No. 115/2019 were made on 26 November 2019 by the Governor in Council under sections 124 and 125 of the **Assisted Reproductive Treatment Act 2008**, No. 76/2008 and came into operation on 13 December 2019: regulation 3.\n\nThe Assisted Reproductive Treatment Regulations 2019 will sunset 10 years after the day of making on 26 November 2029 (see section 5 of the **Subordinate Legislation Act 1994**).\n\nINTERPRETATION OF LEGISLATION ACT 1984 (ILA)\n\nStyle changes\n\nSection 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.\n\nReferences to ILA s. 39B\n\nSidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided regulation, rule or clause of a Schedule is amended by the insertion of one or more subregulations, subrules or subclauses the original regulation, rule or clause becomes subregulation, subrule or subclause (1) and is amended by the insertion of the expression \"(1)\" at the beginning of the original regulation, rule or clause.\n\nInterpretation\n\nAs from 1 January 2001, amendments to section 36 of the ILA have the following effects:\n\n• Headings\n\nAll headings included in a Statutory Rule which is made on or after  \n1 January 2001 form part of that Statutory Rule. Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.  \nThis includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms.  \nSee section 36(1A)(2A)(2B).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule. Any examples, diagrams or notes inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, form part of that Statutory Rule. See section 36(3A).\n\n• Punctuation\n\nAll punctuation included in a Statutory Rule which is made on or after  \n1 January 2001 forms part of that Statutory Rule. Any punctuation inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule.  \nSee section 36(3B).\n\n• Provision numbers\n\nAll provision numbers included in a Statutory Rule form part of that Statutory Rule, whether inserted in the Statutory Rule before, on or after  \n1 January 2001. Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule. See section 36(3)(3D)(3E).\n\n2 Table of Amendments\n\nThis publication incorporates amendments made to the Assisted Reproductive Treatment Regulations 2019 by statutory rules, subordinate instruments and Acts.\n\n–––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––\n\nAssisted Reproductive Treatment Amendment Regulations 2020, S.R. Examples include: consent forms for treatment and donation (Schedules 1, 2, 2AA), a notice of separation form (Schedule 2A), certification forms to bring donor gametes or embryos into or out of Victoria (Schedules 7 and 8), an exemption application form (Schedule 9) and a statement of reasons form (Schedule 10).\n\n- Set out mandatory topics for counselling at several stages (before treatment, donation, surrogacy and posthumous use) and prescribe a minimum professional qualification for counsellors when counselling is provided outside a registered ART provider (regulation 7, 7A; Schedules referenced).\n\n- Require ART providers and doctors who perform artificial insemination to keep specified registers and record detailed information about donors, recipients, treatments, storage, transfers and outcome data (Schedules 3–6, reg 14–18). The Regulations prescribe the exact data fields to be recorded.\n\n- Create procedures and substantive checks for importing donor gametes or embryos into Victoria and for taking them out of Victoria, including the information that must be supplied to receiving/transfer parties, identification checks, use of a unique donor identifier where available, and a 25‑year record‑keeping period for certification documents (regulations 9C–9G; Schedules 7–8).\n\n- Allow the Secretary (departmental head) to declare countries or locations as prohibited for import of donor gametes/embryos where armed conflict or political unrest makes compliance with consent and record‑keeping doubtful (regulation 9H).\n\n- Prescribe which types of costs may be reimbursed to a surrogate mother and her partner (for example medical, counselling, legal, travel and limited reimbursed lost earnings) and set limits and exclusions (regulations 11 and 11A).\n\n- Prescribe the explanatory material the Donor Conception Registrar must give people applying for register information and people whose information may be disclosed (large list of counselling and support topics across regs 19A, 20–21A, 20A–20D, 22A etc.).\n\n- Fix an application fee for access to Central Register information and set exceptions (regulation 19). Fees and penalties are expressed in fee/penalty units (Endnotes explain current unit values).\n\n- List a set of offences for which infringement notices and monetary penalties may be issued (Schedule 11) and specify the infringement penalty for each.\n\nWho is affected\n\n- Donors: must complete prescribed consent forms, provide specified personal and medical information (reg 9B, Schedules 2/2AA), receive counselling on prescribed topics and may face limits on how many genetic siblings may be produced (section 29 of the Act is given effect in the Regulations).\n\n- People seeking ART (recipients): must sign prescribed consent forms; their treatments, child outcomes and identifying details are recorded in provider registers and the Central Register.