adoption for your child there are a number of different arrangements you can consider for raising your child. One of these arrangements may be best suited to you and your child.\n\nThese arrangements include—\n\n• *raising the child yourself* using the supports and financial benefits available in your community.\n\n• *temporary care* by another family until you have set up living arrangements, income and other supports.\n\n• *permanent care* of your child by another person who may have a legal order such as a parenting order. These orders involve the transfer of your legal responsibilities as a parent.\n\n • *adoption* of your child by another person under an adoption order. An adoption order involves the transfer of all of your legal responsibilities as a parent.\n\nWhen an adoption is finalised the Court makes an adoption order. This causes major legal changes affecting your relationship with \nyour child.\n\n*Transfer of rights and responsibilities*\n\nOnce an adoption order is made the child is treated in law in every way as the child of the parents who adopt the child. Your rights and responsibilities as a parent are given to the adoptive parent. An adoption order is permanent unless there are exceptional circumstances.\n\n*Names of the child*\n\nAfter adoption the child may have new names. When an adoption order is made the Court approves the names of the child specified in the adoption application. The surname is usually the surname of the parents applying to adopt.\n\nThey also select given names which may be new names or names by which the child is known.\n\n*New birth certificate*\n\nAfter adoption your child receives a new birth certificate which names the adoptive parents as the parents of your child and does not include your name.\n\n*Inheritance*\n\nAfter adoption your child is entitled to inherit from the adoptive parents as if the child was born to them.\n\nYour child may only inherit from you or your relatives if named in your will or the will of a relative.\n\n*Rights of natural parent*\n\nThe law allows natural parents to have some rights after an adoption order is made.\n\nIt entitles you to some information about your child after an adoption order is made.\n\nYou may be entitled to have access to your child if this has been included in the adoption order, or if other arrangements have been agreed to by you and the adoptive parents.\n\nWhen an adoption order is granted to a step-parent who is married to, or in a domestic relationship with, the parent still caring for the child, the law regards both of these parents as the child's parents. The parent still caring for the child in this case does not lose any of their rights as a parent.\n\nIf you are the other parent of the child (that is the parent who is no longer caring for the adopted child) you are no longer treated in law as the child's parent. All of the usual effects of an adoption order would apply to you once an adoption order is made.\n\nAt any time before or after an adoption order is made you may apply, subject to and in accordance with the **Births, Deaths and Marriages Registration Act 1996** to the Registrar of Births, Deaths and Marriages for a certified copy of, or extract from, the entry in the Register of Births relating to the child.\n\nTo obtain a copy of your child's original birth certificate you should apply either in writing or in person to—\n\nThe Registrar of Births, Deaths and Marriages,\n\nGround Floor, 595 Collins Street\n\nMelbourne 3000.\n\nThere are a number of organisations that provide family support services. No. 8/2019 were made on 19 February 2019 by the Governor in Council under section 130 of the **Adoption Act 1984**, No. 10150/1984 and came into operation on 24 February 2019: regulation 3.\n\nThe Adoption Regulations 2019 will sunset 10 years after the day of making on 19 February 2029 (see section 5 of the **Subordinate Legislation Act 1994**).\n\nINTERPRETATION OF LEGISLATION ACT 1984 (ILA)\n\nStyle changes\n\nSection 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.\n\nReferences to ILA s. 39B\n\nSidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided regulation, rule or clause of a Schedule is amended by the insertion of one or more subregulations, subrules or subclauses the original regulation, rule or clause becomes subregulation, subrule or subclause (1) and is amended by the insertion of the expression \"(1)\" at the beginning of the original regulation, rule or clause.\n\nInterpretation\n\nAs from 1 January 2001, amendments to section 36 of the ILA have the following effects:\n\n• Headings\n\nAll headings included in a Statutory Rule which is made on or after \n1 January 2001 form part of that Statutory Rule. Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule. \nThis includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms. \nSee section 36(1A)(2A)(2B).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule. Any examples, diagrams or notes inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, form part of that Statutory Rule. See section 36(3A).\n\n• Punctuation\n\nAll punctuation included in a Statutory Rule which is made on or after \n1 January 2001 forms part of that Statutory Rule. Any punctuation inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule. \nSee section 36(3B).\n\n• Provision numbers\n\nAll provision numbers included in a Statutory Rule form part of that Statutory Rule, whether inserted in the Statutory Rule before, on or after \n1 January 2001. Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule. See section 36(3)(3D)(3E).\n\n2 Table of Amendments\n\nThere are no amendments made to the Adoption Regulations 2019 by statutory rules, subordinate instruments and Acts.\n\n3 Amendments Not in Operation\n\nThere are no amendments which were Not in Operation at the date of this publication.\n\n4 Explanatory details\n\n1. They must also demonstrate they can support a child's cultural identity and maintain connections with the child's birth family if appropriate.\n\n* **Protect birth parents' rights** — Birth parents must receive counselling and clear information before giving consent. They can express wishes about the adoptive parents' background, request ongoing contact or information about the child, and revoke (take back) their consent within specific timeframes.\n\n* **Establish procedures for adoption agencies** — Organisations that arrange adoptions must meet strict standards for staff qualifications, financial viability, and record-keeping. They must renew their approval periodically.\n\n* **Cover international (intercountry) adoption** — The regulations include specific rules for adopting children from overseas, including accreditation under the Hague Convention (an international treaty protecting children in intercountry adoption) and approved partner organisations in countries like China, India, South Korea, and others.\n\n* **Provide detailed forms** — Schedule 1 contains 19 different forms for applications, consents, notices, and certificates, ensuring every step of the process is properly documented.\n\n* **Include special protections for Aboriginal children** — There are specific requirements to maintain Aboriginal children's connection to their community and culture, including consultation with Aboriginal agencies.\n\n**Who it affects:** Birth parents considering adoption, people wanting to adopt children (including step-parents and relatives), approved adoption agencies, the Victorian Secretary for Justice and Community Safety, and children being adopted (both from Victoria and overseas).\n\n**Why it matters:** These regulations ensure adoption is conducted safely, ethically, and with proper safeguards for everyone involved—especially children.
