It specifies which occupations require notification before automatic deemed registration applies in NSW. The scope is narrow and precisely matches the legislative intent: to allow NSW to impose a notification requirement on specific occupations as a safeguard to automatic mutual recognition. There is no scope creep or expansion beyond this specific purpose."},"complexity_factors":["Very short instrument (only 6 sections, approximately 2 pages)","Single operative provision (section 6) containing a straightforward list","Only 1 defined term ('Act')","No cross-references to other legislation beyond the enabling Act and the specific NSW Acts listed","Simple structure: name, commencement, authority, outline, definitions, and the notification list","Exceptions are clearly marked with 'except' and bullet points rather than nested legislative prose","No conditional logic, temporal limitations, or procedural requirements beyond the basic notification requirement"],"plain_english_summary":"This rule requires certain professionals who rely on Australia’s automatic mutual recognition to notify the relevant NSW registration authority before they begin work in NSW. It targets a range of trades and licensed occupations (e.g., architects, surveyors, driving instructors, builders, taxi/rideshare drivers, pest and radiation users, tow‑truck and water‑drilling operators, and others). The change doesn’t stop mutual recognition but gives regulators advance notice to manage oversight."},"flash_summary":{"complexity_score":4,"scope_assessment":{"changed":false,"description":"The instrument itself sets a notification requirement for the named NSW registrations (see s6) and states its authority under subsection 42J(4) of the Mutual Recognition Act (s3). The text does not indicate any amendment or reduction of scope from a prior instrument or original intent."},"complexity_factors":["Cross‑jurisdictional trigger: instrument is made under subsection 42J(4) of the Mutual Recognition Act 1992 (Commonwealth) (see s3 Authority), so it sits at the interface of Commonwealth mutual recognition and NSW regulatory regimes.","Wide occupational scope with carve‑outs: s6 lists many NSW Acts and categories, but includes specific exceptions for certain subclasses (eg fire safety roles, certain Home Building categories), increasing the need to map precise eligibility.","Lack of procedural detail: s6 creates a notification requirement but does not specify form, timing, content of notification, or sanctions, producing implementation and compliance uncertainty for both applicants and local registration authorities.","Implementation timing and sunset: s2 fixes commencement to 1 December 2022 and s4 notes a legislated sunset mechanism (via Legislation Act 2003 and subsection 42J(5) of the Mutual Recognition Act), affecting administrative planning.","Multiple NSW Acts referenced: the determination relies on interpretation of numerous NSW statutes (eg Architects Act 2003, Building and Development Certifiers Act 2018, Work Health and Safety Act 2011), which can complicate consistent application across different regulators."],"plain_english_summary":"This determination requires a person to notify the relevant New South Wales local registration authority before they start relying on automatic ‘deemed registration’ under the Commonwealth Mutual Recognition Act. It applies to a specified list of NSW registrations and licences (for example architects, certain building and design practitioners, driving instructors, and various safety, surveying and transport licences), creating a pre‑start administrative step for interstate practitioners who would otherwise rely on automatic recognition."}},"importantCases":[],"_links":{"self":"/api/acts/automatic-mutual-recognition-new-south-wales-notification-requirement-various-determination-2022","history":"/api/acts/automatic-mutual-recognition-new-south-wales-notification-requirement-various-determination-2022/history","analysis":"/api/acts/automatic-mutual-recognition-new-south-wales-notification-requirement-various-determination-2022/analysis","conflicts":"/api/acts/automatic-mutual-recognition-new-south-wales-notification-requirement-various-determination-2022/conflicts","importantCases":"/api/acts/automatic-mutual-recognition-new-south-wales-notification-requirement-various-determination-2022/important-cases","documents":"/api/acts/automatic-mutual-recognition-new-south-wales-notification-requirement-various-determination-2022/documents"}}