\n\n- Registered ART providers and doctors performing artificial insemination: face detailed record‑keeping, identification, counselling and certification obligations, must complete and retain forms, and may be the party that gives or receives certifications for import/export of gametes/embryos (regs 14–18, 9C–9G, Schedules 3–8).\n\n- Surrogates and their partners: the Regulations list what costs may lawfully be reimbursed and require prescribed counselling before entering arrangements (regs 10–11A).\n\n- Donor Conception Registrar and the Secretary: responsible for managing Central and Voluntary Registers, supplying explanatory material, accepting applications, issuing exemptions and declaring prohibited locations (regs 17–22A, 9H, 9F/Schedule 9).\n\nWhy it matters (official purpose and how that plays out in practice)\n\n- Officially the Regulations exist to give effect to the Act by standardising consent, counselling, registers, certification for movement of donor material and administrative processes (regulation 1). That standardisation reduces legal uncertainty by fixing forms and the minimum information and counselling content.\n\n- In practice the Regulations extend the Act's administrative reach in several concrete ways:\n  - They create extensive record‑keeping and reporting burdens for providers and doctors (many prescribed data fields in Schedules 3–6; 25‑year retention for certification records at reg 9G(3)). That imposes ongoing administrative costs (staff time, secure storage, IT systems) on providers.\n  - They regulate cross‑border movement of donor material by requiring written certifications and detailed checks (regs 9C–9E, Schedules 7–8). That increases transactional friction and compliance cost for transfers between jurisdictions and gives the Secretary a safety valve (prohibited locations under reg 9H).\n  - They expand what the Donor Conception Registrar must do before disclosing information (detailed explanatory materials in regs 19A, 20–21A etc.), increasing administrative processing and support duties in handling applications.\n\nPractical effects on choices, costs and incentives\n\n- Who pays: providers and doctors bear most compliance costs (administration, record systems, counselling coordination). Donors must provide information and attend counselling; applicants for register information generally pay a fee (reg 19) unless exempted for hardship or prior payment. Intended parents typically reimburse prescribed surrogate costs; the Regulations set which items are reimbursable (regs 11, 11A).\n\n- Who decides: the Secretary has discretionary powers (eg. declaring prohibited locations — reg 9H; granting exemptions to compliance under section 37 of the Act, Schedule 9). Registered ART providers and authorised doctors decide whether certification requirements are met when receiving/transferring gametes (regs 9C–9D, Schedules 7–8).\n\n- Behaviour changes because of the rules:\n  - Providers will alter intake, transfer and storage processes to capture the required data fields and hold records for long periods.\n  - International transfers may fall away or be routed differently if the paperwork burden, identification checks or risk of prohibited‑location declarations make transfers harder.\n  - Donors may be discouraged from donating if they find the information disclosure rules or counselling requirements intrusive; alternatively, the clear consent forms may increase donor understanding.\n\nCosts, trade‑offs and implementation risks\n\n- Compliance burden and ongoing costs are concentrated on ART providers and clinicians: detailed data fields, identification checks, long retention (25 years for certifications), and preparation of explanatory material impose staff, recordkeeping and security costs (Schedules 3–6; reg 9G).\n\n- Bureaucratic discretion and potential for uneven application: the Secretary can declare prohibited import locations (reg 9H) and grant exemptions (reg 9F / Schedule 9). Those discretions may be necessary for safety but create legal uncertainty for cross‑border transfers and may produce delays.\n\n- Cross‑jurisdictional verification risk: where donor material or consents originate overseas, providers rely on undertakings and foreign documents (regs 9C, 9D and Schedules 7–8). If foreign records are inadequate, compliance may be hard to verify, leading to refused imports or reliance on exemptions.\n\n- Enforcement and deterrence: infringement penalties and specified offences are set out (reg 25 and Schedule 11). Monetary penalties are available for recordkeeping and disclosure breaches; these create legal risk and financial exposure for providers.\n\nConcentrated benefits and diffuse costs\n\n- Concentrated benefits: the Act and these Regulations concentrate benefits on people and agencies that value precise donor/offspring identity information (people seeking to obtain identifying information, the Registrar, and medical research that may use de‑identified data). The regulations create clarity for those uses (Schedules 6, 10 and explanatory materials).\n\n- Diffuse costs: the administrative burden and compliance costs are spread across all registered ART providers and clinicians who must upgrade processes, keep long records, and manage export/import certifications.