Citation\n\n\t\tThese regulations may be cited as the *Agricultural Produce (Beekeeping Industry) Regulations 2003*.\n\n##### 2. Interpretation\n\nIn these regulations, unless the context otherwise requires —\n\nbeekeeper producer —\n\n(a) means a person whose business is or includes the production of bees, honey or any other product of bees or beehives; and\n\n(b) if section 19A of the Act applies — includes a person who produces any quantity of bees, honey or any other product of bees or beehives, whether for sale or not;\n\n charge —\n\n(a) means the charge imposed on a beekeeper producer under section 14(1) of the Act; and\n\n(b) in relation to a year, means the amount of the charge determined by the Commission in relation to the year under section 14(2) of the Act.\n\nDepartment means the department of the Public Service principally assisting in the administration of the Act.\n\n[Regulation 2 amended: SL 2020/49 r. 4.]\n\n##### 3. Publication of notice of charge\n\nNotice of the determination and amount of a charge imposed for a year under section 14 of the Act is to be published, in a newspaper circulating in the State, at least 14 days before the charge is due for payment under regulation 4(2).\n\n##### 4. Liability to pay charge\n\n(1) A beekeeper producer is liable to pay the charge for each year for which the service to which the charge relates is to be provided under a determination under section 14 of the Act.\n\n(2) The charge for a year is due for payment on 30 June of that year.\n\n(3) If the beekeeper producer is a company, the company and each director of the company are jointly and severally liable to pay the charge.\n\n[Regulation 4 amended: Gazette 5 Feb 2013 p. 825; SL 2020/49 r. 5.]\n\n##### 5. Payment of charge\n\n(1) The charge is payable to the chief executive officer of the Department.\n\n(2) The chief executive officer must forward to the Commission an amount equal to the amount of charge paid minus an amount by way of the cost of administering the collection of the charge.\n\n[Regulation 5 amended: SL 2020/49 r. 6.]\n\n##### 6. Unpaid charges\n\nIf a beekeeper producer does not pay an amount of charge for which the beekeeper producer is liable, the unpaid amount is a debt due to the State and is recoverable from the beekeeper producer in a court of competent jurisdiction.\n\n[Regulation 6 amended: SL 2020/49 r. 7.]\n\n![dline]()\n\nNotes\n\nThis is a compilation of the *Agricultural Produce (Beekeeping Industry) Regulations 2003* and includes amendments made by other written laws. It sets up a system where beekeepers must pay an annual fee (called a 'charge') to help fund industry services.\n\n**Who it affects:**\n- **Beekeeper producers** — defined as anyone whose business involves producing bees, honey, or other bee products. This includes hobbyists if a specific section of the main Act applies to them.\n- **Companies and their directors** — if a company owes the charge, the directors are personally on the hook too (jointly and severally liable).\n\n**What it does:**\n- The Agricultural Produce Commission decides how much the annual charge will be each year.\n- The Commission must publish a notice in a newspaper at least 14 days before the payment deadline (30 June each year).\n- Beekeepers must pay the charge by 30 June.\n- Payments go to the Department's CEO, who keeps some money for administration costs and passes the rest to the Commission.\n- If someone doesn't pay, the unpaid amount becomes a debt owed to the State and can be chased through the courts.\n\n**Why it matters:**\nThis is essentially a funding mechanism. It ensures beekeepers contribute to industry-wide services (like research, marketing, or biosecurity) coordinated by the Agricultural Produce Commission. The regulations make sure everyone knows when and how much to pay, and what happens if they don't."},"summary":{"complexity_score":1,"scope_assessment":{"changed":false,"description":"Scope cannot be assessed as no legislative content was retrievable.
