modified food means food that is, or contains as an ingredient, including a processing aid, a food produced using gene technology which –\n\n (a) contains novel DNA and/or novel protein; or\n (b) has altered characteristics;\n\n> but does not include –\n\n (c) highly refined food, other than that with altered characteristics, where the effect of the refining process is to remove novel DNA and/or novel protein;\n (d) a processing aid or food additive, except where novel DNA and/or novel protein from the processing aid or food additive remains present in the food to which it has been added;\n (e) flavours present in the food in a concentration no more than 1g/kg; or\n (f) a food, ingredient, or processing aid in which genetically modified food is unintentionally present in a quantity of no more than 10g/kg per ingredient.\n\n> altered characteristics means any of the matters specified in paragraphs 7(a), (b), (c) or (d) of this Standard.\n\n> novel DNA and/or novel protein means DNA or a protein which, as a result of the use of gene technology, is different in chemical sequence or structure from DNA or protein present in counterpart food which has not been produced using gene technology.\n\n(2) Any statement required by clause 5 may be contained in the statement of ingredients where the genetically modified food is an ingredient or processing aid.\n\n \n\n(3) Where genetically modified food is displayed for retail sale other than in a package, any information that would have been required under clause 5 of this Standard on the label on the food if it was packaged, must be displayed on or in connection with the display of the food.\n\n(4) This Division does not apply to food intended for immediate consumption which is prepared and sold from food premises and vending vehicles, including restaurants, take away outlets, caterers, or self-catering institutions.\n\n(5) Deleted\n\n(6) Deleted\n\n5 Labelling of genetically modified food\n\nThe label on a package of genetically modified food must include the statement ‘genetically modified’ in conjunction with the name of that food or ingredient or processing aid.\n\n> Note: Editorial note:\n\n> Note: An example for single ingredient genetically modified foods:\n\n> Note: Soy Flour\n\n> Note: Genetically Modified\n\n> Note: Soy Flour\n\n> Note: From genetically modified soya beans\n\n> Note: An example for genetically modified food ingredients:\n\n> Note: Ingredients: Soy Protein Isolate (genetically modified); Maltodextrin; Vegetable Oil; Food Acid (332); Emulsifier (471); Vegetable Gum (407); Water Added.\n\n6 Labelling of food which is not genetically modified\n\nThe label on a package of food which is not defined as ‘genetically modified food’ in clause 4 of this Standard is not required to include any statement about the genetic status of the food.\n\n7 Additional labelling/information requirements\n\nNotwithstanding the provisions of this Division, Column 4 of the Schedule may specify labelling or other information requirements in relation to food produced using gene technology listed in Column 3 of the Schedule where –\n\n (a) the genetic modification has resulted in one or more significant composition or nutritional parameters having values outside the normal range of values for existing counterpart food not produced using gene technology;\n (b) the level of anti-nutritional factors or natural toxicants are significantly different in comparison to the existing counterpart food not produced using gene technology;\n (c) the food produced using gene technology contains a new factor known to cause an allergic response in particular sections of the population;\n (d) the intended use of the food produced using gene technology is different to the existing counterpart food not produced using gene technology; or\n (e) the genetic modification raises significant ethical, cultural and religious concerns regarding the origin of the genetic material used in the genetic modification.","sortOrder":1},{"sectionNumber":"SCHEDULE","sectionType":"schedule","heading":"SCHEDULE","content":"## Definitions were also broadened/clarified (additions for 'conventional breeding', 'line', 'transformation event' in amendments), and clause 1(2) allows published edits to Columns 1–2 outside the Code proper, increasing administrative flexibility and the set of items businesses must monitor (cl.2; cl.1; Schedule; Amendment History)."},"complexity_factors":["Definition detail and technical triggers — multiple, interlocking definitions (\"food produced using gene technology\", \"gene technology\", \"line\", \"transformation event\", \"genetically modified food\", \"novel DNA and/or novel protein\") create interpretation points for applicability (cl.1; cl.4(1)).","Permitted-list mechanism — blanket prohibition with a positive Schedule of permitted foods means compliance turns on checking Schedule Column 3 and conditions in Column 4 (cl.2; Schedule).","Granular labelling thresholds and exemptions — exclusions for highly refined foods, residual processing-aid DNA/protein, flavour concentration and de minimis adventitious presence establish multiple operational thresholds businesses must apply (cl.4(1)(c)–(f)).","Special-condition labelling and risk factors — Column 4 and clause 7 allow extra labelling/information where composition, anti-nutrients, allergens, intended use or ethical/cultural concerns arise, adding situational obligations (cl.7; Schedule Col.4).","Retail and display rules — labelling may be satisfied via ingredients statement, and non-packaged retail displays must show required information, imposing different compliance steps for packaged vs displayed goods (cl.4(2)–(3); cl.5).","Administrative editing of ancillary information — clause 1(2) permits additions/edits to Columns 1 and 2 in published versions that are not part of the Code, creating an ongoing administrative update channel that businesses must monitor (cl.1(2)).","Extensive and frequent amendments — the Amendment History records numerous additions/changes to the Schedule and definitions over time, indicating maintenance and transitional complexity for regulated parties (Amendment History; Schedule entries).","Interfacing exclusions — notes excluding food from animals fed GM feed (unless animal itself is a product of gene technology) and exclusions for some additives/processing aids require cross-checking supply chains (cl.1 note; cl.4(1)(d)).","Who bears duties and enforcement points — obligations on sellers/importers to ensure listing and labelling mean business-level verification and recordkeeping burdens (cl.2; cl.5)."],"plain_english_summary":"Mechanically: this Standard forbids the sale or use of foods produced using gene technology unless each food is expressly listed in the Schedule and meets any conditions attached.