\n\nKey statutory hooks and examples\n\n- Counselling qualification prescribed: full membership (or eligibility) of the Australian and New Zealand Infertility Counsellors Association is required where counselling is performed outside a registered ART provider (reg 7A).\n\n- Certification and recordkeeping for import/export: detailed checklists and forms at Schedules 7 and 8 and record retention obligations (reg 9C–9G).\n\n- Secretary discretion: prohibited import location declarations (reg 9H) and exemption power/process (Schedule 9).\n\n- Fees and penalties: application fee for Central Register information (reg 19 — 5.18 fee units unless exempt), and a table of infringement offences and penalties (reg 25, Schedule 11).\n\nBottom line (neutral)\n\nThese Regulations translate the Act into concrete administrative rules: they standardise consent and counselling, significantly expand prescribed data collection and retention, set tight procedures for moving donor material across borders, articulate the content of explanatory material the Registrar must provide, prescribe reimbursable surrogacy costs, and create an enforcement framework of infringement penalties. The practical effect is to increase administrative duties and compliance costs for providers and doctors, to centralise information in registers under statutory process, and to give departmental officers specific discretion over exemptions and international safety decisions (see regs 9C–9H, 14–18, 19, 25 and Schedules 3–9)."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available. They operate under the *Assisted Reproductive Treatment Act 2008* and tell clinics, doctors, donors, and patients exactly what paperwork, counselling, and record-keeping is required.\n\n**Who it affects:**\n- **Patients:** People seeking fertility treatment, including those using donor sperm or eggs, and women entering surrogacy arrangements.\n- **Donors:** People donating sperm, eggs, or embryos, including those donating from overseas or interstate.\n- **Surrogates:** Women carrying babies for others, and their partners.\n- **Clinics & Doctors:** All registered ART (Assisted Reproductive Treatment) providers and doctors performing artificial insemination.\n- **Donor-Conceived People:** Adults and children born from donor gametes who want to know their genetic origins.\n\n**What it actually does:**\n\n- **Consent Forms:** Prescribes the exact forms that must be signed before treatment or donation (including specific boxes to tick for importing/exporting genetic material). Different forms exist for donations made inside Victoria versus outside Victoria.\n- **Counselling:** Mandates specific topics that counsellors must cover, such as the emotional impact of donation, telling children about their donor origins, what happens if the donor withdraws consent, and the legal limit that one donor can help create children for no more than 10 women.\n- **Cross-Border Movement:** Sets strict certification rules for bringing donor sperm, eggs, or embryos into Victoria (or taking them out). This includes verifying donor identity, ensuring proper consent exists, and checking that the donor has been counselled. It also allows the government to ban imports from countries with armed conflict.\n- **Surrogacy Costs:** Lists exactly which expenses intended parents can reimburse to a surrogate mother and her partner (e.g., medical costs, legal advice, lost earnings up to 2 months around birth, insurance premiums).\n- **Registers:** Requires clinics to keep detailed registers tracking donors, patients, and children born. This information feeds into the Central Register managed by the Donor Conception Registrar.\n- **Information Disclosure:** Sets fees (around $87, calculated as 5.18 fee units) and procedures for donor-conceived people to apply to find out their donor's identity. It also requires the Registrar to provide detailed \"explanatory material\" about the emotional risks and benefits before releasing information.\n- **Contact Preferences:** Allows donors and donor-conceived people to lodge preferences about whether they want to be contacted, and requires explanatory material about these choices.\n- **Infringements:** Lists specific offences (like failing to keep records) that can result in fines (calculated in penalty units, currently $203.51 per unit).\n\n**Why it matters:**\nThese rules protect the welfare of children born through ART by ensuring they can access information about their genetic heritage. They protect donors by ensuring informed consent and limiting how many families can use one donor. They prevent the commercialisation of surrogacy by strictly limiting reimbursements to actual costs. Finally, they ensure Victoria maintains high clinical and ethical standards when genetic material moves across state or national borders."}},"importantCases":[],"_links":{"self":"/api/acts/assisted-reproductive-treatment-regulations-2019","history":"/api/acts/assisted-reproductive-treatment-regulations-2019/history","analysis":"/api/acts/assisted-reproductive-treatment-regulations-2019/analysis","conflicts":"/api/acts/assisted-reproductive-treatment-regulations-2019/conflicts","importantCases":"/api/acts/assisted-reproductive-treatment-regulations-2019/important-cases","documents":"/api/acts/assisted-reproductive-treatment-regulations-2019/documents"}}
