However, the current version shows significant scope expansion through: (1) insertion of Part 6A (Health) in 2010 adding health practitioner registration; (2) insertion of Part 7A (Hazardous substances) in 2005; (3) expansion of Part 6 to include working with children checks from all other Australian jurisdictions (NSW, Victoria, Queensland, WA, SA, NT, ACT) via statutory rules amendments in 2009 and 2014; (4) addition of dangerous criminal revival mechanism in 2021; (5) expansion of 'Justice Agency' definition to include Border Force/Immigration (2017) and other federal agencies (2018). The Schedule 1 exemptions have grown from a likely shorter original list to 8 Parts covering 40+ specific categories, transforming what was probably a simple rehabilitation measure into a complex, multi-jurisdictional public safety framework."},"complexity_factors":["15+ defined terms in section 3, including nested definitions ('annulled' has 3 sub-categories, 'Justice Agency' has 13 sub-paragraphs plus a catch-all 'prescribed body')","Extensive cross-referencing to other Tasmanian and Commonwealth legislation (Criminal Code, Youth Justice Act, Traffic Act, etc.)","Complex conditional logic in section 6: automatic annulment after good behaviour period, but with reset provisions if new imprisonable offence committed during waiting period, and recursive application of reset rules","Bifurcated treatment of traffic vs non-traffic offences in section 7 with specific exceptions for serious driving offences","Multiple exceptions to the non-disclosure rule in section 9(4) referencing Schedule 1, which contains 8 Parts and 40+ specific occupations/licences","Three separate mechanisms for revival of annulled convictions in section 10 (repeat same offence, public interest, dangerous criminal status)","Nested exceptions to offences in section 11 (disclosure offences) with 6 categories of lawful disclosure","Delegated legislative power allowing Governor to amend definitions and Schedule 1 by order (section 17)","Extraterritorial application requiring construction 'with such changes as may be necessary' for convictions from other jurisdictions (section 4)","Interaction with Royal prerogative of mercy preserved (section 13)"],"plain_english_summary":"**What this law does:**\n\nThis is Tasmania's \"spent convictions\" scheme — a law that lets people move on from old, minor criminal convictions by making them disappear from their official record after a period of good behaviour.\n\n**Who it affects:**\n\n- **People with minor convictions** (not serious crimes like sexual offences or crimes where you got more than 6 months in prison)\n- **Adults:** Their conviction gets wiped after 10 years of good behaviour\n- **Young people (under 18):** Their conviction gets wiped after 5 years of good behaviour\n- **Employers, police, and government agencies** who handle criminal records\n\n**How it works:**\n\n- If you stay out of trouble (no new convictions punishable by prison) for the required time, your old minor conviction is **\"annulled\"** (legally erased)\n- Once annulled, you generally **don't have to tell anyone about it** — not employers, not landlords, not most government forms\n- It **won't show up** in official criminal record checks for most jobs\n- **Traffic offences are treated separately** — they don't reset the clock for non-traffic offences, and vice versa (except for serious driving offences like drink driving)\n\n**Important exceptions:**\n\nSome jobs and licences still require you to disclose *all* convictions, even annulled ones. These include:\n- Judges, lawyers, and police\n- Prison and parole officers\n- Teachers and childcare workers\n- Health professionals\n- Firearms licences\n- Gaming and racing industry jobs\n- Security-sensitive dangerous substances permits\n\n**What you can't do:**\n\n- It's illegal to threaten to reveal someone's annulled conviction (fine up to 50 penalty units)\n- It's illegal for officials to improperly leak annulled conviction info\n- Courts can **revive** an annulled conviction if you reoffend seriously or become a \"dangerous criminal\"\n\n**Why it matters:**\n\nThis law gives people a **second chance**.
