The only amendment (1989) was procedural — updating the land registration mechanism from manual to computer-based records. The Act still only affects the single parcel of land described in the Schedule, and the core purpose (freeing the land from the 1911 church-use restriction) has not expanded or morphed into broader application."},"complexity_factors":["Extremely short: only 2 operative sections plus a Schedule describing the land","Single purpose legislation with no conditional logic or exceptions","Only one amendment in 61 years (1989 update to section 2(4) changing land registration procedures from paper to computer system)","No defined terms section — relies on external documents (Crown grant, Methodist Model Deed) but doesn't incorporate complex definitions","Linear structure: preamble sets up problem, section 2 provides solution in straightforward subsections","No cross-references to other Acts except the specific 1910 St Kilda Land Act and the Methodist Model Deed"],"plain_english_summary":"This is a short Victorian law from 1939 that solves a very specific land problem for one church.\n\n**What it does:**\nIn 1911, the government gave a piece of land in Balaclava (a suburb of St Kilda, Melbourne) to trustees to hold forever for the Methodist Church. The original grant had a restriction: the land could only ever be used for church purposes and couldn't be sold.\n\nBy 1939, the church wanted to sell or develop this land, but legally couldn't because of that \"forever\" restriction. This Act removes that restriction.\n\n**Key changes:**\n- The trustees are now treated as owning the land outright (**fee simple** means full ownership with no strings attached)\n- The \"must hold forever for church purposes\" condition is cancelled\n- The trustees can now sell, mortgage, or deal with the land however they want\n- Any money from selling the land must still be used according to the Methodist Church's standard trust rules (the Methodist Model Deed)\n- The land titles office must update their records to reflect this change\n\n**Who it affects:**\nOnly the trustees of this specific piece of land in Balaclava and the Methodist Church (now part of the Uniting Church in Australia). This is what's called a **private Act** — legislation written for one specific situation rather than general rules for everyone.\n\n**Why it matters:**\nThis shows how Parliament sometimes has to pass special laws to unwind old restrictions on land. The 1910 St Kilda Land Act and the 1911 Crown grant created a permanent lock on this land. Without this 1939 Act, the church would have been stuck with land it couldn't sell, even if the land was no longer needed for religious purposes."},"flash_summary":{"complexity_score":2,"scope_assessment":{"changed":false,"description":"The Act's core effect — removing the Crown‑grant restriction and empowering trustees to alienate the specified land and apply proceeds under the Methodist Model Deed — remains the same as originally enacted. It requires the Registrar of Titles to record any necessary entries and obliges title‑holders to deliver certificates on request (s.2(4)). The Act transfers decision and financial control to trustees, creates registration and trust‑compliance duties, and revokes the 'for ever' church‑use condition (s.2(3))."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
