No. 116/2022 were made on 18 October 2022 by the Governor in Council under section 33 of the **Bail Act 1977**, No. 9008/1977 and came into operation on 10 December 2022: regulation 3.\n\nThe Bail Regulations 2022 will sunset 10 years after the day of making on 18 October 2032 (see section 5 of the **Subordinate Legislation Act 1994**).\n\nINTERPRETATION OF LEGISLATION ACT 1984 (ILA)\n\nStyle changes\n\nSection 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.\n\nReferences to ILA s. 39B\n\nSidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided regulation, rule or clause of a Schedule is amended by the insertion of one or more subregulations, subrules or subclauses the original regulation, rule or clause becomes subregulation, subrule or subclause (1) and is amended by the insertion of the expression \"(1)\" at the beginning of the original regulation, rule or clause.\n\nInterpretation\n\nAs from 1 January 2001, amendments to section 36 of the ILA have the following effects:\n\n• Headings\n\nAll headings included in a Statutory Rule which is made on or after \n1 January 2001 form part of that Statutory Rule. Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule. \nThis includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms. \nSee section 36(1A)(2A)(2B).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule. Any examples, diagrams or notes inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, form part of that Statutory Rule. See section 36(3A).\n\n• Punctuation\n\nAll punctuation included in a Statutory Rule which is made on or after \n1 January 2001 forms part of that Statutory Rule. Any punctuation inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule. \nSee section 36(3B).\n\n• Provision numbers\n\nAll provision numbers included in a Statutory Rule form part of that Statutory Rule, whether inserted in the Statutory Rule before, on or after \n1 January 2001. Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule. See section 36(3)(3D)(3E).\n\n2 Table of Amendments\n\nThis publication incorporates amendments made to the Bail Regulations 2022 by statutory rules, subordinate instruments and Acts.\n\n–––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––\n\nBail Amendment Regulations 2024, S.R. No. 52/2018.\n\n ——\n\n **Penalty Units**\n\n These Regulations provide for penalties by reference to penalty units within the meaning of section 110 of the **Sentencing Act 1991**. The amount of the penalty is to be calculated, in accordance with section 7 of the **Monetary Units Act 2004**, by multiplying the number of penalty units applicable by the value of a penalty unit.\n\n The value of a penalty unit for the financial year commencing 1 July 2025 is $203.51. The amount of the calculated penalty may be rounded to the nearest dollar.\n\n The value of a penalty unit for future financial years is to be fixed by the Treasurer under section 5 of the **Monetary Units Act 2004**. The value of a penalty unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year. However, the 2025 amendments (S.R. No. 16/2025) significantly expanded scope by adding Part 3 — a trial of electronic monitoring for children on bail across 31 metropolitan council areas. This transforms the instrument from purely administrative (prescribing paperwork) to substantive policy implementation (piloting GPS tracking for youth bail). The 2024 and 2026 amendments also added new procedural requirements for notices and refined existing forms, indicating ongoing functional expansion beyond simple form-prescription."},"complexity_factors":["Length is moderate (approximately 60 pages including forms), but highly structured and repetitive","Only 1 defined term in the interpretation section ('the Act'), though forms contain extensive field-specific terminology","Heavy cross-referencing to the Bail Act 1977 (the parent Act), with 23+ distinct section references","Multiple conditional logic paths within forms (asterisked optional clauses, 'delete if inapplicable' instructions)","21 distinct prescribed forms in Schedule 1, each with complex internal branching logic","Nested exceptions in Part 3 regarding electronic monitoring trial regions","Amendment history tracking through 4 separate amending instruments (2024-2026) creates version complexity"],"plain_english_summary":"**What this legislation does:**\n\nThese regulations are the paperwork engine room of Victoria's bail system. They prescribe the exact forms that must be used whenever someone is granted bail, refused bail, or needs to vary their bail conditions. Think of them as the standardised templates that keep the bail process consistent across all Victorian courts.\n\n**Who it affects:**\n\n- **Accused people** seeking release from custody while awaiting trial\n- **Bail guarantors** (people who promise money if the accused doesn't show up to court)\n- **Parents or guardians** of children who lack capacity to understand bail obligations\n- **Police, bail justices, and court staff** who process bail applications\n- **Prosecutors** (informants and the Director of Public Prosecutions) who can apply to vary or revoke bail\n\n**Key things the regulations cover:**\n\n- **Form 1 & 2**: The actual bail undertakings (promises to attend court) — different versions for general bail versus trial attendance\n- **Form 3**: Special undertakings for parents when a child can't understand bail\n- **Form 4**: The \"Notice of Obligations\" that explains to accused people what bail means and what happens if they breach it\n- **Forms 5-23**: Various administrative forms including warrants for arrest, applications to vary bail, and notices to guarantors\n- **Part 3**: A trial of electronic monitoring (ankle bracelets) for children on bail, limited to specific Melbourne metropolitan council areas\n\n**Why it matters:**\n\nBail is the difference between waiting for your trial in prison or in the community. These regulations ensure everyone — from the accused person to the police officer — uses the same paperwork, understands their obligations, and knows the consequences of non-compliance. The electronic monitoring trial (Part 3) represents a significant expansion of surveillance-based bail conditions for young people.\n\nThe regulations also protect vulnerable groups: children, Aboriginal people, and vulnerable adults receive specific information statements when bail is refused, ensuring they understand their right to apply to a court or bail justice."},"flash_summary":{"complexity_score":3,"scope_assessment":{"changed":false,"description":"The Regulations continue to perform their stated objectives: prescribing forms for use under the Bail Act 1977 and identifying prescribed regions for an electronic‑monitoring trial (reg 1; reg 6; reg 24; Sch 2).
