.legislation.act.gov.au\n10 Liability to pay betting operations tax\n(1) A betting operator is liable to pay tax (a betting operations tax) on\nthe operator’s net ACT betting revenue for a financial year.\n(2) The amount of betting operations tax payable by the betting operator\nis—\n(a) if the operator’s net ACT betting revenue for the financial year\nis less than the threshold amount—nil; or\n(b) if the operator’s net ACT betting revenue for the financial year\nis the threshold amount or more—at the determined rate of the\namount by which the net ACT betting revenue exceeds the\nthreshold amount.\n(3) In this section:\ndetermined rate means—\n(a) 15%; (see s 6, s 10)\n\n- Defines an \"ACT bet\" as a bet placed with an operator by a person who is in the ACT when placing the bet, or — if the operator does not know the bettor's location and requires a registered address — where the bettor's registered address is in the ACT. (see s 6)\n\n- Calculates the taxable base (called \"net ACT betting revenue\") for a financial year as:\n (TB + TF) − (W + PC)\n where TB = total ACT bets placed with the operator, TF = fees/commissions (as may be prescribed), W = winnings paid or payable on ACT bets, and PC = refunds of ACT bets plus prescribed costs. (see s 7)\n\n- Applies a threshold. No tax is payable unless an operator's net ACT betting revenue for a year meets or exceeds the threshold. The default threshold is $150,000 but the Treasurer can set a different amount. (see s 8)\n\n- Applies a tax rate to the amount by which net ACT betting revenue exceeds the threshold. The default rate is 15%; a different rate can be set under the Taxation Administration Act 1999. (see s 10)\n\n- Requires operators who become liable to register with the revenue commissioner within set timeframes, to lodge returns and to pay the tax periodically. Timing and variation rules for returns and payments are set out, and the commissioner can vary those arrangements by written notice. (see s 11–14)\n\n- Treats non‑cash contributions to a bet (for example extinguishing a debt, assuming a liability, or digital currency) as part of the amount of the bet. (see s 9)\n\n- Gives the Executive power to make regulations under the Act. (see s 15)\n\n\nWho is affected\n\n- Betting operators: any person who earns revenue by accepting bets or by providing services through which bets are made. They are the taxpayers under the scheme and must register, keep records, lodge returns and pay the tax if their ACT-derived betting revenue exceeds the threshold. (see dictionary definition of \"betting operator\", s 10–14)\n\n- People placing bets in the ACT: the territorial scope is defined by where the bettor is located when placing the bet or, where the operator cannot determine that, by the bettor's registered address with the operator. That affects which bets are included in the taxable base. (see s 6)\n\n\nWhy it matters (practical effects, incentives and administrative features)\n\n- Revenue mechanism: The law converts a share of profitable ACT-sourced betting activity into a tax payable to the ACT (tax liability attaches to operators). (see s 10)\n\n- Compliance and administration: Operators must measure ACT-sourced betting receipts, winnings, refunds and prescribed costs separately for each financial year; register with the commissioner when liable; lodge returns and pay tax on the schedule required unless varied by the commissioner. These are ongoing record‑keeping and reporting obligations. (see s 7, s 11–14)\n\n- Discretion by officials and the Treasurer: The Treasurer can change the threshold amount by determination (a disallowable instrument). The applicable tax rate can be altered under the Taxation Administration Act 1999. The commissioner can vary return periods and timing, and can cancel or revoke registrations. Regulations can prescribe additional details (including the items counted as TF or PC). These give the executive and the revenue commissioner concrete levers to adjust scope, timing and details without further primary‑law amendment. (see s 8, s 10, s 14, s 15)\n\n- Behavioural incentives and possible substitution effects: Operators may respond to the tax and its reporting rules by changing product mix, geolocation and account‑registration practices (because liability depends on bettor location and registered address), adjusting pricing or fees, or consolidating operations. Bettors and operators might shift activity to alternatives (other jurisdictions, exempt products) if that reduces taxable exposure. The Act builds in specific rules on location and non‑cash bets that shape how operators must track and attribute transactions. (see s 6, s 9)\n\n\nCosts, trade‑offs and implementation issues to watch (mechanisms, not judgements)\n\n- Who pays: the legal taxpayer is the betting operator (s 10). Operators may pass some or all of the economic cost to customers via prices or fees, or absorb it.\n\n- Measurement complexity: The taxable base requires itemising bets, fees/commissions, winnings, refunds and prescribed costs (s 7). Including non‑cash components (s 9) adds valuation tasks. Determining bettor location where the operator does not know it (relying on registered addresses) creates an administrative shortcut that may be open to manipulation if users register addresses outside the ACT. (see s 6, s 9)\n\n- Compliance burden and timing: Registration must be applied for within a short timeframe after becoming liable (7 days after the month liability first arises) and returns are monthly unless varied (short payment windows of 7 days for interim periods). This creates a recurring administrative cost for operators and supervisory workload for the commissioner. (see s 11–14)\n\n- Bureaucratic discretion and flexibility: The commissioner and Treasurer have formal powers to vary timing, thresholds and rates, and regulations can add details. That reduces the need for primary legislation to tweak parameters but concentrates operational decisions in the executive and revenue agency.
